AN ORDINANCE AUTHORIZING THE EXECUTION OF A
INTERGOVERNMENTAL AGREEMENT FOR TRANSFER OF JURSDICTION OF
ELDAMAIN ROAD SOUTH OF ROUTE 34 BETWEEN THE COUNTY OF KENDALL
AND THE UNITED CITY OF YORKVILLE
WHEREAS, it is in the best interests of the UNITED CITY OF YORKVILLE to enter
into an agreement with THE COUNTY OF KENDALL,hereinafter referred to as "COUNTY",
to transfer jurisdiction of ELDAMAIN ROAD to the COUNTY beginning at the south corporate
limits of The United City Yorkville, a point approximately 1700' south of Route 34 and
extending northwest to the intersection of ELDAMAIN ROAD and Route 34, a copy of which is
attached hereto and made a part hereof and designated as Exhibit"A", be entered into; and
WHEREAS,the CITY desires to ensure that ELDAMAIN ROAD will continue to attract
new residential, commercial, and industrial users and provide said users adequate access and
other transportation-related efficiencies; and
WHEREAS, the statutory procedures provided for in Division 92.2 of Article I 1 of the
Municipal Code, as amended, for the execution of said Intergovernmental Agreement have been
fully complied with; and

WHEREAS, the corporate authorities, after due investigation and consideration have
determined that entering into the boundary agreement in the form of Exhibit"A"hereto will
serve the public good and benefit the UNITED CITY OF YORKVILLE and be compatible with
the future development of the UNITED CITY OF YORKVILLE.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF
THE UNITED CITY OF YORKVILLE, KENDALL COUNTY, ILLINOIS, as follows:
Section 1: That the Mayor and Alderman of the UNITED CITY OF YORKVILLE
hereby find as facts all of the recitals in the preamble of this Ordinance, as well as the preambles
contained in the Intergovernmental Agreement in the form of Exhibit"A"hereto.
Section 2: That the Mayor is authorized and directed to execute, and the Clerk is
directed to attest the Intergovernmental Agreement, three copies of which is attached hereto as
Exhibit"A"and made a part hereof.
Section 3: That this Ordinance is adopted pursuant to the provisions and procedures
set forth in Section 5/11-91.2-1 of the Illinois Compiled Statutes (65 ILCS 5/11-91.2-1).
Section 4: The City Clerk is hereby authorized and directed to file a certified copy of
this Ordinance and the Agreement, after execution by all parties, in the Office of the Recorder of
Deeds of Kendall County, Illinois and file for record in her office one copy of the executed
Agreement.
Section 5: The City Clerk is hereby authorized and directed to forward three certified
copies of this Ordinance and the Agreement, after execution by all parties, to the Illinois
Department of Transportation.
Section 6: This Ordinance and the Agreement attached hereto as Exhibit"A"shall be

in full force and affect after certified copies of this Ordinance and the Agreement attached hereto
as Exhibit"A"have been filed for record as provided for in Sections 4 and 5 of this Ordinance
and as further provided by Law.
REPEALER: All ordinances or parts of ordinances conflicting with any of the provisions
of this ordinance shall be and the same are hereby repealed.
SEVERABILITY: If any section, subsection, sentence, clause, phrase or portion
of this ordinance is for any reason held invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and
such holding shall not affect the validity of the remaining portions hereof.
EFFECTIVE DATE: This ordinance shall be in effect from and after its passage, approval
and publication in pamphlet form as provided by law.
IN WITNESS WHEREOF, this Ordinance has been enacted this '^day of

KENDALL AND THE UNITED CITY OF YORKVILLE
WHEREAS, THE UNITED CITY OF YORKVVLLE, hereinafter referred to as
"CITY", has entered into an agreement with KENDALL COUNTY, hereinafter referred
to as "COUNTY", to transfer jurisdiction of ELDAMAIN ROAD to the COUNTY
beginning at the south corporate limits of The United City Yorkville, a point
approximately 1700' south of Route 34 and extending northwest to the intersection of
ELDAMAIN ROAD and Route 34; and
WHEREAS, the CITY desires to ensure that ELDAMAIN ROAD will continue to
attract new residential, commercial, and industrial users and provide said users adequate
access and other transportation-related efficiencies; and
THEREFORE, KENDALL COUNTY AND THE UNITED CITY OF
YORKVILLE MUTUALLY AGREE, that said parties will adhere to the following
recitals in administration of the construction,maintenance and permitting activities on
that section of ELDAMAIN ROAD identified above, and including new sections of
ELDAMAIN ROAD that will become incorporated into the CITY:
1. The COUNTY shall "grandfather" all existing non-agricultural entrances and
allow them to remain in perpetuity.
2. The COUNTY shall allow one full-access to the east side of ELDAMAIN
ROAD for the Fox Hill—Unit 7 Subdivision.
3. The COUNTY shall allow one additional full-access to the east side of
ELDAMAIN ROAD between U.S. Route 34 and the Fox Hill—Unit 7
Subdivision for the commercial-zoned property at this location, provided said
entrance conforms in all other ways to the Kendall County Highway Access
Ordinance and one right-in/right-out access to the east side of ELDAMAIN
ROAD between U.S. Route 34 and the Fox Hill—Unit 7 Subdivision for the
commercial-zoned property at this location,provided said entrance conforms
in all other ways to the Kendall County Highway Access Ordinance. In the
event, that the proposed full commercial entrance to Unit 7 of Fox Hill
Subdivision does not meet COUNTY distance requirements for a full
intersection in relation to Route 34, the COUNTY will in any event grant a

highway access permit on the east side of ELDAMAIN ROAD for a full
access drive serving the commercial area so long as it lines up with the
proposed full access which is being designed and planned by the City of Plano
to be located at the Southerly edge of the commercial portion of the Inland
real estate development at the southwest corner of ELDAMAIN ROAD and
Route 34 and the northerly boundary of the Lakewood Residential
Development immediately south and contiguous of the Inland Commercial
Development; it being intent of all parties that a full major intersection be
constructed on both sides of ELDAMAIN ROAD at that location.
4. The COUNTY, in its administration of the Kendall County Highway Access
Regulation Ordinance, will classify ELDAMAIN ROAD between River Road
and Galena Road as an Access 2 Highway, allowing full-access points not less
than every 1/3 mile. Nothing will prevent the COUTNY from seeking a
greater access spacing if both parties agree that the greater spacing will still
adequately serve industrial or residential developments in the future.
5. The County agrees to maintain ELDAMAIN ROAD within the CITY
Corporate Limits as an 80,OOOpound truck route.
6. In the spirit of intergovernmental cooperation, the COUNTY will work with
the CITY to foster economic development along the ELDAMAIN ROAD
CORRIDOR, insofar as administration of roadway issuers can achieve this
end.
7. The CITY will require new development to reserve and dedicate to the
COUNTY not less than 75' of right-of-way for ELDAMAIN ROAD;
measured from the centerline of road to the right-of-way line, and providing a
total right-of-way width of 150'.
8. Considering the mutual benefits derived from an efficient transportation
facility, the City, in negotiating any new annexation agreements, will pursue
funding from the developers for improvements to ELDAMAIN ROAD.
These funds will be made available to the COUNTY to improve the road so
that it will be functional in both capacity and structure.

Please be advised that the United City of Yorkville approved the Intergovernmental
Agreement transferring the jurisdiction of Eldamain Road to the County of Kendall.
Furthermore the City also passed the Ordinance authorizing execution of the
Intergovernmental Agreement and authorizing the City Clerk to forward the documents
to appropriate governmental entities. Pursuant to your fax of February 9,2004 please
contact my office and let me know which IDOT engineer and their address I should
forward the Intergovernmental Agreement and the Ordinance to. Upon receipt of that
information and the execution of the Intergovernmental Agreement by Kendall County I
will forward the documents to Illinois Department of Transportation.

Stipulation Letter
Dear Commissioner Murst:
In connection with the jurisdictional transfer of Eldamain Road from Little Rock Road District to
Kendall County, the County stipulates that, upon approval of the transfer of Eldamain Road,
Kendall County will own and maintain the drainage pipes under Eldamain Road at the Rob Roy
Creek. In fact,Kendall County will be responsible for maintaining all roadway-related facilities
for the entire length of Eldamain Road, and the Road District will have no further obligation to
maintain any part of Eldamain Road.

Concurrence Letter
Dear Commissioner Heinz:
Kendall County and Little Rock Road District are planning to enter into an agreement to transfer
jurisdiction of Eldamain Road (TR60A) from River Road to the south corporate limits of
Yorkville(see attached location map). Upon execution of the Jurisdictional Transfer Agreement,
this section of roadway will become a part of the Kendall County Highway System. Since you
are an adjacent township to this section of roadway, the Illinois Department of Transportation
requires your concurrence with the jurisdictional transfer. If acceptable,please sign and date this
letter indicating your concurrence with the jurisdictional transfer as described herein.
As you may know,Kendall County is pursuing jurisdictional transfers with City of Plano, City of
Yorkville,Bristol Road District and Little Rock Road District to secure jurisdiction of the entire
length of Eldamain Road, from River Road to Galena Road.

under Section 6-201.3 of the Illinois Highway Code.

Providing for the addition of a portion of Eldamain Road(CH 7) to the County Highway System
WHEREAS, the County Board of Kendall County and the City of Yorkville have entered into
an agreement to transfer jurisdiction of Eldamain Road to Kendall County,
THEREFORE, BE IT RESOLVED, by the County Board of Kendall County, and subject to
review and approval by Illinois Department of Transportation, that Eldamain Road from the
south corporate limits of Yorkville, a point approximately 1700' south of U.S. Route 34, and
extending northerly to U.S. Route 34, be added to the highway system of Kendall County.
BE IT FURTHER RESOLVED, that the Kendall County Clerk is hereby directed to forward
three certified copies of this Resolution to the State of Illinois through its District Engineer's
Office at Ottawa, Illinois.
