AN ORDINANCE ADOPTING THE INTERNATIONAL FIRE CODE
ORDINANCE NO. 2003-06
An ordinance of the United City of Yorkville adopting the 2000 edition of the
International Fire Code, regulating and governing the safeguarding of life and property
from fire and explosion hazards arising from the storage, handling, and use of hazardous
substances, materials and devices, and from conditions hazardous to life or property in the
occupancy of buildings and premises in the United City of Yorkville, providing for the
issuance of permits for hazardous uses or operations; and repealing Ordinance
No. 1996-12 of the United City of Yorkville and all other ordinances and part of the
ordinances in conflict therewith.
THE CITY COUNCIL OF THE UNITED CITY OF YORKVILLE does ordain as
follows:
Section 1. That certain documents, three (3) copies of which are on file in the office of
the City Clerk and the United City of Yorkville, being marked and designated as the
International Fire Code, including Appendix Chapter C, D, E, F, and G (2000 Edition), as
published by the International Code Council, Inc., be and is hereby adopted as the code of
the United City of Yorkville for regulating and governing the safeguarding of life and
property from fire and explosion hazards arising from the storage, handling and use of
hazardous substances, materials and devices, and from conditions hazardous to life or
property in the occupancy of buildings and premises in the United City of Yorkville and
providing for the issuance of permits for hazardous uses or operations; and each and all of
the regulations, provisions, conditions and terms of such International Fire Code, 2000
edition, on file in the office of the United City of Yorkville are hereby referred to, adopted
and made a part hereof as if fully set out in this ordinance.
Section 2. The following sections are hereby revised:
Section 101.1 Title. Insert: United City of Yorkville, Kendall County,
Illinois
Section 109.3 Violation penalties. Delete: "...shall be guilty of a
[SPECIFIC OFFENSE], punishable by a fine of not more than [AMOUNT]
dollars or imprisonment not exceeding [NUMBER OF DAYS], or both such
fine and imprisonment." Insert: "...shall be punished by a fine of not less
than seventy-five dollars ($75.00) nor more than five hundred dollars
($500.00).
Section 111.4 Failure to comply. Insert: seventy-five dollars ($75.00), five
hundred dollars ($500.00).
Section 3. That the limits referred to in certain sections of the 2000 International Fire
Code are hereby established as follows:
Section 3204.3.1.1 Location. Delete: "...within the limits established by
law in the adopting ordinance as the limits of districts in which such storage
is prohibited." Insert: "...within all zoning districts except Manufacturing
and Industrial."
Section 3404.2.9.5.1 Locations where above-ground tanks are
prohibited. Delete: "...within the limits established by law in the adopting
ordinances as the limits of districts in which such storage is prohibited."
Insert: "...within all zoning districts except Manufacturing and Industrial."
Section 3406.2.4.4 Locations where above-ground tanks are prohibited.
Delete: "...within the limits established by law in the adopting ordinances as
the limits of districts in which such storage is prohibited." Insert: "...within
all zoning districts except Manufacturing and Industrial."
Section 3804.2 Maximum capacity within established limits. Delete:
"Within the limits established by law in the adopting restricting the storage
of liquefied petroleum gas..." Insert: "Within all zoning districts except
Manufacturing and Industrial, the storage of liquefied petroleum gas is
restricted..."
Section 4. That Ordinance No. 1996-12 of United City of Yorkville entitled Ordinance
Adopting 1996 BOCA and National Codes 1995 CABO One and Two Family Dwelling
Code 1996 National Electrical Code and all other ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 5. That if any section, subsection, sentence, clause or phrase of this ordinance
is, for any reason, held to be unconstitutional, such decision shall not affect the validity of
the remaining portions of this ordinance. The City Council hereby declares that it would
have passed this ordinance, and each section, subsection, clause or phrase thereof,
irrespective of the fact that any one or more sections, subsections, sentences, clauses and
phrases be declared unconstitutional.
Section 6. That the City Clerk is hereby ordered and directed to cause this ordinance to
be published.

Section 7. That this ordinance and the rules, regulations, provisions, requirements,
orders and matters established and adopted hereby shall take effect, and be in full force
and effect after its passage and approval by the Mayor and City Council, as required by
law.
IN WITNESS WHEREOF, this Ordinance has been enacted this 14`h day of
January, 2003.
