Ordinance 2003-09 • 4 STATE OF ILLINOIS COUNTY OF KENDALL AN ORDINANCE ADOPTING THE INTERNATIONAL PROPERTY MAINTENANCE CODE ORDINANCE NO. 2003-09 An ordinance establishing the minimum regulations governing the conditions and maintenance of all property, buildings, and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such structures; known as the International Property Maintenance Code. THE CITY COUNCIL OF THE UNITED CITY OF YORKVILLE does ordain as follows: Section 1. That certain documents, three (3) copies of which are on file in the office of the City Clerk and the United City of Yorkville, being marked and designated as the International Property Maintenance Code (2000 Edition), as published by the International Code Council, Inc., be and is hereby adopted as the Property Maintenance Code of the United City of Yorkville, in the State of Illinois; for the control of buildings and structures as herein provided; and each and all of the regulations, provisions, penalties, conditions and terms of said International Property Maintenance Code, 2000 edition, are hereby referred to, adopted, and made a part hereof, as if fully set out in this ordinance, with the additions, insertions, deletions, and changes, if any, prescribed in Section 2 of this ordinance. Section 2. The following sections are hereby revised: Section 101.1 Title. Insert: United City of Yorkville, Kendall County, Illinois Section 103.6 Fees. Delete in its entirety. Insert: The fee schedule is in accordance with the Building Permit Fees Ordinance. Section 303.14 Insect screens. Insert: March 31, October 31 Section 602.3 Heat supply. Insert: October 1, April 30 Section 602.4 Occupiable work spaces. Insert: October 1, April 30 Section 3. That Ordinance No. 1996-12 of the United City of Yorkville entitled Ordinance Adopting 1996 BOCA and National Codes 1995 CABO One and Two Family Dwelling Code 1996 National Electrical Code and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 4. That nothing in this ordinance or in the International Property Maintenance Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 2 of this ordinance; nor shall any just or legal right or remedy of any character be lost, impaired, or affected by this ordinance. Section 5. That the City Clerk shall certify to the adoption of this ordinance, and cause this ordinance to be published as required by law. Section 6. That this ordinance and the rules regulations, provisions, requirements, orders and matters established and adopted hereby shall take effect, and be in full force and effect after its passage and approval by the Mayor and City Council, as required by law.
