City Council Minutes 2014 01-28-14 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE UNITED CITY OF YORKVILLE,KENDALL COUNTY,ILLINOIS. HELD IN THE CITY COUNCIL CHAMBERS, 800 GAME FARM ROAD ON TUESDAY,JANUARY 28.2014 Mayor Golinski called the meeting to order at 7:00 p.m. and led the Council in the Pledge of Allegiance. Route 71 Sanitary Sewer and Water Main Replacement—Engineering Agreement between the United City of Yorkville and Engineering Enterprises,Inc. -authorize the Mayor and City Clerk to execute (PW 2014-01) 2. Windett Ridge—Plat of Easement-authorize the City Clerk, City Administrator, and City Engineer to execute(PW 2014-02) 3. Minutes of the Regular City Council—January 14,2014(CC 2014-04) Mayor Golinski entertained a motion to approve the minutes of the regular City Council meeting for January 14,2014 as presented. So moved by Alderman Colosimo; seconded by Alderman Frieders. Minutes approved unanimously by a viva voce vote. BILLS FOR PAYMENT Mayor Golinski stated that the bills were$1,086,744.76. REPORTS MAYOR'S REPORT Ordinance 2014-02 Disconnecting Certain Territory from the Boundaries of the United City of Yorkville(Hoover Forest Preserve) (CC 2014-03) Mayor Golinski entertained a motion to approve an ordinance disconnecting certain territory from the boundaries of the United City of Yorkville(Hoover Forest Preserve)and authorize the Mayor and City Clerk to execute. So moved by Alderman Kot; seconded by Alderman Frieders. Motion approved by a roll call vote. Ayes-6 Nays-2 Spears-nay, Colosimo-aye,Funkhouser-aye,Milschewski-nay, Teeling-aye,Koch-aye,Kot-aye,Frieders-aye Appointment of Freedom of Information Officer—Amber Rasmusson (CC 2014-05) Mayor Golinski entertained a motion to approve the appointment of Amber Rasmusson as a freedom of information officer. So moved by Alderman Colosimo; seconded by Alderman Frieders. Motion approved by a roll call vote. Ayes-8 Nays-0 Colosimo-aye,Funkhouser-aye,Milschewski-aye,Teeling-aye, Koch-aye,Kot-aye,Frieders-aye, Spears-aye BUILD Permit Program (CC 2014-06) City Administrator Olson said the City is looking for direction on the Windett Ridge subdivision.The subdivision recently improved the annexation agreement to reduce the impact fees. There has been interest with Ryland homes coming in. They have a couple buyers on the line and are ready to get permits.They are interested in the build program. The total fees of those homes are about$2700. The recommendation on committee level is to not go beyond what the permit fee is.Alderman Teeling asked about fees. City Administrator Olson said the two main fees were water and sewer. Those two fees alone go up to $5000. In Windett Ridge Subdivisions many fees were prepaid and some negotiated away. Alderman Teeling feels the City should only rebate what the City can based on its fees.Mayor Golinski agrees with Alderman Teeling.Alderman Colosimo voted against the build program.He thinks it served its purpose,and now it is time to stop.Mayor Golinski wanted to know if the Council wanted to continue the build program. It comes up for renewal in March.Alderman Kot supports the build program.Mayor Golinski agrees with Alderman Kot.Alderman Koch and City Administrator Olson discussed Windett Ridge and Ryland homes.Alderman Funkhouser supports the build program.Alderman Milschewski, Alderman Frieders,and Alderman Koch want to give the build program another year.Mayor Golinski said the City will extend the build program. The City shouldn't go above the fees that the subdivision generates. City Attorney Orr said under the original program the developer was required to put up $5000. She asked if the developer will be required to match the new dollar amount or required to do the$5000. Community Development Barksdale-Noble said the ordinance was written saying the City can put up to $5000 and the contribution from the developer can be up to a match. PUBLIC WORKS COMMITTEE REPORT Road to Better Roads 5-Year Plan Update (PW 2014-06) City Administrator Olson said Public Works Committee recommended the City goes with the scaled back fiscal year 15.He asked if the Council wanted to proceed with the committee's recommendation.Also, what does the City want to do long term?The main component of the City Council budget presentations i I The Minutes of the Regular Meeting of the City Council—January 28,2014—Page 3 of 4 will be showing what is and is not discretionary in the water and sewer funds. Everything else is concerning the road to better roads. There is a direct correlation to the City participating in the road to better roads and having to raise or lower water and sewer rates. That is the long term discussion. Council's direction is needed.Alderman Kot asked about the million dollars for infrastructure improvements. City Administrator Olson answered his question.Alderman Kot fully supported the road to better roads but does not think fees should be raised.Alderman Koch liked the study but is reluctant to raise fees. He suggested bonds or doing a referendum.Alderman Teeling does not want to raise fees.Alderman Colosimo likes pay as you go. Instead of borrowing money,he would rather see the improvements and then generate the revenues with those improvements.He will not vote to increase fees.Mayor Golinski agrees with Alderman Colosimo. The City can't saddle itself with more long term debt. The City is not looking at raising any water or sewer fees at this point.Alderman Spears stated the roads that are listed to be repaired fiscal year 2017 and 2018 should be moved to fiscal year 2016 due to the many road problems.Alderman Teeling stated the roads in Countryside have water main breaks often. She agrees with Alderman Spears. City Administrator Olson said if the City does not raise rates next year then the road to better roads is looking at fixing one road. Cannonball and Kennedy Roads have been accelerated in fiscal year 2015, so the majority of the City's capital road funding are going to those two projects.The incremental revenue from this is going to offset the road to better roads program in those funds.Even with the proposed increases in sewer and water the long term budget direction is to run deficits each year and bring up the fund balance.Alderman Colosimo stated the City did a road study to prioritize roads. The road study's prioritization should be followed.Alderman Funkhouser said the City can address the issues through bonds. If the City doesn't increase the rates then there is no way to maintain its obligations. He cannot support the idea of a referendum. It is the Council's obligation to provide a service and keep the services that the City needs functional. The money that the City has allocated coming in from the fees are not going to sustain what the City has in terms of maintenance and the obligations it has to provide for the residence. He doesn't want to raise fees but by this report the City is going to have to in order to maintain its system. The City can either bond or raise the rates. The City has to do something for it has failing systems. Rates have to be looked at Mayor Golinski asked when were water rates last increased. City Administrator Olson said they gradually increased the past five years.There hasn't been a scheduled rate increase. Sewer has not changed since 1998.Alderman Frieders said the main complaint he hears about are roads.The City needs to keep moving on them. He doesn't care if the rates go up.Fix as many roads as the City can and do one or two of the main infrastructure improvements per year, if possible.The City is going to have to raise rates.Alderman Teeling is upset that the City didn't raise the rates enough initially. She added that when there is a water main break on Kendall Drive the water floods the streets. This costs the City thousands of dollars.Alderman Frieders asked if it was possible to continue with road to better roads as it is,fixing esthetics and then add fees to that bill. The fees could be used for East and West Kendall.Then the residents would know that for the next three years rates are going up to pay for East and West Kendall.Alderman Kot said the problem is if the City paves a road that needs its infrastructure fixed,then eventually the road will need to be torn up. Alderman Frieders said the City has two categories. Roads that don't need the infrastructure improvements and roads that do. So 2015 get the other roads capped. The East&West Kendall have to be addresses sooner than later.The City has road to better roads which is plural.Get roads capped and then tackle the larger ones. That is when the rate increases have to come.Alderman Kot reminded the Council that under the current fee structure the City is getting roads done. He asked about other types of funding. City Administrator Olson discussed funding. Alderman Frieders stated it sounds like there are two different projects,which can't be lumped together. Rates are going to have to be raised.Alderman Kot stated as of now residents are paying$32 every two months. That is$8 for water, $8 for sewer, and$16 for roads.He suggested shuffling the numbers around as long as they don't exceed$32.Mayor Golinski said Alderman Kot made a good point.This year the City has done more than it has in previous years.Alderman Colosimo said the decision made today doesn't have to be permanent. He likes Alderman Kot's idea of shuffling money around.Let's be vigilant about what the City does and keep progressing. ECONOMIC DEVELOPMENT COMMITTEE REPORT No report. ADMINISTRATION COMMITTEE REPORT NIMEC Bid for Electric Accounts (CC 2014-07) Alderman Spears made a motion to authorize the City Administrator and Finance Director to approve the lowest bid and to execute contracts to secure the provision of electricity from the lowest bidder as presented by NIMEC for a one year of three year period, such authority effective only for the current NIMEC bid cycle ending in April 2014; seconded by Alderman Colosimo. So moved by Alderman Frieders; seconded by Alderman Milschewski. Motion approved by a roll call vote. The City of Aurora's contract and terms of agreement were discussed.The City has two more years with the CVB. STAFF REPORT Salt Supply n City Administrator Olson discussed the City's salt supply,which is at about 700 tons. ADDITIONAL BUSINESS None. EXECUTIVE SESSION Mayor Golinski entertained a motion to go into Executive Session for the purpose of 1. For litigation. 2. For the appointment, employment, compensation, discipline, performance, or dismissal of specific employees of the public body or legal counsel for the public body, including hearing testimony on a complaint lodged against an employee of the public body or against legal counsel for the public body to determine its validity. Mayor Golinski said the City Council will adjourned for executive session for litigation and employment. The City Council entered Executive Session at 8:03 p.m. The City Council returned to regular session at 9:00 p.m. CITIZEN COMMENTS Kris Lackey, Whispering Meadows president,asked Mayor Golinski what the City's plans were for getting the roads finished.Mayor Golinski stated this is public comment only.Not public debate.
