The minutes from the July 25, 2013 meeting were approved as submitted. There were no meeting minutes for the August 2013 meeting because it was cancelled. There were no comments or corrections to the July 25, 2013 minutes. The first and only item on the November 14, 2013 agenda is: PC 2013-15 & PC 2013-16 Green Organics Application for Rezoning & Special Use - Ms.Noble started with comments: Staff went through the actual application as well as the annexation agreement for the Westbury Village, which is also affected by this. In general, the property is approximately 57 acres currently. There is lease land of about 31.88 acres of where Green Organics is conducting a compost facility and landscape waste (with some food waste) operations. They are currently on the county parcel as well as a portion of the city parcel in Westbury Village. They are looking to reconfigure their site. She asked Mr. Dave Gravel of Green Organics for some background on what they're trying to do. In 1999, Green Organics acquired the operation from Scott's and have been operating since that time. The original site has an "L-shape" configuration, with the southern portion currently under lease (until 2014) with Ocean Atlantic. In order to maintain their present operation here, they are exploring options to re-configure the site. They approached one of the other land owners, Bristol Ventures, which owns the rectangular, most northern portion, with the thought to reconfigure and add on land adjacent to that. There are no proposed changes to the County side—all proposed improvements are for the City side of the property. The IEPA permit was originally for landscape material only; no manure or mushrooming products are accepted. However, in 2010, the State of Illinois (through legislation known as SB 99)permitted compost facilities to accept up to 10% of their total volume in food scraps. It is referred to as an additive from the EPA perspective. Ms.Noble then stated she looked at the PIN numbers and acreage and found a slight difference in the numbers. They are going to eliminate 10.5 acres and will reconfigure about 9.5 acres on the city side. Mr. Gravel said he would look at the numbers and would later verify them. He said they were losing portions of 13 and 9 and are adding portions of 18, 19 and 22. Ms. Noble said they need verification from the IEPA of the 2010 exemption from local citing process as long as all set backs are met and raw materials are in rows (as proposed). Mr. Gravel said he would include a copy of the regulations from the IEPA in the application. Ms. Noble asked if the property originally had to go through local citing and Mr. Gravel said no. He said he thought that was part of the benefit of composting. Ms.Noble pointed out the IEPA still required set-backs and Mr. Gravel confirmed and will prove it on the plan. Ms. Noble confirmed he currently has a lease with Mill Roy Farms and a pending lease with Bristol Ventures. She also noted it is overlapping with Westbury Village. She asked about the county's hosting fee at $.60 - $.70/ton for landscape waste. Mr. Gravel stated the ratio should be worked out between the city and county. 11.10 He also said that, from their research, it does not appear that many other compost facilities do, in fact, have a tipping fee. Mr. Olson asked him if they got the survey and statistics from the other ones as far as what they do and their total dollar amount. No answer given. Ms.Noble asked what Mr. Gravel could tell them about meeting the city's decibel levels at property lines (<60). He said since it was considered a `moving operation,' the levels vary. He offered to check the levels of the loaders. Mr. Olson asked about the size of the trucks, were they full semi loaders/dump trucks? Mr. Gravel said they had three levels of sizes they use: packer(dump) truck, contractor and transfer. Ms.Noble said they found out there were previous violations so a F.O.I.A. was filed with IEPA and found out the violations were for the previous property 15.15 owner(Scotts) in 1999. There was follow-up in 2001 and since then, Green Organics has been in compliance. Ms. Noble recommended: they continue to review reports and forward results to the county; a plat of survey, with parcel numbers, on file that shows locations of operations and processes; and up-to-date copies of state permit updated related documentation from IEPA. Operational personnel must be on-site at all times and the city requires a contact person available 24 hours a day as part of their conditions. They are in BKFD's area, and since they require a key in a lock box, Ms. Noble wants the city's Building Department to have a key to the lock box. She also wants Green Organics to authorize: her and Pete Ratos to be out on the property during regular business hours if there's ever a need for testing or an inspection; as well as copies of water and sewer sample reports (taken by independent labs) as required by the IEPA. Ms. Noble said she knows the county is proposing to have a sunset clause in their special use, and they are approving a 10-year term. She was looking at their lease on the city-side, and it states a 5-year term with a renewable 5-year term. At this point, city staff is comfortable with allowing a total 10-year. Ms. Noble is going to recommend a 5-year with a review. She knows there's a clause in the county contract that states anytime residential comes into play, their uses would cease and they have that understanding with the landowner. She would like to see that memorialized in the city agreement. If there is a turnover, there would be a simple review by the Plan Commission again to just renew their Special Use with the same conditions. Mr. Gravel would prefer to keep it the same as the county,but he understands the city's position by trying to tie it to the actual lease (land use)portion. He said it should work for the 10 years, or until the property is sold(or something to that effect). Ms. Noble did the Comprehensive Review and right now they are requesting a re-zoning to A-1. She doesn't know if that's the right route to take now. They are thinking R-2 with Special Use because they already have the ability in the current Annexation Agreement to allow them to have those uses. What they're going to do is look for an amendment to the Westbury Agreement to define that they can now shift the use onto parcels that were not used previously—instead of re-zoning. The 2008 Comprehensive Plan update designates the subject property as "Suburban Neighborhood,"which is intended to be a residential area primarily comprised if single-family detached residences. They are not currently in conflict. Ms. Noble said she gave them a copy of the history of the Westbury Village Annexation Agreement. She said the city does have a lien on some of the property in Westbury for$500,000,but it does not affect their parcel. Mr. Gravel had a question for Ms. Noble on the Landscape Plan. He felt it was "a little much"to request they have a landscape plan because the facility is temporary. They will be providing a berm, and they would like to request that the landscaping, other than ground cover, not be required. Ms. Noble asked Mr. Gravel to provide her with a section of the berm so she could see how high it would block off visually. It was suggested that maybe since Green Organics is not landscaping they might want to make a token donation toward trees to replace the diseased Emerald Ash Borer trees that were removed throughout the city. Julie Morrison, from EEI, only wanted to point out the storm water report and the cross-section for the detention basin and wanted to know if Mr. Gravel would be looking for any variances or is it something they can revise to fit. He asked if it referred to the size of the pond and she said it was the slopes. He said they can certainly adjust to 4:1, 3:1 slopes, and look at 5:1, although that might be a little tricky. They will definitely look at it. A 2:1 can be held in place and easily be maintained. She also brought up Com Ed and it is always an issue when there is a detention basin and the water discharges to property you don't own. Mr. Gravel is going to look at options to see what can be done to not make the point of discharge a concern—maybe a level spreader to avoid erosion. He also wanted to bring up a good deal of that water is going to get re-used in processing on site. Mr. Sanderson confirmed with Ms. Noble that Zoning information should be on the site plan and the plat, showing all PIN numbers. Ms.Noble will be sending an amended schedule of meetings. The petitioner is seeking Special Use approval of a Planned Unit Development (PUD) with an underlining zoning of R-2 One-Family Residence District for the approximately 7.9-acre parcel to construct a 47-lot active adult residential community. Based upon my review of the application documents and Preliminary Plat, I have compiled the following comments: General Comments: • The property is currently zoned R-1 One-Family Residence District within the City of Yorkville. • The parcel currently has a single family residence and various detached accessory structures. • Existing Land uses and zoning within the general area of the Subject Properties are as follows: Existing Zoning Existing Comments Land Use North R-2 One-Family Residential District Residential Single Family Residences. The proposed total coverage for the overall development, inclusive of buildings, is 22.5% of gross area. However, the individual lots are proposed to have a maximum coverage of 65%. The proposed maximum impervious surface coverage will be 39.1% of the gross area. • The request for a Floor Area Ratio (FAR) maximum of 70% is not relevant, as the R-2 District does not have a FAR regulation and the proposed development will have ranch style home construction. Therefore, the lot coverage and FAR would essentially be the same. The developer shall verify which coverage is requested, 65% or 70%. • The maximum Building Height requirement for the R-2 One-Family Residence District is thirty feet (30') and not more than 2.5 stories, whichever is less. Although the developer is not seeking to vary from this bulk regulation, maximum proposed building height shall be provided. Site Plan Comments: • Current zoning designation, R-1 One-Family Residence District is not indicated on the Preliminary Plat exhibit. • Number of bedrooms per dwelling unit shall be provided for the purpose of calculating proposed land cash dedication for parks and schools. • The proposed stormwater management basin will require the establishment of a dormant Special Service Assessment (SSA). • Alexandra Lane is identified to be dedicated to the City. The proposed right-of-way width is 60 feet which is the typical width for a private roadway, as public roadways are 66 feet. Should the City approve a 60 foot right-of-way, staff may recommend Alexandra Lane be classified as a private road unless restricted street parking is provided. • It is noted that the proposed sidewalks along the development are 4' in width, with the exception of sidewalk along Freemont Street. • All driveways facing Bristol Street and Freemont Street should line up with the existing driveways as much as possible. 1 Proposed minimum lot area is 5,000 sq.ft.Proposed maximum lot area is 6,333 sq.ft.Proposed average lot area is 5,230 sq.ft. Appearance Code Comments: • Per Section 8-15-5C of the Appearance Code, no single-family detached residential units shall be similar in appearance unless two (2) or more buildings of dissimilar design separate the buildings. The petitioner has only submitted two (2) proposed black and white elevations. Additional elevations shall be provided. All elevations submitted shall be in color with front, rear and side views, and identify materials for all elements of the building. • Masonry products shall be incorporated on the front fagade of at least seventy five percent (75%) of the total buildings and shall incorporate a minimum of fifty percent (50%)premium siding material on the front fagade. Comprehensive Plan Comments: • The City's Comprehensive Plan Update 2008 had designated this parcel as "Traditional Neighborhood" which is intended primarily for single-family detached residences," preserving the existing unique residential neighborhoods in the developed core of the City." Future development will likely be in form of redevelopment of existing sites. While there is no gross density specified in the Comprehensive Plan for the Traditional Neighborhood designation, it is noted that residential densities will vary and should remain consistent with the surrounding developments. Sign Code Comments: • The Landscape Plan indicates an easement for an 8'xl5' sign to be located between Lot 20 and Lot 21, perpendicular to Jackson Street. Sign plan details will need to be provided prior to approval of the Special Use should variances or exceptions from the Sign Code be required. • Signage landscaping, if proposed, shall be provided on the separate sign plan. Planned Unit Development (PUD) Agreement Comments: • The request for Special Use authorization of a Planned Unit Development (PUD) will have stipulated conditions. The format of such conditions will detail the requests and variations from the underlining R-2 Zoning requirements. Therefore, the City Attorney will draft the ordinance with conditions as requested in the provided Planned Unit Development Agreement dated March 3, 2014. • All references to the R-2 District shall reflect "One-Family Residence District" rather than "General Residence District". • Copies of any proposed covenants, conditions and restrictions and/or homeowner's association bylaws shall be provided to the City. • Land cash request is for $30,000/acre valuation. The current Yorkville Land Cash Valuation per Acre of Improved Land is $101,000/acre. The developer shall provide verification of such a reduction by means of a recent land appraisal or comparable land sales in the area. • Written verification of the Yorkville Community School District waiver of School Transition Fee shall be provided prior to the approval of the Special Use Permit for Planned Unit Development. • Land Cash calculations and Development Fee Sheet shall be prepared by the City of Yorkville and provided to the developer prior to City Council approval and shall be made part of the Ordinance approving Special Use authorization for Planned Unit Development. • The requested phasing of the development is permitted per Section 10-13-7-13-10, however the following shall apply: • Each stage will have a separate unit and the unit shall be described and mapped on the project. Overall design of each unit shall be shown on the plan and through supporting graphic materials. • Dates for beginning and completion of each stage. • Staff can be supportive of the developer's request for up to eight (8) years between the time of Preliminary Plat approval and Final Plat approval for the final phase of development, subject to the City having authority to withhold Final Plat approval for any proposed new phase if Public Improvement Completion (PIC) schedules are not updated for units previously approved and under construction. • Developer shall provide a model site plan indicating the location, landscaping and off- street parking area for the proposed three (3) model homes which will begin construction prior to infrastructure being completed. Landscape Ordinance Comments: • Required trees will be installed in the front or side yards, as required by Ordinance, of each lot rather than in the parkway. Since the parkway trees will be on private property, staff recommends they should be guaranteed for a minimum of two (2) years upon final occupancy permit for each lot. This may or may not be included as a punchlist item. • Additional landscaping surrounding the earthen berm may be required to buffer the view of the adjacent park to the southeast and the existing residential structure to the south. 44DEngineering Enterprises, Inc. All right-of-way (ROW) shall be 66'. The ROW on Alexandra Lane should be revised accordingly. 4. All sidewalk shall be 5' in width per the ordinance. 5. The construction entrance for the development shall be restricted to Freemont Street. All construction traffic shall be limited to Walnut and Freemont Street. No construction traffic will be allowed on Jackson or Bristol unless work is being done on these streets. A construction route plan with detailed signage should be added to the plans. 6. Parking should be limited to one side of the street on Alexandra Lane. 7. Bristol Avenue and Jackson Street were resurfaced in 2013. We recommend any work within the pavement shall require Class D patches and that the Developer be required to mill 1.5" and install 1.5" of surface adjacent to the development. 8. We recommend that as part of the improvements that the Developer be required to mill 3" and install 1.5" of binder and 1.5" of surface on Freemont Street (Elm Street to Walnut Street). 9. If the Developer intends to construct the improvements in phases, the phasing should be shown on the final engineering plans. Additionally, an anticipated phasing schedule should be provided. 10. The following items should be added to the plans: • Existing and proposed easements • Striping and signage improvements • Alexandra Lane roadway profiles with vertical curve information • Storm sewer shown in profile • Curb profiles for Bristol Ave. and Jackson St. • The City's relevant construction notes and details. This information can be obtained from the City's website. 11. The Development should be tied into the City's survey control monuments. This allows for the improvements to be added to the City's GIS system. Information regarding the control monuments can be obtained by contacting Julie Morrison at imorrison(aD-eeiweb.com. Grading Plan 12. One foot proposed contours should be provided. Upon receipt, a detailed review of the grading plan will be performed. 13. Overland flow routes should be marked accordingly. 14. The proposed grading shall be a minimum of 2% with the exception of "swale areas may be at one percent if it is over an approved, pipe underdrain." Ms. Krysti Barksdale-Noble April 4, 2014 Page 3 15. The overflow for the basin is directed to the property to the south. Information regarding the path of the overland flow from the basin should be provided. 16. Clarification as to whether the basin is a dry bottom or wet bottom basin should be provided. If a dry bottom, additional grading will be required. If a wet bottom, information regarding plantings should be included. Utility Plan 17. The existing services to the house being demolished should be shown. The services should be shown as abandoned or removed. 18. All water services shall require trench backfill to the ROW. 19. Per City water main construction notes, valve boxes in lieu of vaults shall be installed. 20. Forty-five (45) degree fittings shall be installed on the water main at Lot 14. 21. The proposed sanitary MH 5 should be tied to the existing sanitary sewer line to create a "break" manhole. The existing sanitary sewer line to the west should be abandoned and any existing services tied into the proposed sanitary sewer. 22. Due to the depth of the sanitary sewer along Jackson Street, the existing sidewalk and trees on the north side of the road should be shown. 23. All storm sewer shall be 12" or larger. All storm sewer within the ROW shall be RCP. RCP and HDPE storm sewer are allowed inside and rear yards. 24. All storm sewer shall have a minimum 3' of cover per the City's Standard Specifications for Improvements. Some of the proposed storm sewer is shallower than 3'. 25. We recommend relocating the storm sewer line from CB 6 to CB 8. CB 7 should be shifted outside the limits of the curb cut for the Lot 27 driveway and CB 8 relocated to the parkway immediately north of the sidewalk. If CB 7 is not relocated, the callout should reflect a depressed frame and grate. 26. Inlet spacing should be less than 300', including the distance traveled on Jackson Street from the high point. 27. Structures with pipes larger than 18" shall be 5 foot in diameter per the City's standard specifications. 28. There appears to be depressional storage encompassed by the 631 contour near the west edge of the detention basin and Lot 27. A portion of this possible depressional storage will be filled in and blocked by the improvements. An outlet from this possible depressional storage should be provided to the detention basin. 29. Confirmation should be provided that there is adequate wall space (12" min) between pipe openings in structures 6 and 14 with a 4 foot diameter structure. Add note to plans that "All storm sewer conduits 12" diameter and larger shall be internally televised in color just prior to City acceptance, and shall be free of defects, sags, dirt, and debris". 31. The following storm sewer slopes should be revised based on the proposed inverts: • Storm 26 to 1 should be 0.70% • Storm 1 to 2 should be 0.70% • Storm 5 to 6 should be 0.59% • Storm 7 to 8 should be 1.33% • Storm 25 to 10 should be 0.60% • Storm 13 to 14 should be 0.59% • Storm 16 to 15 should be 0.62% • Storm 18 to 19 should be 0.71% • Storm 19 to 20 should be 0.81% • Storm 20 to 21 should be 0.79% • Storm 23 to 24 should be 0.36% • Storm 24 to E7 should be 0.34% Dimension Plan 32. The Light Pole Foundation detail should be removed. The City does not install these types of lights. 33. Dimensions appear to be missing from Lot 15, 26, 27, and 32 through 46. Water Main Plan and Profile 34. All storm and sanitary sewers, including sanitary services, shown above the water main shall be water main quality pipe. The callouts on the Utility Plan should be revised accordingly. 35. There are several instances where the water main is shown with less than 1.5' of vertical separation below the sanitary sewer service lines. This is not allowed. 36. There are several instances where the water main is shown with less than 1.5' of vertical separation above sanitary sewer services. The services shall be constructed with water main quality pipe. 37. The water main from station 7+40 to 11+00 should be redesigned to remove as many fittings as possible and the water main should be raised to a maximum depth of 8' to the bottom of pipe for maintenance purposes. 38. No water taps shall be shown within 2' of a joint or bend fitting. 39. There are 2 water services shown for lot 38. The water service for lot 26 appears to be excluded. 40. The street lights at lots 16, 31 and 37 should be removed. Street lights should be located at the southwest corner of lot 15 and southeast corner of lot 26. Ms. Krysti Barksdale-Noble April 4, 2014 Page 5 General Notes and Details 41. The formula in note 5.6 of the YBSD notes needs to be corrected. 42. The City's relevant construction notes and details should be used. The information can be obtained from the City's website. 43. The reference to CA-6 for the "granular cradle" on the storm sewer trench details should be removed. 44. The following details should be provided: • Class D patch • Restrictor structure • ADA sidewalk ramp 45. The pavement section shall be 1.5" of surface, 2.5" of binder and 10" of CA-6 base per City Ordinance. 46. A typical section for the driveway pavement should be provided. Landscape Plan 47. The proposed trees to be planted in the front yards of the lots should be shown. This will allow the review of the following items: • One tree per interior lot. Two trees per corner lots (one per side). • No trees shall be planted closer than 30' of the ROW intersection. • No tree shall be planted within 20' of light poles, street signs and hydrants. Utilities should be shown on the landscape plan 48. The total development area exceeds 5 acres; therefore, a tree preservation and removal plan per the Section H of the City's Landscape Ordinance will be required. The plans should include calculations showing that the number of replacement trees meets or exceeds the quantity based on tree removal. 49. The landscape plan should meet the requirements of outlined in section 8-12-13 of the Landscape Ordinance. Upon receipt, the plans will be forwarded to Planning Resources, Inc. for review and comment. Stormwater Management Report 50. Storm sewer design calculations should be provided. 51. The report should reflect the corrected pipe slopes. 52. The required detention shown on the plans does not match the required detention listed in the report. 53. Confirmation should be provided that the existing storm sewer downstream of the proposed basin has enough capacity to convey the stormwater. Ms. Krysti Barksdale-Noble April 4, 2014 Page 6 54. The overflow weir length calculations in the stormwater report show a required length of 19 feet. The proposed over flow weir and the detail only show an exposed length of 8 feet. 55. According to note 7 in the storm sewer section of the City's Standard Specifications for Improvements: "The storm water storage areas must have containment for twelve inches of additional storm water storage, which an approved calculated overflow area at six inches above calculated 100- year elevation." The detention basin restrictor should be sized to also provide the appropriate detention volume with a maximum 0.04 cfs/acre release rate during the 2-year 24-hour storm event. 57. An overland flood route analysis should be completed for the development. A minimum 1' freeboard should be provided from the high water level of the overland flow to the top of foundation elevations. 58. The stormwater management calculations show that a discharge rate of 1.19 cubic feet per second (cfs) is required to meet the prescribed discharge rate of 0.15 cfs/acre disturbed. The on-site Hydraflow model without exfiltration shows that the peak discharge rate would be marginally higher if the high water elevation is reached.
