AN ORDINANCE OF THE UNITED CITY OF YORKVILLE,
KENDALL COUNTY, ILLINOIS, DESIGNATING THE FOX
INDUSTRIAL PARK AREA A TAX INCREMENT REDEVELOPMENT
PROJECT AREA PURSUANT TO THE Tax Increment Allocation Redevelopment Act
WHEREAS. it is desirable and in the best interests of the citizens of the United City of
Yorkville, Kendall County, Illinois (the "Municipality"), for the Municipality to implement tax
increment allocation financing pursuant to the Tax Increment Allocation Redevelopment Act (the
"Act"), as amended 65 ILCS 5/11-74.4-1 et seq. for a redevelopment project and plan (the
"Project and Plan") Mthin the municipal boundaries of the Municipality and within a proposed
redevelopment project area (the "Area") described in Section 1 of this Ordinance; and,
WHEREAS,the Mayor and City Council of the Municipality(the "Corporate Authorities
")
have heretofore by ordinance adopted and approved the Project and Plan, which Project and Plan
were identified in such ordinance and were the subject, along with the Area designation hereinafter
made, of a public hearing held on the 19`' day of April, 2001, at the Yorkville City Hall, and it
is now necessary and desirable to designate the Area as a "redevelopment project area" pursuant
to the Act.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United
City of Yorkville, Kendall County, Illinois, as follows:
Section 1. Area Designated. The Area, as legally described in Exhibit A-1 attached
hereto and incorporated herein as if set out in full by this reference, is hereby designated as a
redevelopment project area pursuant to Section 11-74.4-4 of the Act. The map of the Area is
depicted on Exhibit A-2 attached hereto and incorporated herein as if set out in full by this
reference.
Section 2. Invalidity of Any Section. If any section, paragraph or provision of this
Ordinance shall be held to be invalid or unenforceable for any reason, the invalidity or
unenforceability of such section, paragraph or provision shall not affect any of the remaining
provisions of this Ordinance.
Section 3. Superseder and Effective Date. All ordinances, resolutions, motions or
orders in conflict hereczith the same hereby are, repealed to the extent of such conflict, and this
Ordinance shall be in full force and effect immediately upon its passage by the Corporate
Authorities and approval as provided by law.

Legal Description
The oundaries of the Project Area have been carefully drawn to include only those contiguous
parcels of real propem- a:d improvements substantially benefited by the proposed Redevelopment
Projec:to be undertaken ._s part of this Redevelopment Plan. The boundaries are shown in Figure 1,
Pro;_::r Area Boundary, a-_d are generally described below:
The Project Area is generally bounded by the north property line of parcels fronting Beaver Street
and a oortion of Route 1-6 on the north, Deer Street on the east, the south property line of parcels
fronn-g Wolf Street and a portion extended to Illinois Route 47 on the south, and Illinois Route 47
on the west.
The boundaries for the P-eject Area are legally described as follows:
That oart of the NW quai_er of Section 4, Township 36 North, Range 7 East of the Third Principal
Meridian, and that part of he NE quarter of Section 5, township and range aforesaid, commencing
at the northeast corner of said Section 5, thence South 89°40'05" West along the north line of the
northeast quarter of Secton 5, 655.52' to the centerline tangent of Illinois Route No. 47 extended
from the south, thence South 1°44'07"East along said centerline tangent and along the centerline of
said Illinois Route No. ';`, 475.21', thence South 89°58'06" East, 470.23 to the Point of the
Beg�nning, also being the Northwest Corner of Lot 4, Block 1 of Fox Industrial Park Unit 1, thence
South 89°58'06" East, 10256.06', thence North 0025'09" East, 191.58' to the southwesterly right-of-
