CORRECTING SCRIVENER'S ERROR IN ORDINANCES PERTAINING
TO THE ADOPTION OF TAX INCREMENT FINANCING FOR THE
UNITED CITY OF YORKVILLE INDUSTRIAL PARK AREA
WHEREAS, the City Council of the United City of Yorkville(the "City")determined that
it was in the best interest of its residents to take action to eradicate certain blighting conditions
within the Fox Industrial Park (the "Redevelopment Project Area") and induce redevelopment
through the adoption of the Tax Increment Allocation Redevelopment Act (the "TIF Act"); and,
WHEREAS, the City Council then directed that all requirements of the TIF Act be met,
including, but not limited to, determination of the eligibility of the Fox Industrial Area as a
Redevelopment Project Area,preparation of a project and plan, meetings of the joint review board
as established by the TIF Act, notices by certified mail to certain property owners, publication of
notices of a public hearing and conducting a public hearing on the proposed plan for the
Redevelopment Project Area; and,
WHEREAS, having completed the prescribed requirements of the TIF Act, the City
Council passed the following ordinances on May 10, 2001:
(a) Ordinance No. 2001-25 Approving a Tax Increment Financing Redevelopment
Project and Plan for the Proposed Tax Increment Redevelopment Area;
(b) Ordinance No. 2001-26 Designating the Fox Industrial Park Area a Tax Increment
Redevelopment Project Area Pursuant to the Tax Increment Allocation
Redevelopment Act; and,
(c) Ordinance No. 2001-27 Adopting Tax Increment Allocation Financing for the Fox
Industrial Park Area Tax Increment Redevelopment Project Area(collectively "the
Ordinances").
WHEREAS, in each of the Ordinances, the Fox Industrial Park Redevelopment Project
Area is described by a map of the area and the legal description therefore and attached to each of
the Ordinances as Exhibit A-1 and Exhibit A-2; and,
WHEREAS, it has come to the attention of the City Council that while the map depicting
the Fox Industrial Area Redevelopment Project Area is a correct depiction of its location,the legal
description referred to as the "westerly" line of Deer Street and the "Southwest" corner of Fox
Industrial Park Unit 4 instead of correctly stating the "easterly" and "Southeast" corner of Fox
Industrial Park Unit 4, in order to mirror the map and graphics of the Fox Industrial Park Area.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the United City of
Yorkville that the reference to "westerly line" of Deer Street and the "Southwest" corner of Fox
Industrial Park Unit 4 in the legal description of the Fox Industrial Park TIF District appended to
each of the Ordinances as Exhibit A-1 is hereby corrected to the "easterly line" of Deer Street on
the "Southeast" corner of Fox Industrial Park Unit 4 in order to accurately describe the area
depicted on the map attached to each of the Ordinances as Exhibit A-2 thereby removing an
obvious scrivener's error.
This Ordinance shall be in full force and effect from its passage, approval and publication
as provided by law and a copy shall be filed with the County Clerk and published in the Kendall
County Record, a newspaper of general circulation, being circulated in the City.
