Ordinance 2001-43 r July 26, 2001 STATE OF ILLINOIS ) )ss COUNTY KENDALL ) ORDINANCE NO. 2001- 'l3 AN ORDINANCE RESTRICTING TRUCK AND COMMERCIAL VEHICLE WHEEL AND AXLE LOADS AND GROSS WEIGHTS ON CERTAIN HIGHWAYS IN THE UNITED CITY OF YORKVILLE WHEREAS, the Mayor and City Council of the UNITED CITY OF YORKVILLE, upon recommendation and request of the City Police Department and various members of the community, deem it to be in the best interest of the City to pass an ordinance to enforce State of Illinois truck and commercial vehicle wheel and axle loads and gross weights restrictions on local roadways in the United City of Yorkville; and WHEREAS, 625 ILCS 5/15-316(c) of the Illinois Vehicle Code permits local municipal authorities, with respect to highways under the jurisdiction of the United City of Yorkville, to impose wheel and axle loads and gross weight limitations on trucks or other commercial vehicles on designated highways; and WHEREAS, said weight prohibitions are being enacted to help protect and maintain City roadways, to ensure traffic safety and to protect persons and property from the dangers of overweight vehicles; and Page 1 of 4 WHEREAS, the City Council has fully considered the best interest of the citizens and the City in considering this Ordinance: NOW THEREFORE, the Mayor and City Council of the UNITED CITY OF YORKVILLE, upon motion duly made, seconded, and approved by a majority of those voting, hereby ORDAINS as follows: 1. That the wheel and axle load and gross weight restrictions contained in Chapter 625, Act 5, Chapter 15, Section 111 of the Illinois Compiled Statues (625 ILCS 5/15-111), as they are amended from time to time, are hereby adopted by the United City of Yorkville as if set forth verbatim herein. 2. The police officers of the Yorkville City Police Department shall weigh and measure vehicles that may be in violation of this Ordinance in the manner set forth in Chapter 625, Act 5, Chapter 15 of the Illinois Compiled Statutes, as amended from time to time. 3. That the penalties for violations related to 625 ILCS 5/15-111, as adopted by the United City of Yorkville, are set out in Chapter 625, Act 5, Chapter 15, Section 113 of the Illinois Compiled Statues (625 ILCS 5/15-113). Said 625 ILCS 5/15- 113, as amended from time to time, is adopted by the United City of Yorkville as penalties for violation of this Ordinance as if set forth verbatim herein. 4. Appropriate signs shall be placed on all highways within the United City of Yorkville which shall be subject to wheel and axle load and gross weight restrictions pursuant to this Ordinance. All special permits and exemptions from the wheel and axle load and gross weight restrictions as set forth in Chapter 625, Act 5, Chapter 15 of the Illinois Compiled Statutes, are hereby adopted as special permits and exemptions from this Ordinance. 6. All ordinances or parts of ordinances conflicting with any of the provisions of this ordinance shall be and the same are hereby repealed. 7. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct, and independent provision, and such holding shall not affect the validity of the remaining portions hereof. 8. This ordinance shall be in effect from and after its passage, approval and publication in pamphlet form as provided by law.
