AN ORDINANCE AMENDING THE CITY CODE OF THE UNITED CITY OF
YORKVILLE AS IT PERTAINS TO ZONING ORDINANCES

WHEREAS Sterling Codifiers, Inc., is the codifier for the UNITED CITY OF

YORKVILLE and has requested an Ordinance clarifying several matters in Title 10, Chapter 6 of
the City Code of the UNITED CITY OF YORKVILLE; and
WHEREAS, THE UNITED CITY OF YORKVILLE by and through its Mayor and City
Council consider it to be in the best interest of the UNITED CITY OF YORKVILLE to amend
certain provisions of Title 10, Chapter 6 of the City Code;
NOW THEREFORE, be it resolved by the CITY COUNCIL AND THE MAYOR OF
THE UNITED CITY OF YORKVILLE, upon motion duly made, seconded and approved, that
the following amendments shall be made to the Title 10, Chapter 6 of the City Code of the
UNITED CITY OF YORKVILLE :
1. That the Zoning Classification entitled"Estate Zoning Class" shall hereinafter be
referred to and titled as "Estate District" and shall be identified as Title 10 Chapter
6 Article A of the City Code.
2. That by this Ordinance, Title 10, Chapter 6, Article A(Estate District), Section 1
be entitled "Uses Permitted" and Section 2 be entitled"Special Uses". That the
uses permitted under Sections I & 2 be the same as those enumerated in the

current version of Title 10, Chapter 6, Article A, Sections 1 & 2 of the Code
(Current R-1 One-Family Residence District).
3. That Title 10 Chapter 6 Article A(Estate District) Section 3 entitled"Lot Area"
be amended to read as follows:
A. Every one-family detached dwelling hereinafter erected shall be located on
a tract of land having an area of not less than 1 acre and with a width at the
established building line not less than two hundred (200) feet.
B. All nonresidential principal use buildings, as permitted in this article, shall
be located on a tract of land having an area of not less than one acre and
with a width at the established building line of not less than two hundred
(200) feet.
C. Lot sizes for special uses shall be specified in the special use permit but
shall not be less than five(5) acres.
4. That Title 10 Chapter 6 Article A(Estate District) Section 4 is hereby amended to
read as follows:
10-6A-4 A. Front Yard: A front yard of not less than Fifty(50) feet.
B. Side Yards: A side yard on each side of the zoning lot of
not less than Fifty (50) feet.
C. Rear Yard: A rear yard of not less than Fifty(50) feet.
5. That the existing Zoning Classification entitled"R-1 One-Family Residence
District" be identified as Title 10, Chapter 6, Article B.

6. That the existing Zoning Classification entitled"R-2 e-Family Residence
District" be identified as Title 10, Chapter 6, Article C.
7. That Title 10, Chapter 6, Article C, Section 1 read as follows: "Uses Permitted:
Any permitted use allowed in Estate District or the R-1 One Family Residence
District."
8. That Title 10, Chapter 6, Article C, Section 2 read as follows: "Special Uses: The
following uses may be allowed by special use permit in accordance with the
provisions of Section 10-14-6 of this title: Any use permitted as a special use in
the Estate District or R-I One-Family Residence District, except that planned
developments may be considered where the zoning lot proposed for development
has a gross area of not less than ten(10) acres.
9. That the existing Zoning Classification entitled"R-2 Duplex, Two-Family
Residence District" be identified as Title 10, Chapter 6, Article D.
10. That Title 10, Chapter 6, Article D, Section 1 read as follows: "Uses Permitted:
Any permitted use allowed in R-2 One Family Residence District. Two Family
semi-detached dwellings (Duplexes)."
11. That Title 10, Chapter 6, Article D, Section 2 read as follows: "Special Uses: The
following uses may be allowed by special use permit in accordance with the
provisions of Section 10-14-6 of this title: Any use permitted as a special use in
Estate District or R-1 One-Family Residence District, except that planned
developments may be considered where the zoning lot proposed for development
has a gross area of not less than ten (10) acres.

12. That the existing Zoning Classification entitled"R-3 General Residence District"
be identified as Title 10, Chapter 6, Article E.
13. That the existing Zoning Classification entitled"R-4 General Residence District"
be identified as Title 10, Chapter 6, Article F.
14. That for all zoning classifications in Title 10, Chapter 6, Articles A, B, C, D, E, F,
Section 5 shall read: "Not more than thirty percent (30%) of the area of the zoning
lot may be occupied by buildings and structures including accessory buildings.
SEVERABILITY: The various parts, sections, and clauses of this Ordinance are
hereby declared to be severable. If any part, sentence, paragraph,
section, or clause is adjudged unconstitutional or invalid by a Court
of competent jurisdiction, the remainder of the Ordinance shall not
be affected thereby.
REPEALER: Any Ordinances or parts thereof in conflict with the provisions of
this Ordinance are hereby repealed to the extent of such conflict.
EFFECTIVE DATE: This Ordinance shall be in full force and effect 15 days from and
after its passage and approval by the Mayor and City Council.
