ORDINANCE APPROVING VARIANCE REQUEST OF
WHITE OAKS ESTATES
HOMEOWNERS ASSOCIATION
WHEREAS,the Mayor and City Council of the UNITED CIT Y OF YORKVILLE have held
a Public Hearing, at which time Public imput was taken as to a Written Variance Request by the
White Oaks Estates Homeowners Association with respect to variances from the Preliminarily
Engineering Plan in regard to location of an East side Nature Trail and West side Nature Trail, and
a further request from homeowners on River Birch Drive to vary the City of Yorkville Subdivision
Control Ordinance for the elimination of a sidewalk along River Birch Drive; and
WHEREAS,the matter has been considered by the City Council of the UNITED CITY OF
YORKVILLE sitting as a Committee of the Whole,and by its Economic Development Commission
and recommended for approval:
NOW THEREFORE,upon Motion duly made,seconded and approved by a majority of those
so voting,the following Variances are hereby granted from the United City of Yorkville Subdivision
Control Ordinance:
1. East side Nature Trail:
The East side nature trail will consist of a walking path meandering north-south
along Out lot B. Access to this trail will be via the southern 10 feet of the emergency
vehicle easement between Unit 1 Lot 3 and Unit 1 Clubhouse Lot.
2. West side Nature Trail:
The West side nature trail will begin at the southern most edge of Unit 3,Lot 47 and
follow along the existing 30 feet wide easement plotted in the final plat of Unit 3.
This nature trail will conform to the general specifications outlined in the October 14,
1997 letter from Crestview Builders to the White Oak Estates Homeowners
Association signed by Mr. Mike Steck. A copy of this letter is attached hereto.
3. No sidewalk shall be required to be installed on River Birch Drive in front of the
residences located thereon due to the large lot size, the wooded nature of the
property, and to the terrain on said street.

We, the undersigned, being owners of real property located in White Oak Estates, Units
1-and 2 and 3j which is located-within-the citylimits of The-United City of the Village of
Yorkville, Illinois; due hereby petition the village officials of the United City of Yorkville
to grant.-the following variance with-regard to.the placement-of nature trails and.sidewalks
within the White Oak Estates subdivision.

Actual variance requested:
In.a.September 14;- 1.997 letters-from-Mayor Bob Johnson to Mr. Rob Stnieter and
Mr. Anthony Robinson,Mayor Johnson advised the City of Yorkville had
determined-the preliminary-Plan for White Oak Estates Subdivision would be the
document utilized to determine the placement of sidewalks and nature trails around
the subdivision. In that.letter Mayor Johnson advised that any desired difference
to this determination must be submitted within 60 days.
After much.discussion.with and-between the developer, White Oak.Estates
Homeowners Association directors and numerous home owners within the
subdivision-this petition-was-circulated-among-all.home owners within the
subdivision for their consideration and approval. The following narrative
represents-what the petitioners agree is the desired.solution with-regard-to the
location of nature trails.
East side Nature Trail:
