Ordinance 1998-19 STATE OF ILLINOIS ) 5/12/98 )ss COUNTY OF KENDALL ) ORDINANCE NO.q$-I G AN ORDINANCE AMENDING ORDINANCE NO. 81-5 AMENDING TITLE 3, CHAPTER 5A., SECTIONS 2(B)(3), 3(A)(B)(C), 4(B)(C), 5 OF THE YORKVILLE MUNICIPAL CODE WHEREAS, after careful consideration, the Mayor and City Council have determined it to be in the best interests of the community and its economy to amend the current provisions of the Yorkville Municipal Code as it relates to the operations and management of the Yorkville Farmers' Market. WHEREAS, the Mayor and City Council have determined that the City Recreation Director is in a better position to manage and operate the Yorkville Farmers' Market. WHEREAS, the City Council has considered this amendment to address important public concerns and to provide for the optimal management and operations of the Yorkville Farmers' Market. NOW THEREFORE, be it ordained by THE UNITED CITY OF YORKVILLE; -1- 1. Title 3, Chapter 5A, Section 2(B)(3) of the Ordinance of the Yorkville Municipal Code is amended to read as follows: The City Recreation Director shall have the power to annually set reasonable fees for the Farmers' Market permit as confirmed by Recreation Board. 2. Title 3, Chapter 5A, Section 3(A) of the Ordinance of the Yorkville Municipal Code is amended to read as follows: Supervision and Control: The City Recreation Director shall have control of the activities of the Yorkville Farmers' Market and powers to regulate, set rules for the conduct of the Farmers' Market and allocate positions of all vehicles and sellers' booths desiring to be located in such market, and the City Recreation Director is hereby vested with authority to maintain order for the convenience and maintenance of said market. 3. Title 3, Chapter 5A, Section 3(B) of the Ordinance of the Yorkville Municipal Code is amended to read as follows: Hours of Operation; Location of -2- Market: The City Recreation Director shall, from time to time prescribe the days and times of said market shall be open to the public as well as the location of said market. 4. Title 3, Chapter 5A, Section 3(C) of the Ordinance of the Yorkville Municipal Code is amended to read as follows: Space Assignment: The City Recreation Director shall assign spaces for the sale of market products. Spaces shall be assigned in accordance with the order in which applications are filed with the City Clerk. 5. Title 3, Chapter 5A, Section 4(B) of the Ordinance of the Yorkville Municipal Code is amended to read as follows: Sanitary Premises: Every seller in the market shall be required to keep space occupied by him in a clean and wholesome condition, subject to the approval of the City Recreation Director. 6. Title 3, Chapter 5A, Section 4(C) of the Ordinance of the Yorkville Municipal Code is amended to read as follows: Use of Scales: Every seller shall be required to keep a true set of scales for -3- the proper weighing of all commodities if sold by weight. Any scales found to be faulty by the City Recreation Director, may forfeit the right of said vendor to participate in the Yorkville Farmers' Market Permanently. 7. Title 3, Chapter 5A, Section 5 of the Ordinance of the Yorkville Municipal Code is amended to read as follows: VIOLATIONS AND PENALTIES: Any person who violates any provisions of this Article shall be guilty of a Class C misdemeanor and, furthermore, any violation of any section of this Article, or any fraud or deceptive practice shall be deemed grounds for the immediate dismissal of any seller, person, firm, or corporation from the marketplace by order of the City Recreation Director and any violation of said rules and regulations is subject to a fine not in excess of Five Hundred Dollars ($500.00) pursuant to Section 1-4-1 of this Code.
