COUNTY OF KENDALL ) ORDINANCE NO. $ 3 AN ORDINANCE AMENDING TITLE 10, CHAPTER 7,ARTICLE D, SECTION 4 OF THE YORKVILLE CITY CODE (B-3 Parking Setback) WHEREAS, THE UNITED CITY OF YORKVILLE, after careful consideration by the Mayor and City Council,has determined it necessary to the health and safety of the residents of the United City of Yorkville to provide an ordinance controlling the location of parking lots within B-3 Zoning Districts; WHEREAS, THE UNITED CITY YORKVILLE, after careful consideration by the Mayor and City Council, has determined that it is in the best interests of the community to amend the Title 10, Chapter 7,Article D, Section 4 of the Yorkville City Code to control the set back requirements of the location of parking lots in relation to two different types of roadways, Arterial and Non- Arterial, as defined by the City's Comprehensive Plan; NOW THEREFORE BE IT ORDAINED BY THE UNITED CITY OF YORKVILLE; 1. That Title 10 , Chapter 7 , Article D , Section 4 of the Yorkville City Code is hereby amended to allow the following: E. Parking Lot Setback Requirements 1. ARTERIAL ROADWAYS: When a parking lot located in the B-3 Zoning District is located next to an Arterial Roadway, as defined in the City's Comprehensive Plan, a 20 foot setback from property line is required. 2. NON-ARTERIAL ROADWAYS: When a parking lot located in the B-3 Zoning District is located next to an Non-Arterial Roadway, as defined in the City's Comprehensive Plan, a 10 foot setback from property line is required. 2. In all other respects Title 10 of the Yorkville City Code shall remain in full force and effect. 3. That if a conflict shall arise with respect to the Code of this Amendment,this Amendment shall control. Passed and Approved this day of , 1998.
