Ordinance 1997-17 9706939 07/18/1997 08:51A 1 of 1 Paul Anderson, Kendall County, IL Recorder COUNTY OF KENDALL ) STATE OF ILLINOIS ) ORDINANCE NO. 1997-1_ RESOLUTION AUTHORIZING ACCEPTANCE OF TRANSFER OF REAL PROPERTY PURSUANT TO LOCAL GOVERNMENT PROPERTY TRANSFER ACT WHEREAS, the United City of Yorkville entered into an Agreement with the County of Kendall on February 21, 1995, said Agreement being in writing and being denominated as Intergovernmental Agreement; and WHEREAS, the written Agreement between the parties was entered into pursuant to the Local Government Property Transfer Act, which permits the transfer of real property between local government entities as defined within 50 ILCS 605/1 et. seq. of said act; and WHEREAS, the transfers agreed to within the Intergovernmental Agreement entered into by and between the United City of Yorkville and the County of Kendall were for public purposes for use by the City, and WHEREAS, the City Council of the United City of Yorkville unanimously approved execution of the Intergovernmental Agreement and the transfer of the Real Property and buildings located thereon as set out in the attached Intergovernmental Agreement dated February 21, 1995 which is attached here to and incorporated herein by reference; and WHEREAS, the County Board of the County of Kendall approved by more than a two thirds vote, the transfer of the real property subject to the Intergovernmental Agreement attached hereto and incorporated herein as Exhibit A pursuant to 50 ILCS 605/2 et. seq.; 0 NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE UNITED CITY OF YORKVILLE that the United City of Yorkville hereby accepts the terms of the Intergovernmental Agreement previously having been approved and voted on by the respective governing boards of the United City of Yorkville and the County of Kendall and memorializes the acceptance of the real property transferred under said Agreement with the Kendall County Recorder of Deeds. Upon any offer being made to Kendall, Kendall agrees to communicate said offer to Yorkville within 45 days and Yorkville may within 45 days of said notice, elect in writing to meet said offer and purchase the subject real estate. 5. Yorkville anticipates seeking grant funds to assist in renovating the old Courthouse cuilding. Kendall agrees to assist Yorkville in such efforts at no cost to the County. .
