AN ORDINANCE PROVIDING FOR THE
AMENDMENT OF THE ZONING ORDINANCE
IN THE UNITED CITY OF YORKVILLE

WHEREAS THE UNITED CITY YORKVILLE is in need of changes to Article D, R-3
GENERAL RESIDENTIAL DISTRICT, Section 10-6D-3 Lot Dimensions, and Section 10-6D-5B
Lot coverage, and the additions of Section 10-6D-9 Minimum Floor Area Per Dwelling Unit, and
Section 10-6D-10 Minimum Building Separation, and
WHEREAS, THE UNITED CITY OF YORKVILLE by and through its Mayor and City
Council consider it to be in the best interest of the UNITED CITY OF YORKVILLE to enact such
an Ordinance:
NOW THEREFORE, be it resolved by the CITY COUNCIL AND THE MAYOR OF THE
UNITED CITY OF YORKVILLE, upon motion duly made, seconded and approved, that the
following will be required:
10-6D-3 A.1 Allowable density based upon the gross area should not exceed five (5.0)
dwelling units per acre (gross) and shall have an area of not less than nine
thousand (9,000) square feet.
10-6D-5 B. Not more than thirty percent(30%)of the area of a zoning lot may be covered
by buildings or structures, including accessory buildings. Drives and
sidewalks on grade are not to be considered structure.
10-613-9 Minimum floor area per dwelling unit. A one story structure shall have a
minimum of 1,200 square footage, and a two story shall have a minimum of
1,400 square feet of livable space excluding the garage.
10-6D-10 Minimum Building Separations. The following shall be maintained as a
minimum (and should be exclusive of required roadway setbacks).
Side to side 20'
Side to rear 40'
Rear or rear 60'
Front to side 50'
Front to Front 50'
Rear to Front 100'
Each building should have a maximum of six (6) dwelling units.
10-613-l OA Any owner of property zoned R-3 General Residential District as of the date
of this Ordinance, existing within the boundaries of THE CITY OF
YORKVILLE, may rely and build on that property,based on the minimum lot
area standards of the previous R-3 Ordinance, for two (2) years following the
enactment of this Ordinance; except in the case of any currently zoned
property affected by this Ordinance that does not currently have UNITED
CITY OF YORKVILLE Sanitary Sewer Service available. In the event any
currently zoned real property does not have sanitary sewer service currently
available, the two (2) year period for compliance with the earlier Ordinance
shall expire two (2) years from the date of notification in writing to the
respective property owners affected without current sanitary sewer service by
the City Administrator that Sanitary Sewer Service has now become available
for any affected property. Thereafter, those properties must conform to the
new standards set forth in this Ordinance.
