Ordinance 1996-20 STATE OF ILLINOIS ) )ss. COUNTY KENDALL ) ORDINANCE NO. 199 AN ORDINANCE PROHIBITING PASSING ON THE SHOULDER OF ALL STATE ROUTES IN THE UNITED CITY OF YORKVILLE WHEREAS, the Mayor and City Council of the of THE UNITED CITY OF YORKVILLE, upon recommendation and request of the City Police Department, various members of the community, in consideration by the City Council, deem it to be in the best interest of and for the orderly flow of traffic within the City, to provide for a "No-Passing on Shoulder" Zone on all State Routes in THE UNITED CITY OF YORKVILLE; and WHEREAS, said "No Passing on Shoulder" prohibition is for the purpose of safety and protection of persons and their property during said time; and WHEREAS, the City Council has fully considered the best interest of the citizens and the City in passing said "No Passing on Shoulder" Prohibition: NOW THEREFORE, the Mayor and City Council of THE UNITED CITY OF YORKVILLE, upon motion duly made, seconded, and approved, hereby requires and enacts a "No Passing on Shoulder" zone to be established on the East and West sides all State Routes within THE UNITED CITY OF YORKVILLE. "Shoulder" is defined as that part of the roadway outside of the outer-most white stripe. Violation of this Ordinance shall result in a Twenty-Five Dollar ($25.00) fine per occurrence. This Ordinance shall become effective upon the proper signage being installed at the location of the "No Passing on Shoulder" zone.
