Ordinance 1995-06 09/08/1995 03: ` -09L1 Anderson, Kendall Coun_ , "I- (� GJ 07 9155 ORDINANCE NO. 1995 - CC' RDINANCE ANNEXING PROPERTIES TO THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS WHEREAS, INLAND LAND APPRECIATION FUND, L.P. is record owner in fee simple of a tract of land contiguous to the UNITED CITY OF THE VILLAGE OF YORKVILLE, and has heretofore submitted a Petition for Annexation of said property to the UNITED CITY OF THE VILLAGE OF YORKVILLE; and WHEREAS, the development and annexation of said land have been considered by the Plan Commission and the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE; and WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE deems it to be in the best interest of the City to annex the said real property described in said Petition for Annexation to the UNITED CITY OF THE VILLAGE OF YORKVILLE; and WHEREAS, the Petitioner is the owner of record of said property and no electors reside thereon; and WHEREAS, said Petition is under oath requesting the annexation of said property to the UNITED CITY OF THE VILLAGE OF YORKVILLE, Kendall County, Illinois and in all respects is presented in accordance with the provisions of Section 7-1-8 of the Illinois Municipal Code, being 65 ILCS 5111-15.1-1 et. seq. WHEREAS, said property is contiguous to the UNITED CITY OF THE VILLAGE OF YORKVILLE and is not within the corporate limits of any municipality; and 1 • WHEREAS, the statutes provide that upon proper affirmative vote of a two-thirds majority of the City Council, contiguous property can be annexed to the UNITED CITY OF THE VILLAGE OF YORKVILLE, Kendall County, Illinois. NOW THEREFORE BE IT ORDAINED by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE, Kendall County, Illinois: Section 1: That the property legally described as follows be and the same is hereby annexed to the UNITED CITY OF THE VILLAGE OF YORKVILLE, Kendall County, Illinois: See Attached Legal Description. Section 2: That the City Limits of the UNITED CITY OF THE VILLAGE OF YORKVILLE be, and they are hereby, extended to include the territory hereby annexed to the UNITED CITY OF THE VILLAGE OF YORKVILLE, Kendall County, Illinois, as set out in the ' attached Exhibit "A"; and the subject property is hereby zoned as set out in the attached Exhibits "B" & "C" as incorporated into this Ordinance. Section 3: That the City Clerk of the UNITED CITY OF THE VILLAGE OF YORKVILLE be, and is hereby, authorized and directed to record with the Recorder of Deeds of Kendall County, Illinois, a certified copy of this Ordinance, together with an accurate map of the territory annexed, which map shall be certified as to its correctness. Section 4: That all Ordinances or portions of Ordinances in conflict herewith be, and they are hereby repealed insofar as such conflict exists. Any other manufacturing establishment that can be operated in compliance with the performance standards of Section 10-8-1 of this Title without creating objectionable noise, odor, dust, smoke, gas, fumes or vapor; and that is a use compatible with the use and occupancy of adjoining properties. Off-street parking and loading as permitted or required in Chapter 11 of this Title. Any production, processing, cleaning, servicing, testing, repair or storage of goods, materials or products shall conform with the performance standards set forth in Section 10-8-1 of this Title. B. All business, production, servicing and processing shall take place within completely enclosed buildings unless otherwise specified. Within one hundred fifty feet (150') of a residence district, all storage shall be in completely enclosed buildings or structures, and storage located elsewhere in this District may be open to the sky but shall be enclosed by solid walls or fences (including solid doors or gates thereto) at least eight feet (8') high, but in no case lower in height than the enclosed storage and suitably landscaped. However, open off-street loading facilities and open off-street parking of motor vehicles under one and one-half (1'/j tons' capacity may be unenclosed throughout the District, except for such screening of parking and loading facilities as may be required under the provisions of Chapter 11 of this Title. C. Uses established on the effective date hereof and by its provisions are rendered nonconforming, shall be permitted to continue subject to the regulations of Chapter 10 of this Title. D. Uses established after the effective date hereof shall conform fully to the performance standards set forth in Section 10-8-1 of this Title. Front Yard: On every zoning lot, a front yard of not less than twenty five feet (25') in depth shall be provided. However, where lots within `" the same block and comprising forty percent (40%) of the frontage on the same street are already developed on the effective date hereof with front yards with an average depth of less than twenty five feet (25'), then such average depth shall be the required front yard depth for such frontage in said block.
