AN ORDINANCE AMENDING TITLE 10 OF THE YORKVILLE
CITY CODE DEFINING STADIUM ZONING AND ALLOWING
IT ONLY AS A SPECIAL USE IN B-3 BUSINESS ZONING DISTRICTS
WHEREAS, THE UNITED CITY OF THE VILLAGE OF YORKVILLE, after careful
consideration by the Mayor and City Council, has determined that the city and community to
provide for stadium zoning only in B-3 zoning districts, and only as a special use; and
WHEREAS, the City Zoning Code provides that Stadiums are a permitted use under B-3
Business Zoning; and
WHEREAS, The City Council has determined that it is in the best interests of the city that
Stadium Zoning be allowed only as a special use under B-3 zoning;
NOW THEREFORE BE IT ORDAINED BY THE UNITED CITY OF THE VILLAGE
OF YORKVILLE;
1. That all current permitted uses of stadiums under any zoning classification
where it is allowed as a permitted use, are hereby revoked;
2. That Title 10 of the Yorkville City Code is amended so that Stadium Zoning
shall be allowed as a special use under B-3 Business District, and shall not be
allowed under any other zoning districts.
3. "Stadium" shall be defined to mean, any facility, building, corral, arena, or
structure of any kind designed for use as either a sports facility (including animal
sports, i.e. rodeos, horse races etc.), entertainment facility, whether for profit or
not, where activities are to be under taken generally for the entertainment of
others. Said description includes ball fields, when any type of structure is
involved, skating rinks, race tracks, football or soccer fields, softball fields,
gymnasiums, swimming facilities, music halls, theaters, stages or any other type
of field or facility.
4. In all other respects Title 10 of the Yorkville City Code shall remain in full
force and effect.
5. That if a conflict shall arise with respect to the Code or this Amendment, this
Amendment shall control.
