Ordinance 1995-23 •v STATE OF ]ILLINOIS ) ss COUNTY OF KENDALL ) ORDINANCE NO. 1995---2-3 AN ORDINANCE ADOPTING TRAFFIC STUDY FINDINGS AND IMPLEMENTING TRAFFIC CONTROL DEVICE AND SIGNAGE CHANGES IN THE UNTIED CITY OF THE VILLAGE OF YORKVILLE WHEREAS, THE UNITED CITY OF THE VILLAGE OF YORKVILLE has commissioned a traffic study for purposes of investigating and considering compliance with fliinois Department of Transportation Signage and Traffic Control Device Compliance; and WHEREAS, a detailed Traffic Control Device and Signage Study was undertaken by Pavia-Marting, professional engineers for compliance with Illinois Department of Transportation Compliance as to traffic flow, traffic signage, and traffic device compliance with applicable statutes; and WHEREAS, said firm has in detail performed a survey with specific written findings and has submitted the same as it pertains to traffic control devices and traffic signage in the UNITED CITY OF THE VILLAGE OF YORKVILLE; and WHEREAS, said traffic study has been duly considered by the City Council at a Public Hearing, and public input has been permitted at said Public Hearing as to the adoption of changes and compliance with said traffic study: NOW THEREFORE, BE IT ORDAINED BY THE UNTIED CITY OF THE VILLAGE OF YORKVILLE upon motion duly made, seconded, and approved by a majority vote by those members if the City Council in attendance as follows: 1. That the traffic study of Pavia-Marting is hereby accepted and the findings adopted into the official records of THE UNITED CITY OF THE VILLAGE OF YORKVILLE. 2. That the UNITED CITY OF THE VILLAGE OF YORKVILLE hereby adopts and makes effective as an Ordinance of THE UNITED CITY OF THE VILLAGE OF YORKVILLE those changes in signage, traffic control devices, and installation or removal of signs controlling the same as set out in items 1 through 37 in the attached Summary of Traffic Changes, which is incorporated herein by reference and made a part of this Ordinance as though set forth in full. 3. That the effective date of the enforcement of violation of any of the traffic control devices as posted under the changes approved by this Ordinance shall be effective sixty (60) jbjxVL4JQ) days from the approval of this Ordinance by the UNITED CITY OF THE VILLAGE OF YORKVILLE. 4. That penalties for violation of any of these traffic control devices shall be as previously set out in the Illinois Motor Vehicle Code, and in the City Traffic Regulation Ordinances providing penalties for violation of the City Ordinances. 5. That to the extent any changes are made under the terns of this Ordinance in any traffic control device, this Ordinance shall take precedence over prior Ordinances of THE UNITED CITY OF THE VILLAGE OF YORKVILLE. Any existing signage, traffic control device, or Ordinance not specifically changed or amended by items 1 through 37 of the attached Summary of Traffic Changes shall remain in full force and effect and shall not be changed or modified in any way by the passage of this Ordinance. 6. In the event any change adopted by this Ordinance is ruled unconstitutional or held to be invalid by a court of competent jurisdiction, the remaining changes, modifications, or new signs required in items 1 through 37 of this Ordinance shall remain in full force and effect;Ve 4,j lq Passed by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE, Kendall County, Illinois this 2day o _. 1995.
