AN ORDINANCE GRANTING REZONING OF THE PROPERTY
LOCATED AT 3W EAST HYDRAULIC, YORKVILLE, ILLINOIS
FROM M-1 TO B-2 GENERAL BUSINESS DISTRICT ZONING WITH AN R-4 GENERAL
RESIDENTIAL SPECIAL USE
BE IT FURTHER ORDAINED BY THE CITY COUNCIL OF THE UNITED CITY OF
THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS:
WHEREAS, the Mayor and the City Council of THE UNITED CITY OF THE VILLAGE
OF YORKVILLE, upon Petition duly made and submitted, deem it to be in the best interests of
the CITY OF YORKVILLE to grant rezoning for the property located at 302 East Hydraulic,
Yorkville, Kendall County, Illinois, (more fully described in the attached Exhibit "A"), to provide
for a special use of R4 General Residential District Zoning for B-2 General Business District
Zoning subject to certain restrictions and conditions;
NOW THEREFORE, the Mayor and City Council of THE UNITED CITY OF THE
VILLAGE OF YORKVILLE, upon motion duly made, seconded and approved hereby rezone the
property located at 302 East Hydraulic, Yorkville, Illinois, from M-1 to B-2 General Business
District with an R-4 General Residential District, Special Use. Said Special Use being subject
to the following restrictions and conditions:
1. No more than four residential dwellings permitted.
2. All residential dwellings to be rental (i.e. apartments not condominiums).
3. Any changes to the original brick facades or chimney must be reviewed and
approved by Council.
4. Neither the original brick facades nor the chimney shall be painted without review

and approval by the City Council.
5. The building and site shall be maintained in reasonable, sound repair in
accordance with all pertinent Building Codes and City Ordinance (unless otherwise
amended in the initial granting of the Special Use Permit).
6. Any future building additions or changes in building appearance beyond normal
maintenance shall be reviewed and approved by Council.
7. No accessory building or structure shall be permitted without review and approval
of the City Council.
8. No fencing shall be permitted along northern (front) building facade.
9. At least two parking spaces for each dwelling shall be provided on site.
10. Access drive and on site parking area shall be paved with asphalt or concrete
within twelve (12) months of the date of issuance of the initial occupancy permit.
11. Landscaping shall proceed in accordance with the approved landscape plan.
12. Owner/Developer will cooperate with the City in determining and resolving the
railroad easement and waives any rights to the easement (if vacated) to the City.
13. Owner/Developer shall occupy the property for at least one (1) year from the date
occupancy permits are issued.

line of Van Emmon Street, 247.50 feet; thence northerly parallel with
said east line, 28.21 feet to the northerly line of a tract of land
conveyed to Robb Container Corporation by a Warranty Deed recorded _
September 8, 1972 as Document No. 724201 extended westerly; thence easterly
along said extended northerly line and said northerly line, which forms
an angle of 90029'590 with the last desribed course, measured counterclockwise
therefrom, 149.0 feet for a point of beginning; thence westerly along
the last described. course, 149.0 feet; thence northerly parallel with
said east line of Mill Street, 56.22 feet to a point which is 10.0 feet,
normally distant, southerly of side track number 2 of the Burlington
Northern Railroad; thence easterly along a line which if extended 210.89
feet would terminate at a point 30.0 feet, normally distant, southerly
of the center line of the main track of said railroad, 150.55 feet to
a line drawn northerly, parallel with said east line of Mill Street
from the point of beginning; thence southerly along said parallel line,
76.52 feet to the point of beginning, all in the United City of the
Village of Yorkville, Kendall County, Illinois as shown by the plat
hereon drawn which is a correct representation of said survey.
