Gary Neyer, Marker, Inc. The meeting was called to order by Chairman Ken Koch at 6:00pm. Citizen Comments None Previous Meeting Minutes April 1, 2014 The minutes were approved as read. New Business 1. EDC 2014-10 Building Permit Reports for March 2014 Alderman Colosimo asked if there should be concern since there were fewer permits, however, the lower numbers were weather-related. It was noted there are two builders who have contracts, but have not pulled permits yet. Mr. Ratos said he has 29 permit applications not yet on this report. He agreed weather was a factor and said one builder had to re-do cement due to cold conditions. Page 2 of 4 2. EDC 2014-11 Building Inspection Reports for March 2014 No comments, no further action. 3. EDC 2014-12 Incentives for Model/Spec Homes Chris Heinen said the EDC committee had asked staff to look at additional incentives beyond the B.U.I.L.D. Program since the success of this program boosted the building in the City. Staff looked at a spec home and model home incentives for which builders were very receptive. The spec home incentive would include a 50% cost reduction in the permit so that homes could be sold quickly. The reduction would be allowed on 10% of the lots acquired by that builder in a given subdivision. They would not be issued all at once, but once the 10% are sold, then additional permits would be allowed at the reduced rate. The model home incentive would receive a 100% permit fee reduction. Only a certain number of model homes would be allowed under their agreement and any other models beyond that number would be eligible for the 100% reduction. For example, if a developer purchased an additional 50 lots, he would receive one additional model home with reduced cost permit, 51-100 homes he would receive two reduced cost permits and 151-225 lots he would receive three permits. There is a cap and if the builder builds a model home and sells it right away, the builder would have to pay the full permit amount. Alderman Colosimo asked about the trigger mechanism as to when the builder can sell that home. It would be at the end of building and will also require language to clarify. Alderman Colosimo said that if this is approved by Council, he wants to be sure the applicants are actually developers or no incentives will be given. It was noted that the City could deny incentives to those who owe the City money. Alderman Koch also questioned if it is fair to ask residents to absorb the cost of water and sewer, etc. when developers are given these kinds of incentives. Mr. Olson said B.U.I.L.D. fees are collected and then later given to the homeowner, where the proposed incentives would be handled administratively and not collected upfront. The houses that have the proposed incentives are not eligible for B.U.I.L.D. Mr. Colosimo also suggested limiting the incentives to the first few houses constructed in order to spur development. The limits proposed were the first 30 spec homes and first 15 model homes. Guest Clayton Marker stated that a developer and builder are different. The committee discussed briefly and the City Attorneys will be asked to review. Mr. Heinen said that if a builder bought lots from a developer, a minimum of 10 lots would be required for incentive eligibility. Mr. Marker added that a percentage of lots might be better than a number, since the building projects would be smaller than those seen in the past. Another point to consider, according to Alderman Colosimo, is that by encouraging building, there is more competition for existing residents trying to sell their homes. Mr. Olson said there is a benefit to the City for the building because property taxes will be collected and City workers do not need to mow the empty lots. This will move forward to the City Council. 4. EDC 2014-13 Architectural Review Board Alderman Funkhouser asked staff to look at two architectural concerns, one in Autumn Creek that was re-platted from townhomes to single family homes. These are starter homes and have sold out. The second component of his request was to see if there is a better way to facilitate aesthetics city-wide Page 3 of 4 through establishment of an architectural review board. Ms. Barksdale-Noble gave background for this discussion and said there are two ordinances which address aesthetics: one is an Appearance Code adopted in 2005 (codified) and the other is Architectural Design Guidelines which is advisory only. These were passed after the Autumn Creek agreement was approved. Autumn Creek addressed their own aesthetic concerns in their agreement. Krysti and Pete insure that developments comply with their Annexation Agreements. The initial homes were basic units to move homes quickly. Ms. Barksdale-Noble also discussed the City's authority to impose architectural guidelines. Only one nearby community, Sugar Grove, has an architectural committee and it is advisory. They only review the guidelines for a house if they receive a request from their Council. Staff then looked farther into the suburbs for communities with committees and they only found five which were mostly located on the northshore where they look at mass developments, not individual homes. Most Yorkville subdivisions predate the Appearance Code and Guidelines. Krysti said staff realizes subjectivity could be an issue and reviews add time and expense to the permit process. It could also discourage certain projects from coming to Yorkville. A Facade Committee was in place long ago, but only met a few times for business only, not residential. Pulte Homes rep, Jason Boyer, was invited to be part of this discussion. Alderman Funkhouser said he was not singling out Pulte, but he had concern for the significant difference in architecture as a result of the re-platting. He said the city has very few controls over building and he is looking for controls and architectural standards for the future. Alderman Colosimo said he feels the standards can be controlled through the Annexation Agreements and is not in favor of a committee for this purpose. Varying elevations are also being addressed and it was suggested that when Pulte's fee lock expires next year, the City could ask for certain standards or different elevations. Mr. Funkhouser said he had received two complaints about the houses in Autumn Creek. Alderman Koch and Colosimo added they had complaints in their Ward. Ms. Teeling said she has not had complaints and added that Pulte was the only builder that remained in town during the economic downturn. She asked what would happen if the market crashed again and these guidelines were in place. Ms. Barksdale-Noble pointed out that basic homes would not be allowed at this point due to the ordinances put in place. Clayton Marker asked what would happen if a developer just sells lots and a different builder comes in to build. Ms. Barksdale-Noble said the only requirement is that building permits are reviewed to determine if the houses meet the code. If changes were to be made in the process, it would be the decision of the Council. Pulte rep Jason Boyer said Pulte could not have continued to build if the standards in place then were not allowed. The homes sold for $110,000 to $120,000 were starter homes and are no longer being built. He said other communities do have the requirements Yorkville is proposing, but it is challenging. Ms. Teeling said the people who live there would rather have the single family rather than a townhome. Aldermen Teeling, Colosimo and Koch said they were not in favor of a review committee, but were OK with minor changes. Staff will continue to work on this and will bring back to EDC. Old Business: None Page 4 of 4 Additional Business: Heartland representatives were present to discuss their new 46-lot, age-restricted development. They have had their PUD review and have a Plan Commission Public Hearing next week. Staff prepared a memo regarding a Park Board member becoming a voting member on the Plan Commission. The Park Board focus will be on parks and land cash. Ms. Barksdale-Noble said the developer is asking for a $30,000 per acre land valuation for parks. Since there is no place to put a park in this adult community and Hiding Spot Park is already there, Marker has asked to donate $54,000 - $55,000 to park land cash. Attorney Kramer said that $18,000 per acre was a recent land cash value in two residential subdivisions that were entitled, but not improved. He suggested that the $30-$35,000 per acre price was on target, but can change as the economy improves. Ms. Barksdale-Noble said that land cash will be determined on a case-by-case basis. Mr. Koch said the County has had land cash valued at $80,000 per acre. Mr. Olson said land cash is set up in two ways--land can be donated or cash given. Cash will be the donation for this development. It was noted by Mr. Marker that when the develoment is complete, it will bring $260,000 in taxes to the school district without bringing additional children into the schools since it is an age-restricted. community. Marker, Inc. has asked for a $3,000 per unit transition fee waiver from the schools and this will be formalized in a letter from the schools. For the record, Mr. Marker said they are the first developer to increase that fee (from $1,500). This item will move forward to Plan Commission on May 14th and City Council for vote on May 27th. Ward Breakdown: Ward 3 has the highest amount of newly filed foreclosures of all the wards. Bristol Bay and Whispering Meadows are a couple of the larger subdivisions within Ward 3, which would indicate the reason for the higher amount of foreclosures. Ward 2 had the fewest amount of newly filed foreclosures in the first few months of 2014. Ward 2 is generally located within the downtown/older part of town and would indicate a stronger stability in the foreclosure market. Subdivision Breakdown: Bristol Bay had the highest amount of newly file foreclosures in the first few months of 2014. Bristol Bay has a mix of single family residences and townhomes, as well as a large amount of condominiums within the subdivision, which indicates a large amount of homeowners. Therefore, it would point towards a higher rate of foreclosures compared to other subdivisions. Property Type Breakdown: The largest amount of newly filed foreclosures in the first few months of 2014 was single family residences. Since a majority of the housing stock in Yorkville is single family detached, this statistic is anticipated. Future Trends: As indicated from the last update, newly filed foreclosures are likely to play a smaller role in the housing market in 2014. This is evident in the fact that the overall number of newly filed foreclosures from January 2014 to April 2014 is down substantially. National expectations are concurrent with what is forecasted in Illinois. A steady decline in foreclosures should continue with the overall housing recovery. Chris Heinen Community Development Name Department Request Summary: Staff has been in contact with the contract purchaser of the Country Hills residential subdivision, Steve Chirico, who is seeking to reduce the building permit fees for the development to their prior rate when the development was initially annexed and approved in 1994. As the contract purchaser of the Country Hills subdivision, Country Hills Yorkville, LLC is looking to start construction on 23 vacant lots but the current building permit fees, which are upwards of $25,000 per unit, are cost prohibitive. See map below indicating the lots being purchased. The increase in fees is largely due to the development fees, particularly, the Municipal Building Fee which was $150 per unit under the fee lock and is now $1,759 per unit; land cash donations for parks which are $2,756 per unit and schools which are $4,392 per unit; and an increase in water and sewer recapture rates as well as the River Crossing fee. Development Background: The Country Hills subdivision is generally located south of IL Rte. 71 and just west of Route 126 and consists of approximately 79-acres with 39 acres zoned R-2 One-Family Residence; 7.5 acres zoned R-2 Duplex Residential and the remainder for commercial. On May 12, 2014, the annexation agreement expired and all current building permit fees were implemented. All infrastructure such as streets, stormwater management basins, water mains and other utilities were subsequently constructed in this development. A majority of the lots within the subdivision were built upon with approximately 45 single family lots remaining. The petitioner is looking to acquire 23 of these lots. Fee Reduction Analysis: Post fee-lock expiration, the current building permit fee for the Country Hills Subdivision is approximately $25,000.00, of which a considerable portion assigned to land-cash fees ($4,392 or ~18%) to the City for parks and school district fees ($3,000 of ~12%). Reduce the public works, police, building, library and BKFD. In addition, the parks and school land-cash fees will be reduce along with the school transition fee. Finally, the south water and sewer recapture and river crossing fees will be reduced. This will result in a reduction of approximately $10,477.00. (Indicated in blue) 2. Remove the engineering impact fee and the parks and recreation impact fee in their entirety. This will result in a reduction of approximately $150.00. (Indicated in red) The resulting overall building permit fee is approximately $14,330 per single family dwelling unit, which the prospective developer has indicated is acceptable in today’s market and will allow a favorable build-out rate of 2 to 4 homes per year over the next several years. Staff Recommendation: Staff is supportive of the request for building permit fee reduction for the Country Hills Subdivision, as it will hopefully stimulate construction within this development specifically and generate needed development on the south side of the City. For your reference, the City Attorney has prepared a draft economic incentive agreement which outlines the provisions for the recommended fee reductions. Aerial Map ECONOMIC INCENTIVE AGREEMENT BETWEEN THE UNITED CITY OF YORKVILLE AND COUNTRY HILLS YORKVILLE, LLC (Country Hills Subdivision) THIS ECONOMIC INCENTIVE AGREEMENT dated as of the ______ day of ______________, 2014, is by and between the United City of Yorkville, Kendall County, Illinois, a municipal corporation (hereafter the “City”) and Country Hills Yorkville, LLC, 1051 Frontenac Road, Naperville, Illinois, an Illinois limited liability company (hereafter “Country”). W I T N E S S E T H: WHEREAS, the City is a duly organized and validly existing non home-rule municipality created in accordance with the Constitution of the State of Illinois of 1970 and the laws of the State; and, WHEREAS, Country as a developer and builder has purchased 23 vacant lots within Phase 1 and 2 of the Country Hills Subdivision which had remained vacant for numerous years; and, WHEREAS, Country has approached the City to propose beginning construction of detached single family homes on the vacant 23 lots and that it needs to receive certain incentives necessary to make the cost of construction of these single family homes competitive with other builders in nearby subdivisions; and, WHEREAS, Country had advised the City that as a result of the construction of 23 single family homes that a total of $4,600,000.00 (23 x $200,000) in new assessed value will be added to the tax base of the City; and, WHEREAS, the Mayor and City Council of the City (the “Corporate Authorities”) have reviewed the desirability of constructing 23 homes on the vacant lots in the Country Hills 1 Subdivision and have concluded that such construction would provide for the economic development thereby enhancing the tax base of the City and the other taxing districts, and add to the wealth and prosperity of the City and its citizens; and, WHEREAS, pursuant to Section 8-1-2.5 of the Illinois Municipal Code (65 ILCS 5/8-1- 2.5) (the “Act”), the Corporate Authorities are empowered to “appropriate and expend funds for economic development purposes, including, without limitation, the making of grants to any other governmental entity or commercial enterprise that are deemed necessary or desirable for the promotion of economic development within the municipality”; and, WHEREAS, the City is prepared to provide economic assistance to Country as authorized by Section 8-1-2.5 of the Act through the reduction of certain permit and impact fees, all as hereinafter set forth. NOW, THEREFORE, for and in consideration of the premises and the mutual covenants hereinafter set forth, the parties agree as follows: Section 1: Incorporation. Country shall, at its own cost and expense, appear, defend, and pay all charges of attorneys, costs, and other expenses arising therefrom or incurred in connection therewith. Section 6: Severability. If any section, subsection, term, or provision of this Economic Incentive Agreement or the application thereof to any party or circumstance shall, to any extent, be invalid or unenforceable, the remainder of said section, subsection, term, or provision of this Economic Incentive Agreement, or the application of same to parties or circumstances other than those to which it is held invalid or unenforceable, shall not be affected thereby. Section 7: Notices. Barksdale-Noble, AICP Community Development Name Department The purpose of this memorandum is to provide the Economic Development Committee (EDC) with an update on the Building Department’s proactive inspections of property maintenance violations in the City’s downtown area. A brief narrative of the statuses for properties with on-going major violations has been provided below as an update of progress made since our last major sweep in October 2013. Staff has resumed the inspection sweeps this month to coordinate with the nuisance grass season. Comprehensive Windshield Survey Proactive inspections were conducted by the seasonal part-time Code Enforcement Inspector using a new strategy for increased compliance over a larger area termed “comprehensive windshield surveys” of specific sectors of the community, beginning with the downtown and surrounding properties. The windshield survey consisted of the inspector observing and taking notes/photographs of property maintenance and building code violations with in a certain sector on a parcel-by-parcel basis. Once a sector was completed, the inspector generated violation notice letters to the property owners informing them of the infractions and establishing a deadline for compliance. Follow -up inspections were conducted upon the expiration of the deadline and citations were issued if the violation was not in compliance. Additional information regarding the status of those findings will be provided during the EDC meeting. It is staff’s opinion that this systematic and incremental approach to code enforcement has been successful and allows for detailed inspections with thorough documentation without it becoming overwhelming or arbitrary for the inspector. It also creates a baseline of violations to use each year in identifying which areas/neighborhoods of the City to concentrate enforcement efforts. Once the spring/summer sweep has been completed in late June or early July, additional outcomes will be provided. Barksdale-Noble, AICP Community Development Name Department Summary The applicant is seeking to amend the existing Kendall Crossing Special Use Permit for Planned Unit Development (PUD) to identify a proposed new building with the PUD and authorize the building’s user, a daycare center, as a special use within the commercial development. Due to the development’s underlying zoning of B-2 General Business District, daycare centers are allowed only as a Special Use. The proposed new daycare center, Lighthouse Academy, will be relocating from its current operation in the Heartland Business Center to within the Kendall Crossing devel opment. As proposed, the approximately 10,450 square foot one-story facility will be located on an acre of land in Lot 6 of the Kendall Crossing development which has recently been subdivided into two (2) parcels through the Plat Act exemption. The site plan for the daycare center also includes off- street parking as well as an outdoor fenced play area. The remaining acreage of Lot 6 will be developed for a future user at a later date in accordance with the approved Planned Unit Development (PUD). Special Use for Planned Unit Development (PUD) On November 5, 2012, via Ordinance 2012-40 (see attached), the City Council approved a Special Use Permit for Planned Unit Development specifically for the 38,500 square foot cinema complex and allowed for the subdivision of various outlots within the Kendall Crossing commercial development. This agreement authorized the construction of the movie theater building only and granted relief from certain zoning and bulk regulations related to that use. Since the approving ordinance only authorized uses that were out right permitted by the current underlying zoning and no further deviations were explicitly provided for with the Special Use Permit, the request for the proposed new daycare center requires additional review and approval by the Plan Commission and City Council, respectively. Approval is also required for the proposed new building on the recently subdivided lot. Staff Comments: Staff is supportive of the proposed new daycare center within this planned unit development, as the same daycare center operated without incident in a similar commercial development and was complementary to the surrounding retail uses. This request is scheduled for the July 9, 2014 Plan Commission meeting for a public hearing and a recommendation will be forwarded to the City Council at the July 22nd meeting. In what respect does the design of the Planned Unit Development meet the requirements and design standards of the development standards and design criteria. ANSWER: The Planned Unit Development Ordinance of the United City of Yorkville as well as the original Planned Unit Development approved for Countryside Center promoted an upscale community shopping area that takes advantage of the major traffic intersection in the United City of Yorkville of Route 47 and Route 34. The proposed NCG Cinema Group Project complies with that Ordinance and the original Planned Unit Development Agreement in that it has an upscale movie theater which will enhance the entertainment and tax base for the United City of Yorkville. The Architecture shows a foot print that will enhance the future development of the area and is consistent with United City of Yorkville Building Codes and Design. 2. The extent to which the proposed plan deviates and/or requires waivers of the bulk regulations in the zoning ordinance and how the modifications in design standards from the subdivision control regulations fulfill the intent of those regulations. ANSWER: No bulk regulations will be deviated by the addition of the NCG Theater Complex. There are certain waivers being granted with respect to parking spaces, signage, and best management practice detention areas. The square footage of the building, complies with all United City of Yorkville Building Codes and Regulations and the bulk area of the property complies with all regulations and ordinances of the United City of Yorkville. 3. The extent of public benefit produced by the Planned Unit Development, such as but not limited to, the adequacy of common open space and/or public recreational facilities provided; sufficient control over vehicular traffic; provision of public services; provision and protection of the reasonable enjoyment of the land. ANSWER: The proposed Planned Unit Development Amendment complies with the City Planned Unit Development Ordinance in that it provides for substantial open space in the overall Countryside Center Development, will provide a smooth flow of traffic with the proposed traffic lay out and internal road improvements that will be done at the expense of owner and developer, adequate public services in terms of utilities exist to the site and the site in fact is the location of an earlier two screen movie theater that served the community for over two decades. 4. The relationship and compatibility, beneficial or adverse, of the Planned Unit Development to the adjacent properties and nearby land uses. ANSWER: It is anticipated that there will be a substantial beneficial effect to surrounding property within Countryside Development and the commercial areas of the United City of Yorkville on Route 47 and Route 34. It is anticipated the ten screen cinema will encourage restaurant traffic substantially for existing restaurants, as well as attract new restaurant and retail opportunities on the lots surrounding the Cinema that are being redeveloped by the Owner/Developer, James G. Ratos. It further will benefit ancillary businesses such as gas stations and other retail outlets that always benefit when increased traffic is brought past their places of business. 5. The extent to which the Planned Unit Development fulfills the objectives of the future planning objectives or other planning policies of the City ANSWER: The proposed Planned Unit Development Amendment complies with the objectives of the United City of Yorkville in that the TIF District was created for Countryside Center to rejuvenate what once was a thriving commercial retail center for over two decades, but has been demolished. The property in the proposed PUD Amendment will generate substantial real estate taxes to the Yorkville School District and all related government bodies as well as create a substantial number of full and part-time jobs in the City on a permanent basis. On a temporary basis it will provide extensive construction jobs for local contracting firms in that the Owner/Developer will be the builder for the NCG Cinema Building and has retained the services of a local general contractor who hires all local people to construct the facility and the site improvements. The proposal meets the overall objectives of the City to create economic opportunities on the site which was the reason the TIF District was created. Standards for Special Use: Section 10-14-617 of the City's Zoning Ordinance establishes standards for special use requests. No special use shall be recommended by the Plan Commission unless said commission shall find that: 1. The establishment, maintenance or operation of the special use will not be unreasonably detrimental to or endanger the public health, safety, morals, comfort or general welfare. ANSWER: There are no negative effects to the development of the subject property, in that all traffic, utility, and development concerns were provided for in the original Countryside Center Design and the proposed PUD Amendment enhances the traffic flow by reconstructing internal roadways and providing adequate access outlets to Route 47 and Route 34. 2. The special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purpose already permitted, nor substantial diminish and impair property values within the neighborhood. ANSWER: The property was previously used as a very active retail center since the early 1970s until its demolition. The use for the Cinema will not in any way change the commercial use or impact the surrounding ownership of properties. In fact it should increase substantially the property values in the neighborhood by having a thriving commercial district once again located in Countryside Center. 3. The establishment of the special use will not impede the normal and orderly development and improvement of surrounding property for uses permitted in the district. ANSWER: Same Answer 4. Adequate utilities, access roads, drainage or other necessary facilities have been or are being provided. ANSWER: Plans are currently being reviewed as to final design, and will provide adequate access, drainage, and all utility facilities which are to the site. 5. Adequate measures have been or will be taken to provide ingress or egress so designed as to minimize traffic congestion in the public streets. ANSWER: Same answer as to 4 above. 6. The special use shall in all other respects conform to the applicable regulations of the district in which it is located, except as such regulations may in each instance be modified by the City Council pursuant to the recommendations of the Plan Commission. ANSWER: Other than the Planned Unit Development modifications indicated in the Staff Report, and the installation of monument signage closely resembling the previous monument signage that existed at Route 47 and Route 34, the proposal complies with all Ordinances of the United City of Yorkville other than specifically modified by this PUD Amendment. Finding: There are no negative effects to the development of the subject property, in that all traffic, utility, and development concerns were provided for in the original Countryside Center Design and the proposed PUD Amendment enhances the traffic flow by reconstructing internal roadways and providing adequate access outlets to Route 47 and Route 34. 2. The special use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purpose already permitted, nor substantially diminish and impair property values within the neighborhood. Finding: The property was previously used as a very active retail center since the early 1970s until its demolition. The use for the Cinema will not in any way change the commercial use or impact the surrounding ownership of properties.
