ORDINANCE NO. 1994- 1
AN ORDINANCE AMENDING THE UNITED CITY OF THE
VILLAGE OF YORKVILLE ZONING ORDINANCE TO
PROVIDE FOR APARTMENTS TO BE LOCATED IN
BUSINESS ESTABLISHMENT BUILDINGS
BE IT ORDAINED BY THE CITY COUNCIL OF THE UNITED CITY OF THE
VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS:
WHEREAS, the Mayor and City Council of the UNITED CITY OF THE VILLAGE OF
YORKVILLE, upon the recommendation and request of various members of the community,
deem it to be in the best interest of the business community and the community of the City in
general, and for the greater public good, to amend the City's Zoning Ordinance to allow for
Single-Family Apartments as a Permitted Use to be located in buildings which have been zoned
for business under B-1, under the UNITED CITY OF THE VILLAGE OF YORKVILLE
Comprehensive Zoning Ordinance; and to allow Single-Family Apartments as a Special Use in
buildings which have been zoned B-2 or B-3 Business Districts.
NOW THEREFORE, the Mayor and City Council of the UNITED CITY OF THE
VILLAGE OF YORKVILLE upon Motion duly made seconded and approved, hereby amend the
Yorkville Zoning Office as follows:
1. That real estate zoned under B-I Limited Business District is permitted to have Single-
Family Apartments located in the business building.
2. That said apartments may be on any floor of the business building, in conformance
with BOCA Code.
3. That said apartment must be contained in the business building and not exist separate
and apart from the building.
400 4. That in the case of a business which contained more than one apartment on a second
floor above a first floor business said business is allowed to have two apartments maximum.
5. That any and all Zoning Ordinances which prohibit apartments in property zoned for
business are hereby specifically revoked.
6. That the above-apartment use and regulations shall be permitted as a Special Use in
B-2 General Business District and B-3 Service Business District; which shall be processed in
conformance with normal City Special Use Zoning Procedures as set out in the City
Comprehensive Zoning Ordinance.
7. This amendment shall replace any ordinance which prohibits apartments in property
zoned for business.
8. That in all other respects the zoning ordinance remains in full effect.
IN WITNESS WHEREFORE, this Ordinance has been enacted this day of
1994.
