Ordinance 1992-01 . r CITY OF YORKVILLE ORDINANCE NO. 1992- _ AN ORDINANCE GRANTING SPECIAL USE BED AND BREAKFAST - GERALD J. LYNCH WHEREAS, GERALD J. LYNCH, contract purchaser, with the express consent and approval of Carolyn Parks, owner of the real estate hereinafter described, has petitioned the City of Yorkville for the granting of a special use for "Bed and Breakfast" , to operate a bed and breakfast facility on said real estate, incidental to single-family use, said real estate being described and known as follows, to-wit: Lot 12 in Black' s Second Addition to the Village of Yorkville, Kendall County, Illinois, Commonly known as 507 West Ridge Street, Yorkville, Illinois; WHEREAS, said Application for Special Use Permit has been considered by the Planning Commission, after due notice, publication and public hearing; and WHEREAS, the Planning Commission of the city has recommended the approval of the granting of the requested Special Use Permit in accordance with the restrictions herein specified; and WHEREAS, the Application for Special Use has, in all respects, been presented in accordance with the applicable ordinances of the City of Yorkville and the City Council concurs in the recommendations from the Planning Commission regarding the granting of the requested special use. NOW, THEREFORE, be it ordained by the Mayor and City Council �oC r� of the City of Yorkville, Kendall County, Illinois, that special use for "Bed and Breakfast" facility be granted for the following described real estate, to-wit: Lot 12 in Black' s Second Addition to the Village of Yorkville, Kendall County, Illinois, Commonly known as 507 West Ridge Street, Yorkville, Illinois. BE IT FURTHER ORDAINED by the Mayor and City Council of the City of Yorkville, Kendall County, Illinois, that said Special Use Permit and Classification shall be subject to the following restrictions and/or conditions: The Bed and Breakfast Facility: (A) Shall have no more than two ( 2 ) guest rooms for rent. (B) Shall maintain a guest register which shall be available at all times for inspection. (C) In addition to the parking requirements for a single family detached dwelling, the bed and breakfast establishment shall provide one ( 1 ) additional parking space for each guest room. The parking spaces shall be located in the area identified as Parking Option No. 1 on Exhibit "A" attached hereto and made a part hereof. (D) The guest rooms shall be established as set forth in the Building Sketch attached hereto as Exhibit "B" . (E) Only one ( 1 ) sign shall be permitted for the establishment. The maximum size of the sign shall be one and one half ( 1 1/2 ) square feet in area as permitted under Section 10-A-1 of the zoning ordinance. r (F) No guest room shall have any kitchen facilities. (G) Guest room shall mean sleeping room intended to serve no more than two ( 2 ) adult transient guests per night. (H) Accommodations shall be provided in guest rooms only. The length of stay in the establishment shall be a maximum of one ( 1) week. (I ) The bed and breakfast facility shall be owner occupied. BE IT FURTHER RESOLVED that this ordinance shall take effect and shall be in full force and effect from and after its passage, approval and signing by the Mayor of the City of Yorkville.
