Ordinance 1992-14A STATE OF ILLINOIS COUNTY OF KENDALL ORDINANCE NO. 1992 AN ORDINANCE REVISING THE ZONING ORDINANCE OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE WHEREAS, the Plan Commission of the United City of The Village of Yorkville has heretofore requested the City Council to consider amendments to the Zoning Ordinance of the City to create a new zoning district, namely: A-1 /Agricultural District; and WHEREAS, the Plan Commission has heretofore recommended to the City Council that an A-1 /Agricultural District be created and that lands maybe annexed to the City, but retain an A-1 /Agricultural District classification; unless otherwise provided in the annexation ordinance and annexation agreement; and WHEREAS, at the request of the City Council, the Plan Commission of the United City of the Village of Yorkville published for and thereafter conducted a public hearing to consider the Amendments to the Zoning Ordinance; and WHEREAS, after due consideration and deliberation, the City Council finds that it is in the best interests of the City to amend the Zoning Ordinance of the City to create a new zoning district, namely: A-1 /Agricultural District. NOW THEREFORE, be it ordained by the Mayor and City Council of the United City of the Village of Yorkville, Kendall County, Illinois, that its Comprehensive Zoning Ordinance be amended as follows: SECTION 1 ADD SECTION 9.01 "ZONING OF AGRICULTURAL DISTRICT" PURPOSE: The regualtions for the Agricultural District are intended to govern the use of the land and building and structures for agricultural purposes after the annexation of land into the City of Yorkville for so long as the owner or owners thereof shall desire to continue to devote said land to agricultural purposes. These regulations are also intended to provide for the protection, conservation and utilization of natural resources; to preserve the value of existing and future open space and recreation facilities; and to provide for the orderly development of the real estate for all uses permitted under the various use districts under this zoning ordinance. 9.01 : Permitted Uses: 1 . Agricultural 2. Single family residential use, provided only three additional single family dwellings shall be permitted for the total parcel zoned Agricultural District and annexed to the City of Yorkville; whether later subdivided into separate parcels after annexation. In the event of approval of re-zoning to a residential use of the subject parcel or any portion thereof, this section shall not apply. 3. The City Plan Commission and City Council reserves the right to require that prior to issuance of a residential building permit within an Agricultural District, the City Council has a right to require their approval of the residential building site, with regard to compatability with the Comprehensive Plan, future roadway and utility extensions, and sufficient buffering between residential and non-residential uses. 3. Signs: As permitted and regulated pursuant to the applicable provisisons of Section 10 of the City Zoning Ordinance. 9-01-Special Uses: 1 . Agricultural sales, storage and service of agriculturally oriented products. 2. Airports, or aircraft landing fields. -2- 3. Animal feed, storage preparation, mixing, and wholesale and retail. 4. Animal hospital. 5. Blacksmith or welding shops. 6. Cemeteries, including crematoriums and mausoleums provided not building shall be located less than one hundred (100) feet from a lot line. 7. Churches, temples or synagogues. 8. Colleges and universities, including dormitories, fraternities, sororities and other accessory buildings and structures or trade schools. 9. Commercial feeding of fish, poultry and livestock. 10. Commercial or private dog kennels provided that they are located not less than five hundred (500) feet from a residential lot line. 11 . Golf courses, miniature golf courses and driving ranges provided that no clubhouse or accessory building shall be located less than three hundred (300) feet from a lot line. 12. Fertilizer sales, including bulk storage and mixing. 13. Grain elevators and storage. 14. Nurseries and greenhouses, wholesale and retail, provided that all plants are grown on the premises. 15. Milk processing and distribution, including pasteurizing and manufacture or ice cream but not including the processing or manufacture of cheese. 16. Outdoor amusement establishments, fairgrounds, carnivals, circuses, race tracks, and other similar amusement centers, and including places of assembly devoted thereto, such as stadiums and arenas. 17. Philanthropic and eleemonsynary institutions. 18. Private clubs or lodges, execept those the chief activity of which is a -3- service customarily carried on as a business. 19. Private recreational area or camps. 20. Public utility and public services, including electric substations; repeater stations; micro-wave relay towers and stations; mobile transmitting tower and stations, antenna towers and other outdoor equipment essential to the operation of exchange in the interest of public convenience and necessity; water filtration plants; water pumping stations; water reservoir and similar uses. 21 . Communications use. 22. Railroad passenger depots. 23. Railroad right-of-way and trackage, but not including classification yard, terminal facilities, piggy-back facilities or maintenance facilities. 24. Rest homes, nursing homes, hospitals and sanitariums, institutions for the aged and for children for human beings only. 25. Riding academies and stables. 26. Sales yards, wholesale or retail, for agricultural products including, but not necessarily limited to, fruits, vegetables, flowers, plants, etc. 27. Seminaries, convents, monasteries, and similar religious institutions including dormitories and other accessory uses required for operations. 9.02 : Accessory Uses: 1 . Those customarily accessory to the pursuit of agriculture, provided that structures for the shelter of livestock, poultry, and other farm animals shall be located not less than one hundred (100) feet from a lot line. 2. Roadside stands for the sale of produce or poultry grown and raised on or in the immediate area of the premises, but not including live animals, and provided that such stands shall contain not more than six hundred (600) square feet of floor area, Each roadside stand shall have facilities approved by the Superintendent -4- of Streets, for vehicular ingress and egress, and adequate off-street parking. 90.03: Building setback lines and Lot Coverage: 1 . Every building hereafter erected or enlarged shall provide and maintain a setback from the public street in accordance with the following requirements: a. Primary thoroughfares, (Route 34 & 47) two hundred (200) feet from the right-of-way. b. All other streets or roads, one hundred (100) feet from the record or established right-of-way. c. Side yards 1 . Each building hereafter erected or remodeled shall have a side yard on each side of each building of not less than fifty (50) feet. d. Floor Area Ratio 1 . Maximum floor area ratio for special use shall be established at the time a special use permit is granted. e. Building Permits, Codes and Fees 1 . All buildings and structures used for agricultural purposes shall be exempt from building permits, codes and fees. f. The fencing restrictions contained in this zoning ordinance shall not apply to agricultural uses under this ordinance. Fencing requirements for special uses shall be established at the time a special use permit is granted. SECTION 2 This Ordinance shall be in full force and effect from and after its passage and approval and publication as required by law. SECTION 3 This Ordinance shall be published in pamphlet form and copies hereof shall be made available, immediately, through the Office of the City Clerk of the United -5- City of the Village of Yorkville.
