Ordinance 1991-01 a.,7 ORDINANCE NO. 1991 - ORDINANCE ANNEXING TERRITORY TO THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS (THEODORE R. SHICK and JERILYN I . SHICK) WHEREAS, Theodore R. Shick and Jerilyn I . Shick, his wife, as record owners in fee simple of a tract of land contiguous to the United City of the Village of Yorkville, Kendall County, Illinois, and legally described as follows: to-wit: That part of the Southeast Quarter of Section 28 , Township 37 North, Range 7 East of the Third Principal Meridian described as follows: Commencing at the Northwest corner of Lot 13 in Wackerlin Subdivision; thence Southerly along the West line of said lot, and the West line of Lot 12 in said subdivision, 314. 22 feet for a point of beginning; thence Southerly along the West line of said Lot 12 , a distance of 85. 78 feet to the North line of Martin Avenue; thence Westerly along said North line, 274 . 95 feet to the East line of McHugh Road; thence Northerly along said East line, 85 . 78 feet to a line drawn Westerly, parallel with said North line, from the point of beginning; thence Easterly along said parallel line, 274 . 88 feet to the point of beginning, in Bristol Township, Kendall County, Illinois , have heretofore filed a Petition To Annex said real estate into the City and to zone said real estate R-2, One-Family Residence District; and WHEREAS, pursuant to said Petition, the Planning Commission of the City has considered the annexation and zoning of said real estate and has conducted a public hearing thereon; and WHEREAS, the Petitioners are the owners of said real estate and no electors reside thereon; and FILED FOR RECORD K NDA�L COUNTY ILL, DCC. _/oGa JAN 3 1 1991 �ECOF,DER OF DEEDS /_/ BK :3 2 7 PC�3 WHEREAS, the Petitioners are, under oath, requesting the annexation of said real estate to the City and in all respects have presented their Petition in accordance with the provisions of Section 7-1-1 of the Illinois Municipal Code, being Chapter 24 of the Illinois Revised Statutes; and WHEREAS, upon investigation by the proper authorities of the City, it has been ascertained that said Petition confirms, in all respects, to the requirements of the statutes and that said property is contiguous to the United City of the Village of Yorkville, Kendall County, Illinois, and is not within the corporate limits of any other municipality; and WHEREAS, due notice of said Petition for Annexation has been served upon the Bristol Township Road Commissioner, the Trustees of Bristol Township, and the Trustees of the Bristol-Kendall Fire Protection District as required by Statute; and WHEREAS, the statutes provide that upon affirmative vote from the majority of the City Council, contiguous territory can be annexed into the City. NOW, THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of the Village of Yorkville, Kendall County, Illinois, as follows: SECTION 1 : That the following described real estate, to-wit: That part of the Southeast Quarter of Section 28, Township 37 North, Range 7 East of the Third Principal Meridian described as follows: Commencing at the Northwest corner of Lot 13 in Wackerlin Subdivision; thence Southerly along the West line of said lot, and the West line of Lot 12 in said subdivision, 314. 22 feet for a point of beginning; thence Southerly along the West line of said Lot 12, a distance of 85 . 78 feet -2- BK 3 2 ,7 pG Zf-�'. to the North line of Martin Avenue; thence Westerly along said North line, 274 . 95 feet to the East line of McHugh Road; thence Northerly along said East line, 85 . 78 feet to a line drawn Westerly, parallel with said North line, from the point of beginning; thence Easterly along said parallel line, 274 . 88 feet to the point of beginning, in Bristol Township, Kendall County, Illinois, together with all of that part of Martin Avenue lying Southerly and adjacent to the within described real estate, be and the same is hereby annexed into the United City of the Village of Yorkville, Kendall County, Illinois. SECTION 2 : That the city limits of the City be and they are hereby extended to include the territory hereby annexed to the city in accordance with the map of said real estate attached hereto and made a part hereof and marked as Exhibit "A" . SECTION 3 : That the real estate described herein be and the same is hereby zoned R-2, One-Family Residence District under the provisions of the Zoning Ordinance of the City. SECTION 4 : No building permit shall issue for the construction of a single-family residence or dwelling on said real estate until such time as municipal utilities are extended to the real estate to provide municipal sewer services, municipal water services, and storm sewer services. SECTION 5 : That the City Clerk of the City be and she is hereby authorized and directed to record with the Recorder of Deeds of Kendall County, Illinois, a certified copy of this Ordinance, together with an accurate map of the property annexed, together with an Affidavit of Notice as required by Section 7-1-1 of Chapter 24 of the Illinois Revised Statutes setting forth that notice of said annexation has been served upon the Bristol Township Road Commissioner, Trustees of Bristol Township, and -3- .sK 3 2 7 PG --- Trustees of Bristol-Kendall Fire Protection District. SECTION 6 : That the City Clerk of the City be and she is herewith authorized and directed to give notice, by certified or registered mail of the annexation of the within described real estate to the election authorities having jurisdiction in the territory hereby annexed and in the post office branch serving the territory herein annexed, within thirty ( 30) days of the annexation of the within described real estate. SECTION 7: This Ordinance shall be in full force and effect after its passage and approval and signing by the Mayor and after it has been recorded by the Recorder of Deeds of Kendall County, Illinois.
