Ordinance 1991-03 ORDINANCE NO. 1991- AN ORDINANCE REZONING AND RECLASSIFYING REAL ESTATE AND GRANTING VARIATIONS GREGORY HUBER and PATRICIA HUBER WHEREAS, GREGORY HUBER and PATRICIA HUBER, his wife, as owners of the real estate hereinafter described, situated in the United City of the Village of Yorkville, Kendall County, Illinois, to-wit: Lot 8 in Block 6 of Mason's Addition to Yorkville, in the United City of the Village of Yorkville, Kendall County, Illinois. being an unimproved lot situated on the North side of East Orange Street in the United City of the Village of Yorkville, Kendall County, Illinois, have heretofore caused to be filed with the Corporate Authorities of the United City of the Village of Yorkville, a Petition to Rezone said real estate from R-2, one-Family Residence District to R-2, Duplex Two-Family Residential District under the provisions of the Zoning Ordinance of the United City of the Village of Yorkville, and to grant variations from the strict letter of the regulations of the Zoning Ordinance of the United City of the Village of Yorkville; and WHEREAS, said Petition requests variations from the strict letter of the regulations of the Zoning Ordinance, as follows: A. That a variation be granted from Section 6.03-C-2-Lot Area Per Dwelling, to reduce the required lot area from 15,000 square feet to 8,556 square feet; and B. That a variation be granted from Section 6.03-C-2-Lot Width, to reduce the required lot width at the building line from 100 feet to 64 feet; and WHEREAS, the Planning Commission of the United City of the Village of Yorkville, Kendall County, Illinois has heretofore conducted a public hearing on the request for rezoning, after having given due notice of said public hearing, and has investigated the desirability of granting the requested rezoning, and has recommended to the City Council that said rezoning be granted; and WHEREAS, the Zoning Board of Appeals of the United City of the Village of Yorkville, Kendall County, Illinois, undertook to conduct a public hearing on the Petition for Variation, at which no objectors were present and, lacking a quorum, informally advised the City Council of the City of its recommendation to grant the requested variations; and WHEREAS, said application has, in all respects, been presented to the corporate authorities of the United City of the Village of Yorkville in accordance with the Ordinances of the United City of the Village of Yorkville and the Statutes of the State of Illinois, NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the United City of the Village of Yorkville, Kendall County, Illinois as follows: SECTION 1 : That the real estate herein described be and the same is hereby zoned and classified R-2, Two-Family Residence District, under the Zoning Ordinance of the United City of the Village of Yorkville. SECTION 2: That variations be and the same are hereby granted from the provisions of the Zoning Ordinance of the United City of the Village of Yorkville, Kendall County, Illinois, to authorize the issuance of a building permit for the erection and maintenance of a duplex dwelling structure on said real estate, as follows: A. That a variation be granted from Section 6.03-C-2 Lot Area Per Dwelling, to reduce the required lot area from 15,000 square feet to 8,556 square feet; and -2- r r B. That a variation be granted from Section 6.3-C-2 Lot Width, to reduce the required lot width at the building line from 100 feet to 64 feet. SECTION 3: At the time of the construction of the duplex dwelling structure on said real estate, the owner or owners of said real estate shall thereupon plant and thereafter maintain a year-round buffer of evergreen trees to limit the view and provide privacy between the real estate herein described and the real estate located immediately to the North of the same and situated at 104 East Washington Street, Yorkville, Illinois. SECTION 4: The within described lot was a lot of record in the United City of the Village of Yorkville prior to the passage of any Land Cash/Fee Ordinances for improvements to the intrastructure of the City. Accordingly, such Land Cash/Fee Ordinances/Impact Fee Ordinances shall not apply to the development of the within described real estate for use as a single-family dwelling or as a duplex structure. SECTION 5: This Ordinance shall be in full force and effect from and after its passage and approval as provided by law.
