ORDINANCE NO. 1990-
AN ORDINANCE AMENDING
AN ORDINANCE PROVIDING
THE POSTING OF CITY STREETS
PASSED THE 25th DAY OF JANUARY, 1990
BE IT ORDAINED BY THE CITY COUNCIL OF THE UNITED CITY OF
THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS:
WHEREAS, the Mayor and the City Council of the United City of the
Village of Yorkville, upon recommendation and request of the City Streets
and Alleys Committee, has deemed it to be in the best interest of the preservation
and maintenance of all city streets not of Class II status pursuant to the
Illinois Motor Vehicle Cade anc- Hlh-:cis and Bridge Act, to be posted
for the prohibition of rPl icle in excess of 12,000 pounds gross weirht, or
in excess of 6,000 pounds per axle, being driven thereon from February
15th through May 1st of each year;
NOW THEREFORE, the City Council and the Ma,,.,or of the United City
of the Village of Yorkville, upon motion duly made, seconded, and approved,
hereby prohibit the driving of any vehicle in excess of 12,000 pounds gross
weight, or in excess of 6,000 pounds per axle upon any street not designated
as a Class 11 street from February 15th, or upon earlier posting of the streets
by the City in the event frost is out of the around earlier, through Ntay
1st of each ;-ear, unless the posted weight limit is in fact removed prior
to May 1st, due to frost being totally Out of the ground.
For purposes of identification of present Class 11 streets within the
municipal city limits, Route 47, Route 126, Van Emmon Street, and Fox Road
are the streets currently open for use by vehicles in excess of 12,000 pounds
dross weight or in excess of 6,000 pounds per axle as defined under this
ordinance. Any further streets or highways through the United City of
the Village of Yorkville designated as Class 11 streets, roads or highways
pursuant to the Illinois Motor Vehicle Code, the Illinois Highway and Bridge
Act, or any Federal designation, shall likewise he exempted from the prohibition
contained in this Ordinance, if any said Mass designation is made in the
future.
Violation of any provision of this Ordinance shall subject any offender
to a fine of not less than $500.00, nor an amount in excess of any then current
Illinois Statute affecting local ordinance violations.
