Ordinance 1989-04 ORDINANCE NO. 1989,-/Y AN ORDINANCE REVISING AND AMENDING THE LIQUOR ORDINANCE OF THE UNITED CITY OF VILLAGE OF YORKVILLE PASSED AS ORDINANCE NO. 16-1979 AND FURTHER REVISES ORDINANCE NO. 87-4 WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE has heretofore adopted an Ordinance governing the licensing and sale of alcoholic liquors within the corporate limits of the UNITED CITY OF THE VILLAGE OF YORKVILLE; and WHEREAS, said Ordinance was adopted on the 21st day of April, 1960, and has been modified from time to time thereafter, and a specific Ordinance having been approved by the City Council as Ordinance No. 16-1979 on September 27, 1979; and WHEREAS, said comprehensive ordinance has certain amendments thereto all of which have been passed in binding fashion by the UNITED CITY OF THE VILLAGE OF YORKVILLE from time to time thereafter; and WHEREAS, the City Council and the Mayor of the UNITED CITY OF THE VILLAGE OF YORKVILLE desire to create a separate class of liquor license in addition to all other classes previously established by lawful ordinances of this City; and WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE through its City Council and Mayor have been requested to create a special class of license for FRATERNAL, PRIVATE CLUB and NOT-FOR-PROFIT ASSOCIATIONS : and WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE through its City Council, Mayor, and Liquor Control Commissioner have infact created a special class of license for FATERNAL, PRIVATE CLUB and NOT-FOR-PROFIT ASSOCIATIONS; and WHEREAS, the City Council and Mayor have :een requested to consider modifying the security provisions contained in said private license ordinance ; NOW, THEREFORE, BE IT ORDAINED by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE that said Ordinance regulating the sale of alcoholic liquor is amended as follows : SECTION I THAT Section IV of Ordinance No. 87-4 is hereby amended that to provide in the event special events or regular events are held on the premises of any holder of said license, in which it is reasonably anticipated that 225 people or more shall be present, then in that event the holder of said license shall be required to provide at their own expense at least one uniformed security person, who is an off-duty regularly employed Police Officer certified with police training institute credentials, to provide security for crowd control purposes, when alcoholic beverages are infact served. IN THE EVENT a crowd of less than 225 persons is anticipated when alcoholic beverages are infact served on premises, no security person shall be required by the CITY OF YORKVILLE to be maintained on said premises. IN THE EVENT a function is held on the premises of any such holder of the above-referenced license at which alcoholic beverages are not to be served, no security person shall be required regardless of number of patrons present. -2- w SECTION II IN ALL OTHER RESPECTS Ordinance No. 16-1979 and Ordinance No. 1987-4 are hereby confirmed and republished and shall remain in full force and effect.
