Ordinance 1988-01 ORDINANCE NO. 88-
AN ORDINANCE AMENDING THE UNITED CITY OF THE VILLAGE OF
YORKVILLE LAND-CASH CONTRIBUTION ORDINANCE
WHEREAS, the United City of the Village of Yorkville is currently experiencing
a substantial increase in population, together with the need to provide expanding
municipal services for the orderly growth and adequate development of the
the City; and
WHEREAS, the School District serving this City is experiencing a rapid
growth in school population and the necessity for the explantion of existing
facilities; and
WHEREAS, the United City of the Village of Yorkville enacted a Land-Cash
Contribution Ordinance providing for cash to be donated upon land being
annexed an improved within the boundaries of the City for subdivision purposes;
and
WHEREAS, the United City of the Village of Yorkville has been formally
requested in writing by the Yorkville School District to amend said ordinance
to provide that the school district could use funds contributed for the purpose
of site improvement, construction of buildings and other capital improvements
with an estimated useful life of more than three (3) years in addition to the
acquisition of future school sites;
NOW, THEREFORE, IT IS HEREBY ENACTED THAT SECTION 1 , PARAGRAPH
C OF SAID ORDINANCE IS HEREBY AMENDED TO PROVIDE THAT THE YORKVILLE
SCHOOL DISTRICT MAY USE FUNDS RECEIVED UPON THE PASSAGE OF
THIS ORDINANCE FOR THE PURPOSE OF BUILDING, SITE IMPROVEMENTS,
AND PURCHASE OF CAPITAL ITEMS WITH A USEFUL LIFE IN EXCESS OF
THREE YEARS, IN ADDITION TO SITE ACQUISITION UNDER THE TERMS
OF THIS ORDINANCE.
EFFECTIVE DATE OF THIS ORDINANCE: This ordinance shall become
effective as to any subdivision for which no preliminary plat has yet been
filed and approved on the date of passage and after due publication of said
ordinance in a newspaper of general circulation as provided under Illinois
Statutes in such case made and provided.
