Ordinance 1986-01 r r • ORDINANCE NUMBER 1986- AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE PASSED DECEMBER, 1971 BE IT ORDAINED BY THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKATILLE, KENDALL COUNTY, ILLINOIS AS FOLLOWS: SECTION I PURPOSE AND INTENT It is the purpose of this Amending Ordinance to provide for uniformity within the Business Zoning Districts of the United City of the Village of Yorkville and to create a new Zoning Classification designated as B-4 hereinafter as provided as follows: For the preservation of present property values of real estate within the United City of the Village of Yorkville and to provide for the orderly expansion of business districts within the corporate boundaries: SECTION II Section 7.02, D, 2 is hereby amended to read as follows: A minimum side yard shall be required between buildings within the B-1 district of 20 feet, between a building constructed thereon and the side lot line, except in any existing B-1 zoning district within the corporate boundaries, where no minimum side yard shall be required between buildings, except where a side yard adjoins a street, wherein a minimum side yard of not less than 20 feet shall be required. The Zoning Board of Appeals may upon application grant a variance to any petitioner seeking to vary the side yard requirement in a B-1 district if the variance is sought for a parcel of real estate that is sought to be developed as a planned unit development because of the unique nature of the parcel or development sought thereon. SECTION III Section 7.03, C, shall be amended to read that no lot shall have an area less than 10,000 square feet. SECTION IV Section 7.03, D, 2 shall be amended to read as follows: A minimum side yard shall be required between buildings within the B-2 district of 20 feet, between a building constructed thereon and the side lot line,. except in any existing B-2 zoning district within the corporate boundaries, where no minimum side yard shall be required between buildings, except where a side yard adjoins a street, wherein a minimum side yard of not less than 20 feet shall be required. SECTION V Section 7.04, A, shall be amended to delete the following specifically named uses from a B-3 zoning district: Auction House Automobile Sales and Service Garage-Bus or Truck Motorcycle sales and Service Recreational Vehicles Sales and Service Truck Sales and Service Utility Company Maintenance Yard Utility Service Yard or Garage and said specific uses shall hereinafter be permitted as uses in a classification designated as B-4 zoning. All lot size, yarn area, lot coverage, building j,_ght, and off- street parking and loading regulations that are effective for B-3 zoning shall be enforced as the requirements for said B-4 zoning classification. SECTION VI Section 7.04, C, shall be amended to read no lot shall have an area less than 10,000 square feet. The existing business districts are hereinafter set-out in the attached Exhibit "A", Zoning Map of The United City of the Village of Yorkville and are designated as E (existing) .
