Ordinance 1986-09 ORDINANCE NO. 1986- AN ORDINANCE PROVIDING FOR DISCONNECTION OF PRIVATE RAIN WATER OR STORM WATER RUN-OFF DIS- CHARGE INTO THE CITY SANITARY SEWER SYSTEM BE IT ORDAINED, BY THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS: WHEREAS, the Mayor and the City Council of the United City of the Village of Yorkville, upon the recommendation and request of the engineering firm independently obtained by said City to evaluate its current sewage disposal system, and with the concurrence of the Yorkville-Bristol Sanitary District requesting that the amount of infiltration of storm water and rain water run-off be limited or reduced from the sanitary sewer system of the United City of the Village of Yorkville; and WHEREAS, the Mayor and the City Council of the United City of the Village of Yorkville upon the recommendation and request of its engineers have determined that the cheapest manner in which to accomplish the same is to use sewer maintenance funds to disconnect known rain water discharge and storm water discharge which is directly connected to the City sanitary sewer system; and further the City Council having first authorized the Director of Public Works to let bids concerning the elimination of said problem; NOW, THEREFORE, the City Council and the Mayor of the United City of the Village of Yorkville upon motion duly made, seconded and approved here- by authorizes said City Council to obtain and accept bids for the elimination of storm water run-off discharge and rain water discharge being eliminated from direct in-flow into the City sanitary sewer system by taking corrective action and do approve the awarding of a bid to accomplish the stated purpose from P1 S_ L 1 in in the amount of M�'300 0" IN WITNESS WHEREOF, this Ordinance has been enacted this / /A day of August, 1986. CM'jLERK r ' PERMISSION TO DISCONNECT STORM WATER RUN-OFF AND DOWN SPOUTS FROM CITY SANITARY SEWER SYSTEM AND HOLD HARMLESS AGREEMENT NOW COMES, , Property Owner who is a resident of or the owner of real estate located within the United City of the Village of Yorkville, located at , Yorkville, Illinois; who does hereby agree in consideration of an offer by the United City of the Village of Yorkville to allow said City to use grant funds and other City sewer maintenance funds to disconnect any downspout or other rainwater run- off collecting pipes that are currently directly connected to the City sanitary sewer system and to provide alternate means of rainwater run-offs or stormwater run-offs on my real property. I further understand that said disconnection from the City sewer system is being done pursuant to a study performed at the request of the United City of the Village of Yorkville to limit infiltration and inflow of storm water into the City sanitary sewer system causing an overburden on said system and an overburden on the sewage treatment plant for the Yorkville-Bristol Sanitary District. I agree that said changes are being conducted by the United City of the Village of Yorkville and agree to allow them or their agents and employees access on to my real property for purposes of conducting the same. I agree to hold harmless and indemnify the United City of the Village of Yorkville, their agents and employees for any claims for damage or otherwise as a result of the alterations in the storm water or rain water disposal system on my real property. l ► It is my further understanding that the United City of the Village of Yorkville will leave any surface areas of my property in "as good as" condition as existed prior to the commencement of said alterations. Where applicable, the United City of the Village of Yorkville shall provide for reseeding and replacement of grass areas, in a good and workmanlike manner.
