ORDINANCE NO. -
AN ORDINANCE REQUIRING
SMOKE DETECTORS
BE IT ORDAINED by the City Council of the UNITED CITY OF THE VILLAGE
OF YORKVILLE, Kendall County, Illinois, as follows:
WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE deems it in
the best interest of the health and saftey of its residents to provide
the installation of smoke detectors in all multi-family housing units; and
WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE deems it in the
best interest of the residents of the City of Yorkville to require the
installation of smoke detectors in all new house construction:
NOW THEREFORE:
Section 1. BE IT ordained that all multi-family structures,
including but not limited to apl tments, duplexes, cooperative apartments,
condominiums, and any other type of residential structure containing more
than one living unit shall have a minimum of one smoke detector per floor
installed in each residential unit of said residential structure.
Section 2. It shall further be required that in all new house
construction of single family residences, that a minimum of one smoke
detector shall be installed on each floor of any single family residence
constructed after the date of the enactment of this ordinance.
Section 3. (a) All owners of multi-family structures defined in
Section 1. of this Ordinance shall comply with the terms of this Ordinance
within 180 days of the passage hereof.
(b) For purposes of disclosing compliance, each multi-
family structure owner shall fill out and return to the City Clerk of
the UNITED CITY OF THE VILLAGE OF YORKVILLE a questionnaire showing
compliance within 30 days of said questionnaire being mailed on or before
June 1 of each calendar year.
(c) In the event of the failure of any multi-family
structure owner to timely file said disclosure, the Director of Public
Works, the Zoning Offic% or the Building Inspector of the UNITED CITY
OF THE VILLAGE OF YORKVILLE shall have authority to inspect the premises
of said multi-family structure owner to determine compliance with this
Ordinance.
Section 4. In the event any multi-family structure owner is found
to be in violation of this Ordinance as to the installation of smoke
detectors, a fine of fifty ($50.00) dollars per violation shall be
assessed, or the then current maximum amount of fine which may be imposed
under Illinois Revised Statutes in such case made and provided for municipal
violations, whichever is greater.
