AN ORDINANCE ENACTING A CONDOMINIUM
CONVERSION ORDINANCE FOR THE
UNITED CITY OF THE VILLAGE OF YORKVILLE
BE IT ORDAINED BY THE CITY COUNCIL OF THE UNITED CITY OF THE VILLAGE
OF YORKVILLE, KENDALL COUNTY, ILLINOIS AS FOLLOWS:
SECTION 1. That the United City of the Village of Yorkville in the
interest of protection of those persons occupying residential rental units,
and affording them the same rights and privileges that are set forth in the
Statutes enacted by the State of Illinois hereby ratifies and enacts as an
Ordinance of the United City of the Village of Yorkville, An Act concerning
the ownersip in and rights and responsibilities of parties under the condominium
form of ownership of real property enacted by the State Legislature under the
"CONDOMINIUM PROPERTY ACT" on June 20, 1963, and all amendments thereto.
SECTION 2. It is further enacted by the City Council and Mayor of
the United City of the Village of Yorkville that any owner of residential real
estate rental units desiring to effect a conversion of any residential real estate
rental units to a condominium form of ownership, shall in addition to the
requirements under Section 330 of Illinois Revised Statutes of the "CONDOMINIUM
PROPERTY ACT" in regard to minimum notice to existing tenants provide a written
consent form to each then existing tenant at the time written notice of an intent
to convert to a condominium form of property ownership is given providing that
each tenant may approve or object to said conversion. No conversion will take
place for a period of at least twelve months unless said real estate owner
secures consent of 800 or more of the then current tenants in the residential
real estate rental units sought to be converted to a condominium form of
ownership. All other notice provisions of Section 330 of the Illinois
Condominium Act shall remain in full force and effect.

SECTION 3. For purposes of definition herein, any apartment, duplex,
cooperative apartment or any other form of a dwelling or structure used for
residential living purposes by the persons occupying the same shall be
considered a residential rental living unit.
SECTION 4. This Ordinance of the UNITED CITY OF THE VILLAGE OF
YORKVILLE shall become effective immediately upon passage by the City
Council and signature by the Mayor of said municipality.
SECTION 5. Any attempted conversion of residential rental units to a
condominium form of property ownership without the requisite 80% written
approval by the then existing tenants upon the date notice of intent to convert
to a condominium form of ownership is given under Section 330 of Illinois Revised
Statutes does hereby create a right in any tenant of said residential rental
unit or in the alternative in the UNITED CITY OF THE VILLAGE OF YORVILLE to
seek and obtain an injunction from a court of competent jurisdiction to prevent
the conversion to a condominium form of ownership for said one year period.
SECTION 6. Written consents from at least 80% of the then existing
tenants of any residential rental units shall be filed with the City Clerk
of THE UNITED CITY OF THE VILLAGE OF YORK/ILLE before any condominium unit
may be sold after a conversion to show compliance with this Act.
SECTION 7. Prior to completion of conversion to a condominium form of
ownership, the subject residential rental units shall be inspected by the Director
of Public Works or any authorized City Building or Zoning Inspector. No final
conversion to a condominium form of ownership shall be permitted unless the
owner of said real estate shows the building to be in compliance with all cur-
rent BOCA building codes in effect, fire codes and current ordinances of
THE UNITED CITY OF THE VILLAGE OF YORKVILLE.
