Ordinance 1985-19 ` 1 ORDINANCE NUMBER 1985- AN ORDINANCE REGULATING THE INSTALLATION AND LOCATION OF CABLE TELEVISION SATELLITE ANTENNA DISHES BE IT ORDANINED BY THE CITY COUNCIL OF THE UNITED CITY OF TfT, VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS AS FOLLOWS: SECTION I PURPOSE AND INTENT It is the purpose of this Ordinance to provide for the orderly install- ation and location of cable antenna television satellite "dishes" to eli- minate potential hazards to pedestrians and motorists brought about by the location of said devices in an area which would interfere with a clear view for motorists, and to provide for the orderly location of said devices so as not to constitute a nuisance or depreciate the property values of surround- ing and adjacent landowners. SECTION II LOCATION No cable antenna television satellite "dish" shall be located in front of the building setback lines as established in any residential, business, or manufacturing zoning district of the United City of the Village of York- ville. Further no said device shall be located at any time in the front- yard of any zoning district, or beyond the edge of any side building line of an existing residential, business or manufacturing structure when such is located on a corner lot. SECTION III SETBACK REQUIREMENTS Any cable antenna television satellite "dish" shall be located with a setback of at least ten (10) feet from any rearyard line and a setback of at least ten (10) feet from any side yard line. SECTION IV ROOF-MOUNT OF CABLE ANTENNA TELEVISION SATELLITE "DISH" It shall be permissable for any owner of residential, manufacturing or business zoned real estate within the United City of the Village of Yorkville to provide for a roof-mounted cable antenna television satel- lite "dish". Said installation shall be undertaken only after securing a building permit from the United City of the Village of Yorkville and compliance with any BOCA Building Code promulgated and adopted by the United City of the Village of Yorkville concerning the roof-mounting of said devices. SECTION V ABATEMENT OF NON-CONFORMING SATELLITE ANTENNA "DISHES" The zoning officer of the United City of the Village of Yorkville shall have full authority to issue notices to any owner of a residential lot in the United City of the Village of Yorkville who installs a cable antenna television satellite "dish" in violation of this ordinance; and he shall further be fully authorized to institute legal proceedings to obtain an injunction for removal or compliance with the terms of this or- dinance of said "dish". A violation of this ordinance shall subject any homeowner to the penalties provided for any zoning ordinance under the Building and Zoning Ordinances of the United City of the Village of York- ville. SECTION VI VARIANCES The Zoning Board of Appeals shall have authority to recommend either the approval or the denial of any variance from this ordinance by any home- owner in a residential, business or manufacturing zoning district where it would be impossible to provide for reception from a cable antenna tele- vision satellite "dish" on any zoning lot where the existing structures would prevent a sight-line permitting reception due to no fault of the then existing owner of said building lot. The City Council of the United City of the Village of Yorkville shall then vote to recommend or deny said variance based upon the findings made by the Zoning Board of Appeals to the City Council. -2- SECTION VII PORTABLE SATELLITE ANTENNA DISHES No portable cable television or microwave satellite antenna television "dishes" shall be permitted to be parked in an area zoned for residential use of the City. Portable cable television or microwave antenna "dishes" shall be per- mitted to be used in a business manufacturing zoned area of the City for a period not in excess of one (1) week when used for special event purposes or telenetworking associated with the operation of any such business or manufacturing establishment. Any business or manufacturing establishement shall notify the City Zoning officer of said intended use, specifying the times and dates thereof. No user shall be permitted to locate a portable dish on its premises as provided hereunder for more than two (2) one (1) week periods within any calendar year. Portable cable television or microwave antenna "dishes" shall be per- mitted to be placed on land zoned for residential purposes within the United City of the Village of Yorkville for a period not in excess of three (3) days, nor on more than one occasion within any calendar year for the pur- pose of allowing an owner of residential real estate to receive a demonstra- tion or test use of said dish.
