AN ORDINANCE ENACTING THE FOOD SERVICE AND SANITATION ORDINANCE
ADOPTED BY THE COUNTY OF KENDALL ON AUGUST 8,1978 ANT! AN AN1END-
MENT TO RETAIL FOOD STORE SANITATION ORDINANCE ADOPTED BY THE
COUNTY OF KENDALL ON MARCH 13, 1979 AS AN ORDINANCE OF TI-TE
UNITED CITY OF THE VILLAGE OF YORKVILLE
BE IT ORDAINED BY THE CITY COUNCIL OF THE UNITED CI'T'Y OF THE VILLAGE
OF YORKVILLE, KENDALL COUNTY, ILLINOIS AS FOLLOWS:
1. That the United City of the Village of Yorkville hereby ratifies and
enacts as an Ordinance of the City of Yorkville the Food Service and Sani-
tation Ordinance of August 8, 1978 adopted by the County of Kendall, and
an amendment to Retail Food Store Sanitation Ordinance -enacted by the
County of Kendall on March 13, 1979 as though they were set forth in full
as an Ordinance of the United City of the Village of Yorkville.
2. That in addition to said enactments of the Kendall County Ordinances,
as Ordinances of the United City of the Village of Yorkville, the .following
further provisions are hereby added thereto:
a. That in the event any restaurant, food store, or other food
service vender that is listed and defined ur4er the terms of
said Ordinance scores below Seventy Pg TM-) on three (3)
consecutive inspections by the Kendall County Health Officer,
said food store or food service shall be given a written notice
advising said food store or retail food store the suspension of
their authority to do business for a period of three (3) days,
or until a successful inspection above the level of seventy
(70) is performed by the Kendall County Health Officer.
In the event a written notice is sent by the Health and Sani-
tation Committee of the United City of the Village of Yorkville
advising any food store or retail food store of said violation
as defined in the act, then and in that event said food store
operator shall have forty-eight (48) hours to give written no-
tice to the Health and Sanitation Committee at the main office

of the United City- of the Village of Yorkville that a hearing
is desired prior to said three (3) day suspension being im-
posed.
In the event a hearing is held contesting the three (3) day
suspension, a hearing time shall be established no less than
ten (10) working days beyond the date said written notice was
sent or mailed b)• the Health and Sanitation Committee of the
United City of the Village of Yorkville.
That for purposes of sending said notice of suspension, the
Public Works Director is hereby designated as an authorized
person to sign said written notice; after having received a
request to do so from two thirds (2/3rds) of the Health and
Sanitation Committee of the United Cite of the Village of
Yorkville, or in the event that any member of said committee
is absent and unable to be contacted, the Mayor of the United
City of the Village of Yorkville shall vote in place instead
of any absent member of the Health and Sanitation Committee.
b. That the Food Service and Sanitation Ordinance enacted by the
United City of the Village of Yorkville on August 23, 1984 shall
provide that an immediate suspension of business may only take
place under Section II Paragraph (b) if the Kendall County
Health Officer declares it to be an absolute emergency and
public health hazard to continue operating any food store or
retail food store without said suspension.
