Ordinance 1981-012 FHD: FK 1• ORDINANCE NO. AN ORDINANCE OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE PROHIBITING EXTENSIONS OF DRIVEWAYS INTO STREETS WITH THE HAD CITY OF THE VILLAGE OF YORKVILLE UNITED (LZfc) WHEREAS, the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE has investigated and considered the practice of extension of driveways beyond the curb lines into the streets of the City, and WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE has concluded that the extension of driveways beyong the curb lines into the streets of the United City of the Village of Yorkville, either through bituminous matter or concrete , or other materials, hinders or obstructs the free flow of storm waters within the gutters and, further, interferes with snow removal operations within the streets of the UNITED CITY OF THE VILLAGE OF YORKVILLE, and WHEREAS , it is necessary for the continued maintenance of the streets of the UNITED CITY OF THE VILLAGE OF YORKVILLE and for the effective removal of storm water from the streets and otherwise within the City and , therefore, the public safety, necessity and convenience require that such extensions of driveways into and withinthe streets be discontinued and prohibited. NOW, THEREFORE, BE IT ORDAINED by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE, Kendall County, Illinois, as follows: SECTION I PROHIBITION OF EXTENSION OF DRIVEWAYS BEYOND CURB LINES INTO STREETS It shall be unlawful for any person to place any materials, whether bituminous materials, concrete materials, or other materials, within the streets of the UNITED CITY OF THE VILLAGE OF YORKVILLE, as an extension of any driveway. All driveways and all materials used in construction of driveways shall terminate at the curb line or edge of the street, in the event that no curbs exist along such streets within the UNITED CITY OF THE VILLAGE OF YORKVILLE. SECTION II PHASEOUT OF ALL EXISTING DRIVEWAY EXTENSIONS No person shall repair or restore any damaged or deteriorating driveway extension, insofar as the same encroach upon the street in violation of Section I herein. SECTION III PENALTY Any person or corporation, violating or failing to -2- /9.'/-1a comply with the provisions of this Ordinance, shall be guilty of a Class A Misdemeanor. SECTION IV EFFECTIVE DATE This Ordinance shall take effect and shall be in full force and effect from and after its passage, approval and publica- tion, as provided by law.
