Y- 1977 AN ORDINANCE ANNEXING TERRITORY TO THE UNITED CITY + ~ OF THE VILLAGE OF YORKVILLE PURSUANT TO AN ANNEXATION AGREEMENT ENTERED INTO WITH JAMES STARK H WHEREAS, a petition for annexation has heretofore been filed with the City Clerk of the United City of the Village of Yorkville, Kendall County, Illinois, by James Stark �. as record owner of the territory described in Exhibit "A" attached to this Ordinance hereto and made a part hereof; and WHEREAS, a portion of said territory, consisting of approximately 37.9 acres (37.9) is North of and contiguous to the city limits of the United City of the Village of Yorkville, Kendall County, Illinois, and not within the corporate limits of any municipality, all of which territory includes adjacent highways to the far side thereof, specifically, including portions of Illinois Route 47, U.S . Route 34, and McHugh Road; and WHEREAS, James W. Stark is the record owner of said land and no electors reside within the territory described in Exhibit "A" with the exception of Ray Bunch and Sandy Bunch, Mary Shostak Frye, and Donald Frye, who, together with James W. Stark, have heretofore signed, under oath, the petition originally filed herein; and WHEREAS, the United City of the Village of Yorkville has heretofore entered into an annexation agreement with James Stark, as record owner of the territory described upon Exhibit "A" to re- classify the property described upon Exhibit "A" upon annexation of GOLDSMITH, THELIN, SCHILLER & DICKSON ATTORNEYS AT LAW MERCHANTS NATIONAL BANK BLDG. BOX 1485 AREA CODE 312-858.3300 • `c the territory, said Annexation Agreement being dated the 26th day of October, 1978, said territory to be zoned as B-1--Limited Business District, B-2--General Business District, and B-3-- Service Business District, in accordance with the Zoning Ordinances of the United City of the Village of Yorkville, said zoning classifications for the territories being more particularly described and identified upon Exhibit "B" attached hereto and made a part hereof; and WHEREAS, due notice of the Petition for Annexation has been served upon all appropriate authorities including the Bristol- Kendall Fire Protection District by and through its Trustees, the Bristol Township Road Commissioner, Floyd Woods, and the Board of Auditors for Bristol Township, including James Kenton, Supervisor, and Jacqueline Mann, Town Clerk, and the Yorkville Public Library District by and through the Library Board, as more particularly appears from the Notice of Annexation, certified and attested to by the City Clerk of the United City of the Village of Yorkville; and WHEREAS, an accurate map of the territory to be annexed is attached hereto as Exhibit "C" said annexation map showing the annexations to the far side of all adjacent roads including Routes 47, 34, and McHugh Road; and WHEREAS, it appears that the annexation petition heretofore filed herein, as ammended, is in all respects in compliance with Section 7-1-8 and Section 7-1-1 of the Illinois Municipal Code, being Chapter 24 of the Illinois Revised Statutes, 1977. NOW THEREFORE BE IT ORDAINED, by the City Council of the United City of the Village of Yorkville, Kendall County, Illinois, GOLDSMITH, THELIN, SCHILLER & DICKSON ATTORNEYS AT LAW —'l MERCHANTS NATIONAL BANK BLDG. That the real estate described in Exhibit "A" attached hereto and made a part hereof is hereby annexed to the United City of the Village of Yorkville, Kendall County, Illinois. SECTION 2. That the city limits of the city be and they are hereby extended to include the territory hereby annexed to the city in accordance with the map of said property attached hereto and marked Exhibit "C" , and extending to the far side of all adjacent roads, including specifically Illinois Route 47, U. S . Route 34, and McHugh Road. SECTION 3. That the territory described upon Exhibit "A" shall be and is hereby assigned Zoning Classifications of B-1-- Limited Business District, B-2--General Business District, and B-3--Service Business District in accordance with the general classification and definition of such zoning districts as defined by the Zoning Ordinance of the United City of the Village of Yorkville, said zoning classification being assigned to the properties described upon Exhibit "B" attached hereto and by reference made a part hereof. SECTION 4. That all ordinances or portions of ordinances in conflict herewith be, and they are hereby repealed insofar as they are inconsistent herewith. SECTION 5. That upon the filing with, and presentation to, the City of a Petition for Annexation to the City, the City shall adopt an Ordinance Annexing to the City so mach of the property described in Exhibit "A" as is not now within the corporate limits of the City; and that the City shall, in said Ordinance, zone the entire parcel of real estate described in Exhibit "A", subject to the further terms of this Agreement, into three (3) business districts appropriately zoned to B-11 B-2 and B-3, as indicated on the diagram attached hereto as Exhibit "B", and made a part hereof, and that said real estate be allowed the use, size, density, areas, coverage, maximum building height as set forth on Exhibit "C" which is attached hereto and made a part hereof. 2. That in connection with the development of the land hereinabove described, the Owners shall comply with the provisions of the Subdivision Control Ordinance and of all other ordinances of the City in effect from the time of this Agreement and it is further agreed that all ordinances relating to subdivision control, zoning, official plan and building, housing and related restrictions which would affect that portion of the property described herein be continued in effect for a term of ten (10) years from and after the date of this Annexation Agreement. 3. That the Owners have requested that the City grant to said Owners, a variance of the provisions of Section 7.03 of the Subdivision Control Ordinance, allowing Owners to install 40-foot streets and 75-foot right of ways, said request having been granted by the City. It is further agreed, that as a condition to the granting of the variance described herein, the City shall authorize and invoke an Ordinance prohibiting on-street parking within so much of the property described in Exhibit "A". 4. That the Owners shall execute covenants running with the land, to the municipality as well as to individual landowners prohibiting the installation for the construction of entrance- ways or driveways other than those which appear on diagram which has been attached hereto as Exhibit "B". That the Owners agree that the presently existing wooded "green" area which runs in an easterly and westerly direction along Walnut Street shall not be removed from Walnut Street and the Owners property. That the Owners agree to install, extend and lay, at their initial expense, from the closest existing end of a water main as presently consituted to the property described in Exhibit "A:, the same being one (1) water main at least 8" in diameter, or such larger size as may be approved by the engineers, and it is further aqreed that all hook-up charges or tap-on fees collected by the City within three (3) years of the date of approval of the final plat of the proposed development collected for connections made in the property described in Exhibit "A" shall be remitted to James Stark and Patricia Stark as a reimbursement for their expense in extending the water mains to the property described herein, together with interest thereon at the rate of 8% per annum. The sums so collected shall be remitted to the Owners within thirty (30) days of collection, any hook-up charges collected by the City in excess of the cost of constructing water mains to the property described herein, together with interest at the rate of 8% per annum as aforesaid on theAnitial cost thereof shall be retained by the City regardless of when the same is collected. The City shall not be obligated to Owners for any costs of construction or laying of water mains to the property described herein, together with interest thereon at the rate of 8% per annum, not collected by the City within three (3) years from the date of the approval of the final plat of the proposed development as aforesaid. b. That the Owners shall install, extend and lay at their initial expense, sewer lines from the closest end of a sewer line as presently constituted in said City to the property described in Exhibit "A" attached hereto, and shall install, if necessary, a lift station along said sewer line; that all hook-up charges or tap-on fees collected by the City within three (3) years from the date of the final plat collected for connections within the property described in Exhibit "A" shall be remitted to James Stark and Patricia Stark as a reimbursement for their expense of extending sewer lines to the property described herein, together with interest thereon at the rate of 8% per annum. The sums so collected shall be remitted to Owners within thirty (30) days of collection . Any hook-up charges collected in excess of the cost of construction of the sewer lines to the property described herein, together with interest thereon at the rate of 89/6 per annum as aforesaid on the initial cost thereof, shall be retained by the City regardless of when the same is collected. The City shall not be obligated to the Owners for any cost of construction or laying of sewer lines to the property K : PG. - 4 - described herein, together with interest thereon at the rate of 8% per annum, not collected by the City within three (3) years from the date of approval of the final plat of the proposed sub- division aforesaid. The reimbursement of hook-up charges and tap-on fees herein referred to shall apply only to those hook-up charges or tap- on fees imposed and collected by the City and shall not deem to include any hook-up charges or tap-on fees or other charges imposed or collected by the Yorkville-Bristol Sanitary District. All of the aforesaid sewer installation, including the proposed lift station, shall be in accordance with specifications approved by the City engineer. 7. To the extent required by City Ordinance, of by the engineering studies, Owners agree to install any necessary water detension facility and suitable storm sewers to remove surface water from the proposed subdivision. S. The City hereby agrees to waive any and all futur a Impact Study Committee meetinqs pertaining to the property described herein and Owners agree to contribute the sum of $188.00 per lot as shown in Exhibit "B" in accordance with the recommended impact study contribution table, a copy of which is attached hereto as Exhibit "D" and made a part hereof. It is further agreed by and between the parties hereto that any land donated to the City6y Owners shall be appraised and that the amount of that appraisal shall be applied to, in lieu of, and constitute a reduction in the total obligation of the Owners for the Impact Study contribution as provided for herein. 9. It is understood that Owners' property which is being annexed to the City as a business development is not subject to a cash land grant ordinance. 10. That subsequent to the execution of this Agreement, and within six (6) months thereof, the Owners shall submit a Petition for Annexation to the City so that the property described herein can be annexed in accordance with the terms of this Agreement. 11 . That the Owners shall conform and be subject to all permit fees of the City which shall be in effect from time to time unless specifically stated to the contrary herein . - 12. That the Owners shall conform and be subject to the Subdivision Control Ordinance of the City at the time the property is platted unless specifically stated to the contrary herein . 13.
