Ordinance 1979-03 ORDINANCE NO. AN ORDINANCE RECLASSIFYING A PORTION OF BLOCK 5 AND LOT 4 IN BLOCK 2 OF COUNTRYSIDE CENTER, YORKVILLE, ILLINOIS, AND PERMITTING A VARIATION THEREON. WHEREAS, Jack Purcell , Virginia Purcell, Orville E. Madsen & Sons, Inc . have petitioned the United City of the Village of Yorkville to reclassify or rezone property from business use to R-4 , general residence district, and to vary the strict application of the terms of the City' s Zoning Ordinance to require not more than one parking space per dwelling unit upon the following described tract of land, to-wit: That part of Block 5 , Countryside Center, Unit #2 , Yorkville, Kendall County, Illinois, lying Southeasterly of a line drawn parallel with and 87 feet normally distant Northwesterly of the Southeasterly line of said Block 5 , situated in the United City of the Village of Yorkville, Kendall County, Illinois; and That part of Lot 4 , Block 2 , Countryside Center, Unit #4 , Yorkville, Kendall County, Illinois, lying Northwesterly of a line drawn perpendicular to the Western most Northeasterly line of said Lot 4 , from a point on said Northerly line which is 292 . 76 feet Southeasterly of the Northern most Northwest corner of said Lot 4 , in the City of Yorkville, Kendall County, Illinois . WHEREAS, the petition for rezoning or reclassifica- tion of property and the variation as aforesaid, has been con- sidered by the Planning Commission and the Zoning Board of Appeals, after due notice, publication and public hearing, and WHEREAS, both the Planning Commission and the Zoning Board of Appeals have favorably recommended and approved rezoning GOLDSMITH, THELIN, SCHILLER & DICKSON ATTORNEYS AT LAW MERCHANTS NATIONAL BANK BLDG. BOX 1485 AREA CODE 312-859.3300 and reclassification of the property to an R-4 general residence district classification and reduction in the required parking to one car space per dwelling unit, as and for senior citizens housing, and that the public interest is best served by granting the rezoning and variance from the strict application of the Zoning Ordinance as aforesaid. NOW, THEREFORE, be it ordained by the City Council of the United City of the Village of Yorkville, that the following described property be rezoned and reclassified R-4 general residence district as defined by the Zoning Ordinance of the United City of the Village of Yorkville as enacted March 28 , 1974 and subsequently amended from time to time, to-wit: That part of Block 5 , Countryside Center, Unit 12 , Yorkville, Kendall County, Illinois, lying Southeasterly of a line drawn parallel with and 87 feet normally distant Northwesterly of the Southeasterly line of said Block 5, situated in the United City of the Village of Yorkville, Kendall County, Illinois; and That part of Lot 4 , Block 2 , Countryside Center, Unit #4 , Yorkville, Kendall County, Illinois, lying Northwesterly of a line drawn perpendicular to the Western most Northeasterly line of said Lot 4 , from a point on said Northerly line which is 292 . 76 feet Southeasterly of the Northern most Northwest corner of said Lot 4 , in the City of Yorkville, Kendall County, Illinois. BE IT FURTHER ORDAINED, by the City Council of the United City of the Village of Yorkville that variation of the strict application of the R-4 general residence district park- ing requirements be, and the same is granted to the foregoing property to require not more than one parking stall per dwelling unit constructed upon the foregoing property.
