Ordinance 1977-03 FHD:GKH ORDINANCE NO. AN ORDINANCE OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS TO ESTABLISH A PARK COMMISSION AS AN ADVISORY BOARD TO THE CITY COUNCIL THEREOF WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE has considered the advisability of establishing a Park Commission as an advisory board to organize, promote and to help supervise and regulate park programs; and WHEREAS, the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE has considered the establishment of such a Park Commission to be in the best interests of the said City and of the residents thereof. NOW THEREFORE, BE IT ORDAINED by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE as follows : SECTION l : Creation. There is hereby created a Park Commission, consisting of five members appointed by the Mayor with the consent of the City Council for a three-year term. -2- The Mayor and Aldermen serving as Trees and Parks Committee Chairmen shall be ex officio members of the Park Commission. Not more than one voting member of the Park Commission created hereby shall be a member of the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE. The initial term of members of the Park Commission so appointed shall be as follows : 1 member, 1 year 2 members, 2 years 2 members, 3 years Thereafter, all appointments to the Park Commission shall be for a three-year term. SECTION 2 : Organization. The Mayor, with the advice and consent of the City Council, shall select one of the Commission' s number to act as Chairman and one to act as Secretary. The Commission shall keep a correct record of its proceedings and shall meet at such times as it may determine. All meetings of the Park Commission shall be open to the public, excepting only those meetings concerning litigation involving the City and those dealing with personnel policies, problems and wages. SECTION 3 : Duties. The Park Commission shall investigate, hear and advise the City Council on all matters relating to the control and use of all public parks and any other lands or lots heretofore or hereafter devised -3- and bequeathed to the City for recreational or park purposes; it shall advise the City Council concerning the ornamentation and the laying out and improving of the grounds of the parks , and for that purpose, may recommend the employment of such workmen and shall recommend to the City Council such purchases or contracts for materials as the Commission may deem necessary, provided that in no case shall the Commission enter into a contract and in no case shall incur liability for and on behalf of the City. The Commission shall further, as a permanent standing committee of the UNITED CITY OF THE VILLAGE OF YORKVILLE, investigate the advisability and needs, as well as the suitability of sites for park purposes, shall recommend to the City Council, and shall promote and provide advisory opinions concerning the organization and promotion of adult and children' s recreational programs in the City. It shall also hear reports from all personnel and shall report periodically concerning the activities of employees to the City Council, and shall investigate the advisability and need for expen- ditures for and on behalf of existing parks generally within the City to the City Council . SECTION 4 : Recreation Director. The Commission may advertise and interview for employment of a part-time Recreation Director and such other park personnel as the Commission deems advisable, and shall define the duties of the Recreation Director and Park employees . The Park Commission shall not hire the Recreation Director or any other Park employees , j, -4- but shall make recommendations concerning employment of such personnel to the City Council, which shall set the salary of such personnel as the City Council may hire . The Recreation Director shall be appointed by the Mayor with the advice and consent of the City Council . SECTION 5 : Receipts, Donations and Disposition. All receipts on account of the City Parks, whether arising from rentals, donations, sales of any part thereof, or of any lands so willed and devised by any person to the City, shall be exclusively expended and applied under the direction and control of the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE with the advice and recommendations of the Park Commission. SECTION 6 : Compensation. The Commission and its members shall not be compensated for their services.
