Ordinance 1977-06 FHD:GKH ORDINANCE NO. AN ORDINANCE OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS, LICENSING SPECIAL SALES OF GOODS FOR INSURANCE, SALVAGE, CLOSING OUT, AND GOING OUT OF BUSINESS, AND OTHER PURPOSES WHEREAS, the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE has considered the frequency and the representations concerning special sales of merchants within the said City; and WHEREAS, the City Council considers it in the best interests of the public that licensing be required. NOW THEREFORE, BE IT ORDAINED by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE: SECTION l: LICENSE REQUIRED. No person shall advertise, represent or hold out that any sale of goods, wares or merchandise is an insurance, salvage, removal, closing out, going out of business, liquidation or creditors ' sale, or a sale of goods, wares or merchandise damaged by fire, smoke, water or otherwise damaged, unless he shall have first obtained a license to conduct such a sale, under one of such descriptive names, from the City Clerk. SECTION 2 : APPLICATION FOR LICENSE. A person desiring a license required by this Ilk -2- Ordinance shall make an application to the City Clerk in writing and under oath, setting forth an inventory of the goods, wares or merchandise to be sold, why such goods, wares or merchandise are to be sold under such name, why, and in what manner, such name is truthfully descriptive of such sale, whether such sale is for the purpose of removal, in the case of a sale to be called a removal sale, or whether such sale is for the purpose of closing out the applicant' s business, or for the purpose of going out of business, in case of a sale to be called a closing out or going out of business sale, or where, and under what circumstances, and how, the goods, wares or merchandise, if to be sold as damaged, were so damaged, the place and manner of conducting such sale and by what persons such sale is to be conducted, from whom the goods, wares or merchandise to be sold were procured by the applicant, the date of so procuring them and of the delivery thereof to the applicant, and the proposed period of time during which the sale will be conducted, not to exceed a period of sixty (60) days. SECTION 3: ISSUANCE OF LICENSE; FEE; DURATION; EXTENSIONS. Upon compliance with the provisions of this Ordinance, the City Clerk shall issue a license to the person so applying therefor, on his paying to the Clerk a fee of Twenty-Five ($25 . 00) Dollars, authorizing such applicant so to advertise, represent or sell such goods, wares or merchandise under this Ordinance during a period -3- of sixty (60) days; provided, however, if the licensee furnishes an affidavit to the effect that all goods listed in the original inventory have not been disposed of, and that no stock has been added, an extension of thirty (30) days may be granted upon the payment of an additional license fee of Twenty-Five ($25. 00) Dollars. • SECTION 4 : RECORDS TO BE KEPT BY CLERK. The City Clerk shall endorse upon each application filed under this Ordinance the date of its filing, and shall preserve it as a public record of his office, and shall make a notation of it in a book to be kept for that purpose, properly indexed, showing the name of the applicant, the date of application, the descriptive name of the proposed sale, the place where such sale is to be conducted, its duration, the date of the license issued thereon, and the value of the stock of goods, wares and merchandise thus to be sold. SECTION 5: Any person violating any provision of this Ordinance shall be guilty of a Class "C" Misdemeanor. This Ordinance shall be in full force and effect from and after its passage and publication as provided by law. PASSED this % day of -4- A.D. 1977.
