Ordinance 1977-10 FHD:GKH L 9/14/77 - ORDINANCE NO. /Gl - /? �7 J AN ORDINANCE OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE , KENDALL COUNTY, ILLINOIS TO ESTABLISH A COMMUNITY CENTER COMMITTEE AS AN ADVISORY COMMITTEE TO THE CITY COUNCIL THEREOF WHEREAS , the Mayor and City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE are aware of the need for and the desire by the citizens of the community to establish a Community Center ; and WHEREAS , the Mayor and City Council recognize the need of responsible leadership in the planning and development of a Community Center ; and WHEREAS , the late Clarence Beecher, in his Last Will and Testament , directed that the remainder of his estate be used for the purchase of land and construction of a building for use by the community as a Community Center building; and WHEREAS , this Community Center building shall be expressly for the purpose of social, literary and recreational use . NOW THEREFORE, BE IT ORDAINED by the Mayor and City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS , as follows : .4 Commission and the UNITED CITY OF THE VILLAGE OF YORKVILLE Park Commission, serving jointly as the City of Yorkville Community Center Committee. The terms of office of members of the Community Center Committee shall be coincidental with the terms of office of the members of the Human Resources Commission and the UNITED CITY OF THE VILLAGE OF YORKVILLE Park Commission. Membership in the UNITED CITY OF THE VILLAGE OF YORKVILLE Community Center Committee shall be automatic and coterminous with the tenure of each member of the Human Resources Commission and the UNITED CITY OF THE VILLAGE OF YORKVILLE Park Commission. The Chairman of the UNITED CITY OF THE VILLAGE OF YORKVILLE Community Center Committee shall be appointed by the Mayor with the advice and consent of the City Council. The Chairman of the UNITED CITY OF THE VILLAGE OF YORKVILLE Community Center Committee shall vote only in the event of a tie vote within said Committee. The Aldermen acting as liaison and representatives to the Park Commission and to the Human Resources Commission from the City Council and the Mayor shall be ex-officio members of the UNITED CITY OF THE VILLAGE OF YORKVILLE Community Center Committee. SECTION 2 : Duties. The UNITED CITY OF THE VILLAGE OF YORKVILLE Community Center Committee shall investigate, hear and advise the ('i +-K7 ('f-%I I-n i 1 -r. I 1 1 --4-4---- v-..1 -CJ-.., - i i i..- --—-- -- i- --- -r City Council concerning the maintenance and improvement of said building, its present and future usage, promotion of community usage for the greatest and broadest possible use by the community in general, and for that purpose, they shall recommend the employment of such director or personnel and shall recommend to the City Council such purchases or contracts for materials and services as the Committee may deem necessary, provided that in no case shall the Committee enter into a contract and in no case shall the Committee incur liability for and on behalf of the City. The Committee shall also hear reports from all personnel and shall report periodically concerning the activities of the employees to the City Council, and shall investigate the advisability and need for expenditures for and on behalf of existing and proposed functions, and shall further advise the City Council with respect to charges for any proposed usage of the building and make recommendations therefor. The UNITED CITY OF THE VILLAGE OF YORKVILLE Community Center Committee shall be authorized to expend no municipal or public funds other than those appropriated and approved by the Mayor and City Council . The Community Center Committee shall be furnished with a secretary by the corporate authorities of the UNITED CITY OF THE VILLAGE OF YORKVILLE, whose duties shall be to keep minutes of all meetings, to document and record accurately and to keep in good order all records of the and recommendations to said Council as often as directed by said Council . The UNITED CITY OF THE VILLAGE OF YORKVILLE Community Center Committee shall further cooperate with The Merchants National Bank of Aurora, as Trustee of the late Clarence Beecher Testamentary Trust, and shall recommend to the City Council sites for the construction of such building or buildings as may be appropriate under the provisions of the late Clarence Beecher Testamentary Trust. The said Committee is further directed to solicit and enlist the volunteer services of such organizations and citizens of the community who will assist in achieving the goal of the Community Center, which will serve the entire community and enhance the quality of life of all citizens thereof. SECTION 3: Receipts, Donations and Dispositions. All receipts on account of the Community Center, whether arising from rentals, donations or sales of lands devised to the City, shall be exclusively expended and applied under the direction and control of the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE, with the advice and recommendations of the Community Center Committee. SECTION 4 : Compensation. The Committee and its members shall not be compensated for their services. from and after its passage and approval according to law.
