Ordinance 1976-33 FHD:GKH - 1 ORDINANCE NO. AN ORDINANCE PROHIBITING THE PLACING OR THROWING OF TRASH ON PUBLIC STREETS , ALLEYS, CITY PROPERTY AND PARKS OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS WHEREAS, the corporate authorities of the UNITED CITY OF THE VILLAGE OF YORKVILLE have the duty of maintaining streets and alleys, City property and public parks and, further, have the duty of maintaining and protecting the public health; and WHEREAS, it has been determined by the corporate authorities of the UNITED CITY OF THE VILLAGE OF YORKVILLE that the throwing or placing of trash upon public streets, alleys, City property and parks is obnoxious to the public health and increases the cost of maintenance therefor. NOW THEREFORE, BE IT ORDAINED by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE: SECTION l: It shall be unlawful for any person to throw or place any trash on any public street, alley, City property or City park at any time. -2- and conspicuously stating the penalty provided for herein. SECTION 3: Anyone found guilty of violating SECTION 1 hereof shall be guilty of a misdemeanor, punishable by a fine of not less than $50 . 00 nor more than $500 . 00 . SECTION 4 : The provisions of this Ordinance are hereby declared to be severable, and if any of its sections, provisions, sentences, phrases or parts shall be held unconstitutional or void, the remainder of this Ordinance shall continue in full force and effect, it being the legislative intent that this Ordinance would have been passed even if such unconstitutional or void matter had not been included herein. SECTION 5 : This Ordinance shall be in full force and effect from and after its passage and publication according to law. PASSED this day of r- u 1976 .
