AN ORDINANCE TO PROVIDE FOR A VARIATION IN
PARKING REQUIREMENTS FOR A PORTION OF BLOCK 5,
UNIT 2 , COUNTRYSIDE CENTER, YORKVILLE, ILLINOIS
WHEREAS, after due publication and notice and
hearing by the Yorkville Zoning Board of Appeals of a
Petition to reduce the parking requirements from two cars
per multi-family unit to one within Block 5, Unit 2 of
Countryside Center, Yorkville, Illinois by Madsen Construction
Company and Jack and Virginia Purcell, and the City Council
having duly considered the said application; and
WHEREAS, it appearing that the application for
variance in parking requirements was made for the express
purpose upon findings of fact by the Yorkville Zoning
Board of Appeals, and it further appearing that the intended
usage of the foregoing property is for Senior Citizen housing
and that the needs of the elderly within the property to
be used for Senior Citizens would not require more than
one parking space per unit; and
WHEREAS, it appears that all of Block 5 , Unit 2
of Countryside Center, Yorkville, Illinois, excluding therefrom
the southerly 80 feet as measured along Kendall Drive,
will be used for Senior Citizen housing.

NOW THEREFORE, BE IT ORDAINED by the City Council
of the UNITED CITY OF THE VILLAGE OF YORKVILLE that a variation
be and the same is hereby granted reducing the parking
requirement from two cars per housing unit to one car per
housing unit for the following described property:
Block 5, Unit 2 , Countryside Center, Yorkville,
Illinois, excluding therefrom the southerly 80
feet as measured along Kendall Drive.
BE IT FURTHER ORDAINED by the City Council of the
UNITED CITY OF THE VILLAGE OF YORKVILLE that the variation
shall be and hereby is declared to be effective only for
and in the event of the construction of a multi-family
housing unit used exclusively by elderly citizens, defined
as persons over the age of 60, and for no other purpose
whatsoever.
This Ordinance shall be in full force and effect
from the after its passage and publication as provided by
law.
The effective provisions of ordinances passed
heretofore and not inconsistent with the provisions of
this Ordinance are hereby expressly ratified and all provisions
inconsistent herewith are expressly repealed.
