Ordinance 1976-40 FHD:GKH y '{rr } ORDINANCE NO AN ORDINAN(ZE' AMENDING AN ORDINANCE OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLIND,,.�,W DECLARING THE STORING OF JUNK, TRASH AND REFUSE, OR THE STORING AND PARKING OF INOPERATIVE �_ _ AUTOMO$iLES, MOTORCYCLES OR TRUCKS ON PRIVATE �._ PROPE<TY AND THE BURNING OF CERTAIN MATERIALS "° .... TO BE A NUISANCE WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE has heretofore, on the 12th day of March, 1970, passed an Ordinance described as "An Ordinance of the United City of the Village of Yorkville, Kendall County, Illinois , Declaring the Storing of Junk, Trash and Refuse, or the Storing and Parking of Inoperative Automobiles, Motorcycles or Trucks on Private Property and the Burning of Certain Materials to be a Nuisance" ; and WHEREAS, certain provisions regarding the burning of leaves were contained in said Ordinance, and it is no longer considered in the best interests of the community that leaves be burned in wire containers. NOW THEREFORE, BE IT ORDAINED by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE that Section 6 of An Ordinance of the United City of the Village of Yorkville, Kendall County, Illinois, Declaring the Storing of Junk, Trash and Refuse , or the Storing and Parking of Inoperative yc -/ �,)(, Automobiles, Motorcycles or Trucks on Private Property and the Burning of Certain Materials to be a Nuisance be and the same is hereby amended to read as follows: "Section 6 - That the open or outside burning of any materials, including plastic coated or treated paper or paper materials within the City Limits, is expressly prohibited, except that in residential districts , during daylight hours only, the occasional burning of untreated paper and paper products and wood is permitted, provided the same is done in suitable wire containers so as to prevent the blowing of burning papers, other materials or sparks. Seasonal burning of dry leaves is permitted, so long as the same is conducted in such a manner so as not to constitute a hazard or nuisance to persons or property. The discharge into the outdoor atmosphere of fumes, smoke, gas or vapor or any combination from the burning of any materials other than untreated papers , wood and leaves as provided above shall be, for the purposes of this Ordinance, declared air pollution and a public nuisance. " That all other sections of said Ordinance are hereby reaffirmed and readopted. This Ordinance shall be in full force and effect from and after the date of its passage, approval and publication, as provided by law. PASSED this day of c -2- v � R 1976 .
