Ordinance 1976-43 FHD:GKH r ORDINANCE NO. - 19 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE UNITED CITY OF THE VILLAGE OF YORKVILLE, KENDALL COUNTY, ILLINOIS WHEREAS, the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE has heretofore, to-wit, on the 28th day of March, A.D. 1974, adopted a Zoning Ordinance; and WHEREAS, the UNITED CITY OF THE VILLAGE OF YORKVILLE, in cooperation with the County of Kendall and the Cities and Villages of Sandwich, Plano, Montgomery and Oswego, has heretofore studied the impact of development along a certain thoroughfare , to-wit, Route 34; and WHEREAS, it is considered in the best interests of the City that the Zoning Ordinance be amended to require the Plan Commission to consider the impact of such proposed reclassifications or amendments upon existing traffic and other accesses to and from Route 34 and Illinois State Route 47 . NOW THEREFORE, BE IT ORDAINED by the City Council of the UNITED CITY OF THE VILLAGE OF YORKVILLE that the Zoning Ordinance of the UNITED CITY OF THE VILLAGE OF YORKVILLE, heretofore passed and approved the 28th day of March, 1974, as subsequently amended, is hereby amended as follows : r r A -2- SECTION 13. 04 , PARAGRAPH E. "E. Findings of Fact and Recommendation of the Plan Commission. Within forty-five (45) days after the close of the hearing on a proposed amendment, the Plan Commission shall make written findings of fact and shall submit same, together with its recommendations to the Mayor and City Council. Where the purpose and effect of the proposed amendment is to change the zoning classification of particular property, the Plan Commission shall make findings based upon the evidence presented to it in each specific case with respect to the following matters: 1. Existing uses of property within the general area of the property in question. 2 . The zoning classification of property within the general area of the property in question. 3. The suitability of the property in question to the uses permitted under the existing zoning classification. 4 . The trend of development, if any, in the general area of the property in question, including changes, if any, which have taken place since the day the property in question was placed in its present zoning classification. 5 . The impact that such reclassification and/or annexation will have upon traffic and traffic conditions on said routes; the effect, if any, such reclassification and/or annexation would have upon existing accesses to said routes; and the impact of additional accesses as requested by the petitioner upon traffic and traffic conditions and flow on said routes. " This Ordinance shall be in full force and effect from and after its passage and publication as provided by law. PASSED this day of 1976 .
