AN ORDINANCE OF THE UNITED CITY OF THE
VILLAGE OF YORKVILLE, KENDALL COUNTY,
ILLINOIS REGULATING AND PROVIDING FOR
INSPECTION OF CERTAIN SEWER SYSTEMS
AND PROVIDING A STANDARD FOR ACCEPTANCE
THEREOF
BE IT ORDAINED by the UNITED CITY OF THE VILLAGE
OF YORKVILLE, Kendall County, Illinois as follows :
Section 1 : Definitions.
When used in this Ordinance:
"Sewage system" means and includes any or all of
the following: collecting, intercepting and outlet sewers ,
force mains, conduits , lateral sewers and extensions, pumping
stations , ejector stations, and all other appurtenances ,
extensions or improvements necessary or useful and convenient
for the collection and transportation, in a sanitary manner,
of sewage and industrial wastes , referred to collectively
as sanitary waste.
"City" means the City of Yorkville.
"Person or persons" means any individual , public
or private corporation, political subdivision, government
agency, public or private institution, industry, co-partnership,
association, firm, trust, estate or any other entity whatsoever.
"Municipal corporation" means a city, village or
incorporated town.
"Sewage system" or "drainage lines" means pipelines
or conduits , pumping stations, force mains and all other
constructions, devices and appliances appurtenant thereto
used for collecting or conducting sewage, industrial wastes
or other wastes.
Section 2 : Public Purpose.
The public purpose of this Ordinance is hereby
declared to be that the sewage system of the City will, in
its operation and expansion, better conduce to the public
health, comfort or convenience of the City if any sewer system
or drainage lines constructed within the jurisdiction of
the City are constructed in accordance with the standards
and specifications of the City, and if inspection by the City
of the construction of any such sewer systems or drainage
lines is made to ascertain that it does comply with the standards

and specifications of the City.
Section 3 : Connections--Inspections--Charge for
Inspection Service--Funds.
No person or municipal corporation, other than the
UNITED CITY OF THE VILLAGE OF YORKVILLE, shall connect drainage
lines to the sewage system of the City until and unless the
City has accepted the lines and appurtenances desired to be
connected. Prior to such acceptance , the City shall inspect
the lines and appurtenances by closed circuit television,
or such other means as the City shall deem appropriate, to
determine whether such lines and appurtenances comply with
the City specifications and whether they are adequate and
suitable for connection to the City sewage system.
After such initial inspection, the City shall require
such repairs, alterations, replacements and additions to
the lines and appurtenances as the City determines necessary
in order that the lines and appurtenances comply with the
City specifications and that they are adequate and suitable
for connection to the City sewage system. For purposes of
such inspection, the lines and appurtenances shall be considered
acceptable if infiltration of waters from ground sources ,
or sources other than said lines and appurtenances , does not
exceed the rate of 50 gallons per inch diameter of said line
or appurtenance per mile per day. In the event repairs,
alterations, replacements and additions are required and made,
the City may order such additional inspections as it determines
necessary and appropriate to assure the City that the lines
and appurtenances are acceptable as herein set forth. In
no event shall the lines be put in use until and unless they
have been approved and accepted by the City.
The inspection charge herein provided shall apply
only to the first or initial inspection above referred to.
In the event additional inspections are required by the City,

the applicant shall pay all such additional inspection charges
in full before the lines and appurtenances are accepted by
the City and before they are put in use.
All inspections referred to herein shall be made
under the sole jurisdiction and authority of the City of
Yorkville.
In addition to the other charges provided by the
City ordinances, rules and regulations, each person or municipal
corporation shall pay to the City the sum of fifty cents
(50G) for each lineal foot of drainage line desired to be
connected to the sewage system of the City. This charge,
to be known as an inspection charge, shall be paid to the
City at the time that application for connection to or additional
use of the City' s sewage system is submitted to the City
for approval. In the event such application is not approved,
the inspection charge shall be refunded in full.
Funds collected by the City as inspection charges
pursuant to the provisions of this Ordinance shall be used
by the City for its general corporate purposes after payment
of costs of making the inspections .
Section 4 : Fines and Penalties .
(A) Any person violating or failing to comply with
any of the terms or provisions of this Ordinance shall be
guilty of a misdemeanor, and on conviction thereof, shall
be subject to a fine of not less than $500. 00 nor more than
$1, 000. 00 .
(B) For each and every day that any person, party
or corporation shall violate or fail to comply with any of
the terms or provisions of this Ordinance, such person, party
or corporation shall be deemed guilty of a separate offense.
(C) The City Attorney for the UNITED CITY OF THE
VILLAGE OF YORKVILLE is hereby authorized and empowered to
institute and prosecute any and all proceedings, suits and

actions necessary to collect any and all fines and penalties
herein provided for, and is also hereby authorized and empowered
to institute and prosecute any and all suits at law or in
equity as may be appropriate or necessary to prevent unlawful
connections to the UNITED CITY OF THE VILLAGE OF YORKVILLE
sewage system in violation of the provisions of this Ordinance.
Section 5: Validity of Ordinance.
The invalidity of any section, sentence, clause
or provision of this Ordinance shall not affect the validity
of any other part or portion of this Ordinance which can be
given effect without such invalid part or portion, if any.
Section 6 : Violation Declared Public Nuisance.
Any violation of any of the terms and provisions
of this Ordinance is hereby declared by the UNITED CITY OF
THE VILLAGE OF YORKVILLE to be a public nuisance.
Section 7 : Inconsistent Provisions of Other Ordinances.
Any other ordinance, or section thereof, heretofore
adopted by the UNITED CITY OF THE VILLAGE OF YORKVILLE in
conflict with any of the provisions of any section herein
is hereby directly and impliedly repealed.
Section 8 : Ordinance in Force.
This Ordinance shall be in full force and effect
from and after its passage, approval, recording and publication
as provided by law.
