Ordinance 1974-67 AN ORDINANCE CONCERNING DOGS
BE IT ORDAINED by the City Council of the United City of
the Village of Yorkville , Kendall County, Illinois , that :
SECTION 1. License . Every person who harbors or keeps
a dog of over the age of three months in the City shall pay an
annual tax on such dog of $3 .00 if it be an unspayed female , and
$1 .00 if it be a male , or a spayed female , which tax shall be
paid in advance on or before the first day of January of each year.
The Clerk shall keep a record of all dog taxes paid and
shall furnish to each person paying such tax a metal tag, having
stamped thereon numbers indicating the year for which the tax is
paid. A duplicate to replace a lost or destroyed tag may be
issued by the Clerk upon the payment of twenty—five cents .
The tax required by this ordinance shall be paid to the
City Collector and shall be by him turned over to the Treasurer.
SECTION 2 . Tags . It shall be unlawful to permit any
dog to be on any public street , sidewalk, alley or other public
place unless such dog has a collar firmly attached around his neck,
with a license tax for the current year attached to such collar.
SECTION 3 . Running at Large . It shall be unlawful to
permit any dog to run at large within the City. Any dog found
upon any public street , sidewalk, alley or any unenclosed place ,
shall be deemed running at large unless dog is firmly held on a
leash, or is in an enclosed vehicle .
SECTION 4. Disturbances . Any dog, within t -ie corporate
limits of the City which shall be barking, biting, howling, whining,
or in any other manner disturbing the quiet of, or becoming a source
of annoyance to any person, or persons , whatsoever, is hereby de-
clared to be a nuisance ,�'and upon complaint being made to the City
Dog Warden, or his assistant or to the Police Department of the
City, the same being satisfied of the truth of the complaint shall
thereafter notify the owner or person having the possession of such
dog, or the owner or occupant of the premises on which such dog may
be kept , and the person so notified shall , within the twenty—four

hours next following the receipt of such notice abate such
nuisance .
SECTION 5 • Inoculation. It shall be unlawful to per-
mit any dog which is not on a leash, under control , or muzzled to
be in any public street , parkway, sidewalk, park, in any store or
place of public gathering or in any place in the City other than
in an enclosed area unless such dog has been inoculated against
rabies by a licensed veterinarian within the preceding year.
SECTION 6. Dog Bites . It shall be the duty of the owner
or person having custody of any dog which bites any human being to
keep such dog locked up in an enclosure for a period of two weeks
following the time the dog has bitten a person and to have the dog
/ examined by a physician or licensed veterinarian at the commence-
.
�L' ment and termination of this two week period. If such dog during
this period shall die or shall show definite signs of illness , it
shall be the duty of such owner or person having custody of the
dog to turn the dog over to the health officer or, Chief of Police ,
or City Dog Warden, so that it can be determined whether or not
the dog had rabies .
SECTION 7• Impounding. Any dog found upon any public
street or highway running at large , or any dog for which the annual
tax has not been paid as hereinabove provided, shall be impounded
by the Police Department and shall be boarded at the place or
places from time to time designated by the City Dog Warden. If
such dog shall not have been redeemed within five days after being
impounded, it shall be disposed of in the manner prescribed by the
City Council.
Upon confinement and impoundment , the City Dog Warden or
the Police Department shall notify the owner, if known, of such im-
poundment .
If the owner of any dog impounded hereunder is unknown,
such dog shall be boarded for a period of five (5 ) days and there-
after, if no claim has been made for such dog, shall be disposed of

by injection by a licensed veterinarian or physician or released
to any person desiring said dog upon payment of a Twenty ($20.00)
Dollars release fee plus a fee of Five ($5 .00) Dollars for rabies
shots . Efforts shall be made hereunder to find suitable homes for
any unclaimed dogs or dogs whose owners are unknown, either directly
by the City Dog Warden and the Police Department or with the assis-
tance of the Animal Welfare League .
The owner of any dog impounded hereunder may redeem the
same by paying to the City Collector a boarding fee in the amount
of Three ($3 .00) Dollars per day for each day said dog has been
impounded plus a release--redemption fee according to the following
schedule:
For first offense --a redemption fee of $ 5 .00
For second offense--a redemption fee of $10.00
For third offense --a redemption fee of $20.00
For all offenses thereafter
--a redemption fee of $10.00
In addition to the foregoing, any such owner shall pay
the annual tax if not already paid, and the Five ($5 .00) Dollars
fee for rabies shots , if applicable .
SECTION $. City Dog Warden. The Mayor, with the advice
and consent of the City Counsel, shall have the authority to
appoint a City Dog Warden and an Assistant City Dog Warden whose
duties shall be the enforcement of the Ordinance.
SECTION 9. Definition of "dog" . The word "dog" as
used in this ordinance shall include all animals , regardless of
sex, of the canine species . The word "Person" as used in this
ordinance shall include any individual, association of individuals
or any corporation.
SECTION 10. Method of Destruction. Whenever it shall
become necessary to destroy any dog, the method of destruction
shall accord with the latest accepted practices from a humane
standpoint .
SECTION 11. Penalty. Any person, firm or corporation
violating this ordinance shall be fined not less than $10.00 nor
more than $100.00 for each offense , and a separate offense shall

be deemed committed on each day during or on which a violation
occurs or continues .
SECTION 12 . Resisting Officer. It shall be unlawful
for any person to molest , resist , interfere with, hinder, or pre-
vent any officer or person in the discharge of the duties or
powers conferred upon them by this ordinance .
SECTION 13 . Any ordinance in conflict herewith is re-
pealed.
SECTION 14. This ordinance shall be in full force and
effect from and after its passage, approval and publication as
required by law.
