Ordinance 1974-73 AN ORDINANCE AUTHORIZING THE TOWING AWAY OF ILLEGALLY PARKED MOTOR VEHICLES BE IT ORDAINED by the City Council of the United City of the Village of Yorkville , Kendall County, Illinois , as follows : Section 1 . That the police department, and all members thereof assigned to traffic duty, are hereby authorized to remove and tow away, or have removed and towed away by commercial towing services , any car or other motor vehicle illegally parked in any place where such parked motor vehicle creates or constitutes a traffic hazard, blocks the use of a fire hydrant, or obstructs a or may obstruct the movement of any emergency vehicle . Section 2 . Any car or other motor vehicle illegally parked within or upon any street or alley heretofore designated by the United City of the Village of Yorkville , to be a no-parking zone or area when parking thereon is prohibited may also be removed and towed away as herein provided. Section 3 . Any car or other motor vehicle so towed away for illegal parking shall be stored in a safe place and shall be restored to the owner or operator of such motor vehicle upon payment to the City Clerk, of a fine of $10 . 00 within twenty- four hours after the time such car was removed, plus $3 . 00 for each additional twenty-four hours or fraction thereof. In - addition thereto , said owner or operator shall pay all costs and expenses incident to the towing and storage of any said motor vehicle , said costs and expenses to be paid directly to the commercial towing service rendering services hereunder. I Section 4 . This Ordinance shall be in full force and effect from and after its due passage , approval and publication r according to law. PASSED this 14th day of November, A.D. , 1974.
