Ordinance 1968-41 AN ORDINANCE AMMING AN ORDINANCE CONCERNING
ALCOHOLIC LIQUORS, AS PASSED AND APPROVED ON
APRIL 21, 1960
WHEREAS, public good and convenience require the regulation licensing for the
sale at retail of alcoholic liquors in the United City of the Village of Yorkville,
Kendall County, Illinois, and
WHEREAS, public good and convenience require that permissible hours for the sale
of alcoholic liquors and that the number of licensed premises and licenses to be
issued in said City be determined, and because of the necessity of police supervision
and the nature of the licensed premises; therefore; an ordinance concerning alcoholic
liquors as passed and approved April 21, 1960 is hereby amended as follows:
BE IT ORDAINED BY THE CITY COUNCIL of the United City of the Village of
Yorkville, Kendall County, Illinois:
Section 1. That Section 3 of the April 21, 1960 Ordinance Concerning alcoholic
Liquors be and the same is hereby amended by deleting Section 3 of the April 21, 1960
Ordinance and inserting in lieu thereof the following:
"Section 3. Licenses to sell ak-,ftlic liquor shall be of the following
kinds and classes:
Retail class
Club class
Restaurant class
A retail class license, a club class license and also a restaurant class
license shall entitle the licensee to sell at retail all alcoholic liquors."
Section 2. That Section 4 of the April 21, 1960 Ordinance be and the same is hereby
amended by deleting Section 4 of the April 21, 1960 Ordinance and inserting in lieu
thereof the following:
IlSection 4. The license fee for a license to sell alokolic liquors in
the United City of the Village of Yorkville shall be as follows:
Retail Class - The sum of $500.00 for each ensuing six months
period or fraction thereof, payable in advance, and all licenses shall
be issued for a six months period, expiring on April 30, or October 31,
as the case may be, provided, however, that a full years license fee
may be paid in advance, in the discretion of the Local Commission.
Club Class - The sum of $50.00 for each ensuing six months period
or fraction thereof, payable in advance, and all licenses shall be
issued for a six months period, expiring on April 30 or October 31,
as the case may be, provided, however, that a full years license fee
may be paid in advance, in the discretion of the Local Commission.
Restaurant Class - The sum of $175.00 for each ensuing six months

period or fraction thereof, payable in advance, and all licenses shall
be issued for a six months period, expiring on April 30, or October 31,
as the case may be, provided, however, that a full years license fee
may be paid in advance, in the discretion of the Local Commission."
Section 3• That there is hereby added to the April 21, 1960 Ordinance Concerning
Alaholic Liquors, the following Section, namely: Section 7a.:
"Section 7a. Restaurant licenses, shall authorize the retail sale,
on the premises specified, of all kinds of legalized alcoholic liquors,
for consumption on the premises, other than packaged liquors, and shall
be issued only to operators of restaurants, provided the owner or
owners of the premises shall give their written consent thereto.
No public bar shall be permitted in a restaurant which has been issued
a restaurant license, and no alcoholic liquors shall be sold over or
at any public bar or counter in said restaurant, but shall be served
only to patrons or customers of the restaurant who are seated for dining,
during the hours meals are being served, and in conjunction with a meal,
by waiters or waitresses employed by the licensee, from a service
bar in the kitchen thereof. No signs shall be permitted on or about
the premises advertising the sale of alcoholic liquors, and no original
package sale of alcoholic liquors shall be made by the licensee hereof,
and, in addition, restaurant license hours for the sale of alcoholic
liquors shall be only between the hours of 11:00 A. 11. and 11:00 P.1"i.,
Central Standard Time, unless Daylight Savings Time shall be in effect
in the United City of the Village of Yorkville, in which case such
latter time shall apply."
Section 4. That Section 24 of the April 21, 1960 Ordinance Concerning Alcoholic
Liquors be and the same is hereby amended by deleting said Section 24 of the April 21,
1960 Ordinance, and inserting in lieu thereof the following:
"Section 24. And, it is hereby further determined that the number
one (1) shall be the maximum number of restaurant licenses issued in
the United City of the Village of Yorkville, provided, if the population
of the City, to be determined by the latest Federal census, should at
any time exceed 2,000, then for each 500 of population in excess of
such 2,000, one additional Restaurant Class license may be permitted
to be issued by the Local Commission; and, it is hereby determined
that the number two (2) shall be the maximum number of Retail Class
licenses issued in the United City of the Village of Yorkville,
provided, if the population of the City, to be determined by the latest
Federal census, should at any time exceed 2,000, then for each 500 of
population in excess of such 2,000, one additional Retail Class license
to sell alcoholic liquors at retail may be permitted to be issued by
the Local Commission, and it is further hereby determined that the
number one (1) shall be the maximum number of Club Class licenses
issued in the City of Yorkville, provided if the population of the
City, to be determined by the latest Federal census, should at any
time exceed 2,000, then for each 500 of population in excess of
such 2,000, one additional Club Class license may be permitted to
be issued by the Local Commission."
Section 5• That this Ordinance shall repeal all other Ordinances of the United City of
Village of Yorkville heretofore passed and adopted that conflict herewith, and in all
other respects said Ordinances shall remain in full force and effect, including all
provisions of the April 21, 1960 Ordinance Concerning Alcoholic Liquors, except as
hereby amended.
Section 6. That this Ordinance shall take effect and be in full force and effect
from and after its passage and publication as provided by law.

ORDINANCE CONCERNING

and the nature of the licensed premises; therefore, an ordinance concerning alcoholic

Liquors as amended October 10, 1968, be, and the same is hereby amended by deleting
Section 3 of the October 10, 1968 amendatory ordinance and inserting in lieu thereof,
the following:
"Section 3: Licenses to sell alcoholic liquor shall be of the
following kinds and classes:
Retail Class
Club Class
Restaurant Class
Package Class
A retail class license, a club class license, a restaurant class
license and a package class license shall entitle the licensee to
sell at retail all alcoholic liquors, subject to the terms and
conditions herein set forth."
Section 2: That Section 4 of the October 101 1968 amendatory ordinance is hereby
amended by deleting Section 4 and inserting in lieu thereof, the following:
"Section 4: The license fee for a license to sell alcoholic liquors
in the United City of the Village of Yorkville shall be as follows:
Retail Class - the sum of ;;500.00 for each ensuing six month period
or fraction thereof, payable in advance, and all licenses shall be
issued for a six month period, expiring on April 30, or October 31,

as the case may be, provided, however, that a full year's license
fee may be paid in advance, in the discretion of the :vocal Commission.
Club Class - The sum of $50.00 for each ensuing six month period or
fraction thereof, payable in advance, and all licenses shall be issued

Package Class - The sum of $250.00 for each ensuing six month
period or fraction thereof, payable in advance, and all licenses shall
be issued for a six month period, expiring on April 30 or October 31,
as the case may be; provided, however, that a full year's license fee

Section 3: There is hereby added to the April 21, 1960 Ordinance Concerning
Alcoholic Liquors, as amended by the October 10, 1968 ordinance, the following section,
namely, Section 7 b:
"Section 7 b. Package licenses shall authorize the sale on the premises
specified, all kinds of legalized alcoholic liquors by and in their
original packages for the consumption off the premises, and such license
shall be issued only to those persons who can ineet the requirements of
the April 21, 1960 ordinance, as amended, and the sale of package liquors
is expressly prohibited on Sundays and before the hour of 9:00 a.m. and
after the hour of 11:00 p.m. on the remaining days of the week."
Section 4: That Section 24 of the April 21, 1960 Ordinance Concerning Alcoholic
Liquors as amended by the October 10, 1968 ordinance, is hereby amended by deleting
Section 24 and inserting in lieu thereof the following:
"Section 24: It is hereby determined that number one (1) shall be the
maximum number of package licenses issued in the City of Yorkville,
provided that if the population of the City of Yorkville as determined

by the latest Federal census, shall at any time exceed 2500 persons,
then for each 500 of population in excess of such 2500, one additional
Package Class License may be permitted to be issued by the Local
Commission; and, it is hereby further determined that the number one (1)
shall be the maximum number of Restaurant Licenses issued in the United
City of the Village of Yorkville; provided that, if the population of
the city, as determined by the latest Federal census, should at any time
exceed 2500, then for each 500 of population in excess of such 2500, one
additional Restaurant Class License may be permitted to be issued by the
Local Commission; and it is hereby determined that the number two (2)
shall be the maximum number of Retail Class Licenses issued in the United
City of the Village of Yorkville; provided that, if the population of
the city, as determined by the latest Federal census, should at any time
exceed 2500, then for each 500 of population in excess of such 2500, one
additional Retail Class License to sell alcoholic liquors at retail may
be permitted to be issued by the Local Commission; and it is further
hereby determined that the number one (1) shall be the maximum number
of Club Class licenses issued in the City of Yorkville; provided that
if the population of the city, as determined by the latest Federal census,
should at any time exceed 2500, then for each 500 of population in excess
of such 2500, one additional Club Class License may be permitted to be
issued by the Local Commission. "
Section 5: That Section 6 of the April 21, 1960 Ordinance Concerning Alcoholic
Liquors be, and the same is hereby amended by deleting said Section 6 of the April 21,
1960 Ordinance and inserting in lieu thereof, the following:
"Section 6: All the territory within the United City of the Village of
Yorkville is determined to be predominantly residential in character
other than the following portions,to-wit: Commencing at the intersection
of the center line of Route 47, also known as Bridge Street, and the
center line of Van Emmon Street, and running thence West along the center
line of Van En;ion Street to the alley; thence in a Northerly direction
parallel to the center line of said Route 47 to the South bank of the
Fox River, thence Easterly along the South bank, of the Fox River to a
point which intersects with the center line of Heustis Street extended;
thence along said line extended in a Southerly direction and along
the center line of said Heustis Street mntil said line intersects the
center line of Van Emmon Street; thence West along the center line of
Van Emmon Street to the intersection of the center line of Route 47;
thence Westerly along the center line of Van Emmon Street to a point
100 feet Westerly of the Easterly line of R.)ute 47; thence Southerly
parallel with Route 47 (the same being Bridge Street) to the point of
intersection with the center line of Washington Street; thence Easterly
along the center line of Washington Street to a point 100 feet Easterly
of the Easterly line of Route 47, the same being Bridge Street; thence
Northerly parallel with the Easterly line of Route 47 to its intersection
with the center line of Van Emmon Street; thence Westerly along the
center line of Van Emmon Street to the place of beginning. It shall be
unlawful to sell or offer for sale at retail any alcoholic liquor within
any residential portion of the United City of the Village of Yorkville,
and it shall be unlawful to peddle alcoholic liquor in said city, and
except in the case of a sale by a manufacturer to a consumer, as provided
in the State Liquor Control Act, all sales shall be made on the licensed
premises.
Section 6: That this ordinance shall repeal all other ordinances concerning
alcoholic liquors of the United City of the Village of Yorkville heretofore passed and
adopted that conflict herewith, and in all other respects said ordinances shall remain
in full force and effect, including all provisions of the April 21, 1960 Ordinance Con-
cerning Alcoholic Liquors, as amended by the October 10, 1968 ordinance.
Section 7: That this ordinance shall take effect and be in full force and effect
from and after its passage and publication as provided by law.
