Adjournment it DRAFT r Yorkville Public Library Board of Trustees Monday, August 11 , 2014, 7pm 902 Game Farm Road — Library Historic Wing The meeting was called to order at 7 :OOpm by President Beth Gambro Roll Call: Carol LaChance-yes, Judy Somerlot-yes, Sandy Lindblom-yes, Beth Gambro-yes, Russ Walter-yes Absent: Susan Chacon, Barb Johnson, Jo Ann Gryder Others Present: Library Director Michelle Pfister City Finance Director Rob Fredrickson Library Youth Director Jennette Weiss Library Youth Director Marianne Eberhardt Recognition of Visitors: Ms. Gambro welcomed Mr. Fredrickson, Ms. Weiss and Ms. Eberhardt. Amendments to the Agenda: Ms. Gambro said she would like a short discussion about the proposed coffee house and that there would be an Executive Session. Minutes: July 14, 2014 The previous meeting minutes were approved as presented on a motion by Ms. Somerlot and second by Ms. LaChance. Approved on a voice vote. Correspondence: A thank you card was received from Rita (former library employee) for the flowers sent to her upon her retirement. Heartland Blood Center also sent a letter thanking the library for their support during a recent blood drive. Public Comment: None Staff Comment: Ms. Pfister introduced Ms. Weiss and Ms. Eberhardt who assumed the children's department duties this summer. Each staff member gave an overview of the recent youth activities and upcoming programs. Ms. Somerlot asked what they need from the Library Board to meet their goals. Ms. Weiss said books, especially fiction, are a priority. Ms. Gambro said she might be able to obtain used books from the school district. Ms. Pfister suggested a Board member could do a "twilight reading". Another suggestion was community members presenting programs such as the recent canine program. A Page 1 of 5 I possible after-school reading program is being discussed as well as ways to involve the scboo4. Ms. Weiss said Bristol Bay School came four times last year, students got library cards and the teafher arranged a scavenger hunt at the library. Ms. LaChance asked if there would be a program for 3-year olds for early evenings or Saturdays. There will be a drop-in twilight read, not age-specific and it was noted the daytime Tots and Toddler program is filling up rapidly. Report of the Treasurer: Budget Report Ms. Lindblom reported the following: 1 . Budget is at 25% of FY 2. Half of the budgeted revenue has already been received 3 . Expenditures are right at budget 4. Paying agent fees are at 48% 5 . $550 received from development fees in July i Check Register 1 . All Vac is for vacuum repair--$ 155 .95 2. Bonding fees of $588.50 3 . Castle Insurance bonding for entire Board 4. Failed compressor service call for $ 1 ,366 5 : OCLC is annual database fee of $862 6: Library lawyer charged $975 (5 hours at $ 195/hour) for calls made by Trustee Gryder regarding the health insurance issue from earlier this year. Ms. Lindblom asked if the Board needed a policy on Board members calling the attorney. Ms. Gambro said she had researched the minutes since January for any formal requests to contact the attorney. In the March minutes, it was mentioned by Ms. Gryder that the Board should contact the library attorney about the health insurance. In the end, it was decided that Ms. Pfister would contact the attorney with pre-determined questions (from a sub-committee). However, this call was not made. Mr. Walter also remembered a discussion about contacting the attorney regarding the Inter-Government Agreement. This was to determine if the Board was obligated to use the City insurance. In another reference to contacting the attorney, the Board discussed asking him to write letters to all companies involved in the building siding issue. Ms. Gambro suggested that a policy is needed and asked the Policy Committee to develop procedures regarding any expenditures. Ms. Somerlot said that when money will be spent, a vote should be taken. The Board should be more formal in the future when suggesting these calls, said Ms. LaChance. Going forward, a vote will be taken prior to any money being spent. 7: Sound Inc., $752.07 for quarterly payment for security system 8 : Ms. Lindblom said the kids raised $50 toward the magic performance and a $250 anonymous donation was received towards the show. 9: Trico bill for $6,580 for air chiller repair. 10: Friends paid Visa bill 11 : Internet bill / Comcast is for a T- 1 line Page 2 of 5 i Ms. Pfister discussed the compressor repair and said that half the amount was due prior to work being done. After three days of work, it was determined the problem was not the compressor. In addition, a crane was on the way and had to be stopped. Electronics were repaired and a motherboard was replaced. Michelle is working on getting a partial refund minus the cost of replacing the motherboard. Since a check was cut for these repairs outside the normal check run, it was noted in the bills as "Manual Check Register" Ms. Lindblom also provided the following statistics to conclude her report : Payroll : $32,685.01 Total Disbursements: $80,684.69 Memorials and Gifts balance: $ 1 ,31 .79 Cash Statement No comment. Mr. Fredrickson said a City audit was done two weeks ago with the final audit to come in September. He highlighted the library's budget as follows: Surplus of $24,940 to be added to the Fund Balance The overall Fund Balance is $471 ,076 which he described as healthy and strong. When property tax comes in, debt service is paid. Capital Fund (houses development fees): slight surplus of about $ 11 ,000 Remaining Fund Balance at end of FY ' 14 : $26,871 Payment of Bills Trustee Somerlot moved to pay the bills in the amount of $46,999.68 and payroll in the amount of $33 ,685.01 for a total disbursement amount of $80,684 .69. The motion was seconded by Trustee LaChance. Roll call : Somerlot-yes, Lindblom-yes, Gambro-yes, Walter-yes, LaChance-yes. Passed 5-0. Report of the Library Director: Library Director Pfister gave the following report: 1 . June/July were the busiest months and she gave the stats for the month of July 2. Had intem in June/July who was in the kid's room. She taught crocheting among other things and spent $ 100 3 . Library had candy history program attended by 51 people, Wrigley provided gum for guests 4 . Friends group provided prizes for summer adult reading program. Ms. Pfister expressed her thanks to the Friends group for all the assistance they provide and the programs they make possible. Friends of the Library Report by Judy Somerlot: 1 . Judy reported that a President is needed for the Friends group and that more people need to be involved. She said 14 people attended the meeting on this date. Much money has been raised, but it takes many to participate. 2. Additional volunteers are needed for the upcoming book sale, books will be moved August 26`h. 3 . Membership campaign starts on September 1 . Library Director Report cunt.... 5 . "Food for Fines" netted 480 items for the Food Pantry, in addition over $700 in Library fines was collected. Page 3 of 5 6. Shelley is working on 100-year celebration and has written letters to 60 authors so far asking for memories of what a library means to them. Will also ask for autograph and photos. 7. Michelle will attend the open house for the new Morris Library Director and to view the newly refinished teen area 8. Over 200 responses have been received for the library survey which is now closed. The results should be available at the next Board meeting. Hoped for 400 responses. 9. Michelle would like to do a walk-through inside/outside with Board members at 6: 15 prior to the September Board meeting. She will point out where money has been spent for improvements and improvements still needed. Ms. Gambro will notify Trustees Johnson and Gryder. 10. New Board member to be appointed: Kate Elder—has experience in fund-raising. Ms. Gambro will call her. City Council Liaison: No report Standing Committees: There were no reports from the committees. President Gambro said new committee assignments will be made next month and she asked Trustees to advise her of their preferences. Unfinished Business: Building Siding Mr. Walter said there was no further information regarding the building siding and no proposals for painting. Ms. Pfister reported that the handyman who has done recent work for the library, said the painting job would be too much for him. The Oswego Sherwin-Williams store was also going to ask clients about providing estimates. Mr. Walter said no info regarding RFP's has been received from the City and he suggested paying Tom Lindblom to assist with the REP. He also noted it may be too late in the season for this job. Ms. Lindblom added that Mr. Lindblom had looked at the building and suggested just painting the front at this time. Trustee Walter agreed with doing the job in stages, however, he noted that paint lot numbers could be slightly different colors if purchased at separate times. If the job is done in stages, no RFP would be needed. Some wood work also needs to be repaired, he said. He and Ms. LaChance both suggested placing an ad in the paper soliciting a painter. He said he was hesitant to wait until spring since that would be the middle of the 100-year celebration. He will contact Menards and Home Depot for names of painters and Sandy will ask Tom for suggestions. President Gambro asked all Board members to be on the lookout for painters. Ms. Pfister asked if the same color would be used, and the Board replied no. Ms. Lindblom noted that if a different color is used, the job must be done all at one time. Web Site Update Ms. Pfister said staff has been working with Weblinx on the update and the first page is now completed. It is hoped to have the update done by the next meeting. Half of the cost has been paid. Library staff will take care of the updates and work on the Facebook. Coffee House Update Jo Arm Gryder has met with the contact for the coffee house. The Health Department has not been called yet until Ms. Gryder is able to determine more of the requirements from the contact. Page 4 of 5 III New Business: Disaster Plan All Board members should give their Disaster Plans to Michelle for an update of staff and Board members. She also provides a copy to the Police Department. I Per Capita Grant — Serving Our Public Collection Management and Source Sharing Director Pfister said when she does the grant, she has to make the Board aware of circulation management and collection management. Currently, the library has no Braille books, but they can be obtained through the inter-library loans. She would like to purchase some when the budget allows. Ms. Gambro asked if the library is actually spending 12% of the budget on materials for patrons. Ms. Pfister replied yes and said the materials can include such things as DVD's, electronics, etc. Per Capita Grant — Analyze the Current Budget The Per Capita grant is done and she read to the Board, the statement that she drafted as part of the grant. The statement included information on the reduction of library hours and budget constraints, etc. As the budget is developed, Ms. Gambro said priorities are put on purchasing best sellers and replacements. Executive Session: It was moved and seconded, respectively by Ms. Lindblom and Ms. Somerlot to enter into Executive Session. Approved by unanimous voice vote. It began at 8:26pm and ended at 8:48pm. Roll call back into Regular Session: Gambro-yes, Walter-yes, LaChance-yes, Somerlot-yes, Lindblom- yes. No action will be taken based on what was discussed in the Executive Session. Yorkville Public Library Internet Use Policy In fulfilling its mission to provide information, education, and cultural enrichment for the community through a commitment to excellence in library services, the Yorkville Public Library provides its patrons with the latest information technology. Therefore, internet access is available in both the Adult and Children's departments. The internet is a global and unregulated information network. As such it allows patrons to access information and images beyond the scope of the Yorkville Public Library's collection. The library cannot control the information accessible through the internet and does not accept responsibility for its content. As with other library materials, a child's use of the internet is solely the responsibility of the child's parents or guardian. Parents are encouraged to provide guidance and explore the internet with their children. The library's internet stations are in public areas and are shared by patrons of all age. Therefore, all patrons are asked to refrain from accessing potentially offensive information or images. Use of the computer workstations with internet access, except for the "express" workstation in the Adult Services department, is limited to holders of a valid Illinois public library card. The internet connection is available on a first come, first served basis. 2. Students 7`h grade or older may use the internet connection. Students younger than 7`h grade may use the internet connection when accompanied by a parent or other responsible adult. The parent or guardian must come to the library and sign the Internet Use Disclaimer for students in 7`h through high school. 3 . III. TERMS OF THE AGREEMENT A. Definitions: For the purposes of this Agreement: Applicant Statement shall refer to the Tax Abatement Applicant Summary Statement, attached hereto and incorporated herein as "Exhibit B" Estimated Market Value shall be provided by the Applicant on the Applicant Statement and shall be the estimated valuation of the Property once the property has become Fully Assessed. Real Estate Property Taxes shall mean all taxes levied or extended upon the Property and any improvements to the Property, including the taxes now existing or which may in the future exist. Fully Assessed shall mean the Applicant has received an occupancy permit for the facility. Fully Operational shall refer to the period of time after the Applicant has commenced business operations on the Property and jobs have been created, as represented by the Applicant on the Applicant Statement. The Applicant must continue to occupy and conduct business on the Property at all times for the Property to be considered "Fully Operational'. Tax Year shall mean from January 1 through December 31 of a given year. Default shall refer to a situation where the Applicant has not met its obligations under this agreement and thus the obligations of the Taxing Body(s) are extinguished and the Agreement is terminated. In such a Default, Applicant agrees to and shall repay the terminating Taxing Body(s) in full the amount of money equal to all the Real Estate Property Taxes on the property that were previously abated by the Taxing Body(s) pursuant to this Agreement. B. Amount and Duration: The Applicant shall commence construction of an addition to their existing facility on the Property described in Exhibit A, attached hereto and incorporated herein by reference. The Taxing Bodies shall, pursuant to 35 ILCS 200/18- 165 as it may be amended subsequent to the effective date of this Agreement, each take any and all action necessary to abate their portion of the new Real Estate Property Taxes attributed to the approximate market value of $5,375,000.00 for the addition to the I Page 2 of 23 �1 I existing facility for five consecutive tax years after the addition to the facility is fully assessed and fully operational as follows: i 1. First Tax Year: Fifty (50) percent of the Real Estate Property Taxes attributed to the approximate market value of $5,375,000.00 for the addition to the existing facility shall be abated for the First Tax Year when the addition to the facility is fully assessed and fully operational and the amount of initial jobs have been created as represented by the Applicant on the Applicant Statement ("First Tax Year"). 2. Second Tax Year: Fifty (50) percent of the Real Estate Property Taxes attributed to the approximate market value of $5,375,000.00 for the addition to the existing facility shall be abated for the Second Tax Year when the addition to the facility is fully assessed and fully operational and the amount of initial jobs have been created as represented by the Applicant on the Applicant Statement ("Second Tax Year"). 3. Taxing Bodies agree, however, that they shall not file undervaluation complaints with the Board of Review, Property Tax Appeal Board or the Circuit Court during the time the Applicant receives the tax abatement. The aggregate amount of abated taxes for all taxing districts combined shall not exceed $4,000,000 pursuant to 35 ILCS 200/18- 165(a)(1 )(C). Should it be determined that the aggregate amount abated has exceeded the statutorily allowable amount, the remaining abatement allowances shall cease to be extended and all duties of the Taxing Bodies under this agreement shall cease. C. Applicant Cooperation: Prior to the abatement of Real Estate Property Taxes taking effect, the Applicant shall, no later than March 1 of a given year, submit documentation on forms provided by the Kendall County Administrative Office demonstrating that the facility has become Fully Operational. Should the Applicant fail to provide the information specified in this Agreement or access required (provided such Taxing Body executes Applicant's confidentiality agreement prior to entering the Property), and should such failure continue for more than thirty (30) days after written notice, any Taxing Body may terminate their obligation under this Agreement, unless a written request has been made by Applicant within thirty (30) days of the above Notice in which Applicant requests an additional thirty (30) days to provide the information or access. Upon written request by the Applicant, the Supervisor of Assessments shall grant Applicant an additional thirty (30) days to provide the information or access. Upon any herein outlined termination, the Applicant agrees to and shall repay the terminating Taxing Body(s) in full the amount of money equal to all the Real Estate Property Taxes on the property, which were previously abated by the Taxing Body(s) pursuant to this Agreement. Should a material intentional misrepresentation be discovered regarding Applicant's Application and Applicant Summary Statement, the Applicant shall be in default of this Agreement, which shall result in the termination of the Agreement. Upon such termination, the Applicant agrees to and shall repay the terminating Taxing Body(s) in full the amount of money equal to all the Real Estate Property Taxes on the property, which were previously abated by the Taxing Body(s) pursuant to this Agreement. D. Estimated Market Value The Applicant has represented, and the Parties agree, that the addition to the Property will have an approximate market value of $5,375,000.00 when fully improved and assessed. The Applicant has represented, and the Parties agree, that the Property as a whole will have an approximate market value of $ 13,497, 180.00 when fully improved and assessed. The Supervisor of Assessments and the Bristol Township Assessor shall Page 4 of 23 j not assess the Property improvements, partial or otherwise, until the City of Yorkville issues an occupancy permit to the Applicant. E. Tax Obiections and Assessment Appeals: Except in the case of a typographical or ministerial error, and except for the conditions described in the second paragraph of this Section E, the Applicant agrees not to file an objection to the Real Estate Property Taxes levied by the Taxing Bodies, not to tender payment under protest, nor to file any appeal of the assessment of the Real Estate Property Taxes on the Property for any year in which the Applicant is granted an abatement pursuant to Paragraph III.B., nor for any of the next three tax years after the final year of abatement. This paragraph shall permit and result in the mandatory dismissal of any objections, assessment appeals, or protests made by the Applicant or its representative for any year in which abatement has been provided pursuant to Paragraph III.B. With respect to the three years following the final year of abatement, if the Supervisor of Assessments or Board of Review establishes an assessed value based upon a market value greater than the Estimated Market Value of the Property, the Applicant may seek a reduction through the assessment appeal process; provided, however, that the Applicant agrees not to seek and hereby waives the right to be granted, a reduction to an assessed value which would represent a market value valuation of less than the Estimated Market Value of the addition to Property as set forth in section D above. F. Employees: The Applicant has represented on the Applicant Statement that 75 initial additional jobs will be created on the Property by June 2016. The Applicant shall maintain the wage rates and fringe benefits for said employees pursuant to the figures provided by the Applicant in the Kendall County Applicant Statement for Tax Abatement and Tax Abatement Request Summary as set forth in Exhibit B, attached hereto and incorporated herein by reference. The Applicant shall provide the Taxing Bodies with documentation of compliance with employment, wage rate and fringe benefit requirements by sending the documentation to the Kendall County Administrator. Further, to verify compliance with the Property Tax Abatement Agreement, a business must submit a payroll summary with listing of either the first name or initial of the employees or a listing of the employees' ID number along with job titles, salaries, benefits, county of residence, and hiring dates on an annual basis to the Kendall County Office of Administrative Services. Said documentation shall be provided no later than March I following the date when the facility has been fully assessed and on or before March I for each full tax abatement year. Should the Applicant fail to substantially meet the requirements set forth in "Exhibit B", ( 1 ) for the number of employees, or (2) for the wage rates and/or fringe benefits, or (3) fail to provide the information and documentation as set forth above, Wrigley Page 5 of 23 will have sixty (60) days to cure the defect. If no cure occurs within sixty (60) days, r any Taxing Body may terminate their obligation under this Agreement. Upon such termination, the Applicant agrees to and shall repay the terminating Taxing Body in full the amount of money equal to all the Real Estate Property Taxes on the property, which were previously abated by the Taxing Body pursuant to this Agreement. G. Compliance with Applicable Laws: Applicant agrees to comply with all applicable federal, state and local laws and regulatory requirements and to secure such licenses as may be required for its employees and to conduct business in the state, municipality, county and location. Such obligation includes, but is not limited to, environmental laws, civil rights laws, prevailing wage and labor laws. The Applicant, its officers, employees, and agents agree not to commit unlawful discrimination and agree to comply with all applicable provisions of the Illinois Human Rights Act, Title VII of the Civil Rights Act of 1964, as amended, the Americans with Disabilities Act, the Age Discrimination in Employment Act, Section 504 of the Federal Rehabilitation Act, and all applicable rules and regulations. The Applicant shall not violate any environmental performance standard or environmental or building code, ordinance, rule, or regulation of the United States of America, State of Illinois, the County of Kendall, or United City of Yorkville. During the Tax Years that are subject to abatement under Section III.B., should the Applicant receive notice of any such violation and fail to cure the violation and fail to cure the violation within sixty (60) days of the written notice, any Taxing Body has the right to terminate the tax abatements. H. Termination: To terminate its respective tax abatement pursuant to the terms of this Agreement, each Taxing Body shall provide notice to the Applicant in writing or by written agreement of the respective Taxing Body and the Applicant. The Indemnification sections of this Agreement shall survive termination of this agreement. IV. BINDING PARTIES A. Guarantee of Authorization: Each party signing this Agreement represents, warrants, and guarantees to all the other parties that: ( 1 ) They are authorized to execute this Agreement upon behalf of the party for whom they signed this instrument; (2) All action necessary, including, but not limited to corporate resolutions, ordinances and notices, to make this Agreement a lawful and binding agreement upon that party has been taken; Page 6 of 23 (3) The performance of the transactions contemplated by the provisions of this Agreement, and the execution, issuance, delivery and performance of this Agreement to be executed and delivered by the Taxing Bodies and the Applicant have each been duly authorized by all necessary action on the part of each. B. Effective Date: This Agreement shall not be effective until all of the parties to this Agreement have in fact signed this Agreement and the effective date of this Agreement shall be the latest date that any one party actually signs and dates this Agreement. C. No Assignment or Transfer: The abatement is specifically granted to the Applicant and may not be assigned or transferred. In the event that the Applicant ceases operation or transfers title of the property without consent of the taxing districts, the abatement shall immediately terminate and the Taxing Bodies shall have the right to require the Applicant to repay the total sum of all previously abated taxes. D. Early Closure of Applicant's Abated Facility: The Applicant agrees that by signing this agreement they will remain Fully Operational at the Property for a tern of at least three full years beyond the termination of the final tax abatement year. Should the Applicant cease operation of the facility within three (3) years from the termination date of the abatement period, the Taxing Bodies shall have the right to require the Applicant to repay the total sum of all previously abated taxes. Should the subject property cease to be operated during the outlined abatement years and at least three (3) full years beyond the termination of the final tax abatement year, as originally intended and described by the Applicant Summary Statement attached as Exhibit B, the abatement shall immediately terminate and the Taxing Bodies shall have the right to require the Applicant to repay the total sum of all previously abated taxes. Pursuant to the Property Tax Code, 35 ILCS 200/18- 183, Should the Applicant entirely relocate the business facility from the applicable taxing district during the outlined abatement years, or within three (3) full years beyond the termination of the final tax abatement year, the abatement benefit for the remainder of the term is cancelled and Applicant must repay all abatements it received from the Taxing Bodies under this Agreement. The repayment must be made within 30 days of the violation, and the Taxing Bodies will have no obligation to make future abatements under this agreement. E. Successors of Taxing Bodies: odies: This Agreement shall be binding upon the Taxing Bodies, their successors, and their assigns, notwithstanding the provisions of paragraph C. Page 7 of 23 1 F. Communication Requirements: All notices, requests, demands, waivers and other communications shall be in writing and shall be considered duly given three days following dispatch when deposited by mail, certified or registered mail, postage prepaid, properly addressed to the party entitled to receive such notices at the addresses listed in "Exhibit C". Each party may designate a new place or places, or a new person or persons, for notice purposes, by providing thirty days written notice to all other parties. G. Applicable Law: This Agreement shall be interpreted and enforced according to the statutes, case law and Constitution of the State of Illinois regardless of the later legal residence or domicile of any of the Taxing Bodies or the Applicant. Venue shall be the Circuit Court of the Twenty-Third Judicial Circuit, Kendall County, Illinois. The parties hereto waive any claim or defense that such venue is not convenient or proper. H. Indemnification: It is understood and agreed between the parties to this Agreement that the Applicant, in performing its obligations pursuant to this Agreement, is acting independently and apart from any other party to this agreement. The Taxing Bodies that are parties to this Agreement assume no responsibility or liability for actions resulting from this Agreement or for any and all claims, suits and causes of action of any nature whatsoever arising out of the Applicant's obligations hereunder. As such, the Applicant receiving the abatement agrees to indemnify, hold harmless and defend, with counsel of the Taxing Bodies own choosing, the Taxing Bodies and their past, present and future board members, elected officials, insurers, employees, and agents (the "Indemnitees") from, and against such claims, damages, demands, expenses, liabilities and losses of any nature whatsoever resulting from this agreement, including, but not limited to those resulting from: ( 1 ) The construction, improvement and development activities of Applicant, its agents, contractors, and subcontractors with respect to the development or improvement of its property; and (2) Applicant's performance or alleged failure to perform its obligations pursuant to this Agreement; except to the extent such claims, damages, demands, expenses, liabilities and losses arise by reason of the negligence, gross negligence or willful or wanton act or omission of the Taxing Bodies. The obligation to indemnify created hereunder extends to indemnifying the Taxing Bodies from any claims for monetary relief seeking a refund of any monies abated under the terms of this agreement. The Taxing Bodies' participation in their defense shall not remove Applicant's duty to indemnify, defend, and hold them harmless, as set forth above. The Taxing Bodies do not waive their defenses or immunities, including those under the Local Government and Governmental Employees Tort Immunity Act (745 ILCS 10/1 et seq.), by reason of indemnification. Indemnification shall survive the termination of this contract. Page 8 of 23 L Severabilitv: If any clause in this Agreement is deemed to be void or unenforceable, such clause shall be severed and the remaining provisions in this Agreement shall remain in full force and effect. J. Entire Agreement/Amendment: This Agreement represents the entire Agreement between the parties and there are no other promises or conditions in any other Agreement whether oral or written. This Agreement supersedes any prior written or oral agreements between the parties and may not be modified except in writing acknowledged and signed by all the Taxing Bodies and the Applicant. K. Counterparts: This Agreement may be executed in counterparts (including facsimile signatures), each of which shall be deemed to be an original and each of which shall constitute one and the same Agreement. L. Captions and Paragraph Headings: Captions and paragraph headings are for convenience only and are not a part of this Agreement and shall not be used in construing it. Background The Wrigley Yorkville Manufacturing Facility was constructed in 1995 by the Amurol Corporation, which was bought by Wrigley in 2003 . The current facility contains 215,000 square feet of food manufacturing space, and Wrigley is moving forward with a 146,000 square foot expansion to accommodate Skittles production. City officials met with Wrigley representative in early 2014 to discuss potential expansion of the Wrigley Manufacturing Facility. At the time, Yorkville was competing against several other sites within and outside the country. In early meetings, it became apparent that the normal City incentives (TIF, sales tax sharing) would not apply to this project. Fortunately, the type of jobs created by the expansion and the nature of the land-use lent itself to state incentives, including job tax credits, money for training employees, and 100% funding for a new traffic light at their entrance and Route 47, for which the City will be the recipient and coordinator of the project. Additionally, Wrigley is seeking a five-year real estate property tax abatement on the incremental property taxes from the new facility from all units of government. All other units of government have approved the attached agreement. Wrigley is seeking a 5-year, 50% incremental property tax abatement for the addition only. We are not abating any property taxes on the existing facility, which currently has a total tax bill of over $304,000 annually. Of that amount, the Library receives $9,000 annually. We estimate that the additional Library property taxes generated by this expansion will be around $7,000 per year, which means the Library would be abating around $3,500 per year for an estimated total of $ 17,500 over the life of the agreement. In exchange, Wrigley is committing to: 1 ) Build a new commercial addition of 146,000 sf. Their existing facility is 215,000 sf. 2) Hiring 75 new full-time employees.
