Ordinance 1967-30 AN ORDINANCE Af IENDING SECTIONS 8, 26 AND 27 OF "AN ORDINANCE PERTAINING TO THE WATER WORKS OF THE UNITED CI`?'Y OF THE VILLAGE OF YORKVILLE, ILLINCIS, AND REPEALING ALL ORDINA�?CES IN RE- GARD TO THE WATER WCRKS HERETOFORE PASSED AND APPROVED, AS PUBLISHED BY AUTHORITY OF THE CITY COUNCIL ON JULY 16, 1959", AS AMENDED. BE IT ORDAINED by the City Council of the United City of the Vila ge of Yorkville, Illinois: Section 1. That Sections 8, 26 and 27 of, "An Ordinance Pertaining to the Water Works of the United City of the Village of Yorkville, Illinois, and Repealing All Ordinances in Regard to the Water Works Heretofore Passed and Approved, as Published by Authority of the City Council on July 16, 1959", As Amended", is hereby amended to read as follows : Section 8. All connections and installations of water service shall upon proper application be made from the existing main upon applicant ' s street to the street side of applicant ' s sidewalk or to a point four (4) feet within the curb line, whichever point the Superintendent of water works shall so elect, and said connections and installations shall be made only by authorized employees of the City and only after payment by the user rar property owner at the time of application for water to the City Treasurer or Collector of a connection fee of One Hundred Seventy-Five ( $175.00) Dollars, which said fee shall include the installation and use of a city water meter. Section 26. (a) Meters shall be read quarterly and bills for water furnished shall be mailed on or about the first day of July, October, January, and April of each year, and all bills and charges for water rents and other services are payable at the cf f ice of the City Treasurer or Collector. (b) The following water rent charges, or rates, are hereby estab- lished and shall be collected for all water consumption and water ser- vices rendered within the city limits by the city, for which each service shall be by meter registration: Five ($5.00) Dollars for each Five Hundred (500) cubic feet or fraction thereof per quarter. Sixty ($0.60) Cents per One Hundred (100) cubic feet over Five Hundred (500) cubic feet, to and including Two Thousand (2000) cubic feet. Fifty-five ($0.55) Cents per One Hundred (100) cubic feet over Two Thousand (2000) cubic feet to and including, Four Thousand (4000) 30 r , —2— cubic fe r Fifty (0 0.50) Cents per One Hundred ( 100) cubic feet above Four Thousand (4000) cubic feet . (c) The following water rent charges, or rates, are hereby estab- lished and shall be collected for all water consumption and water ser- vices rendered beyond the city limits by the City, for which each service shall be by meter registration: Ten ($10.00) Dollars for each Five Hundred (500) cubic feet or fraction thereof per quarter. One Dollar and Twenty Cents ( $1.20) per One Hundred (100) cubic feet over Five Hundred (500) cubic feet, to and including Two Thousand (2000) cubic feet. One Dollar and Ten Cents ($1.10) per One Hundred (100) cubic feet above Two Thousand (2000) cubic feet to and including Four Thousand (4000) cubic feet. One Dollar ($1.00) per One Hundred ( 100) cubic feet above Four Thousand (4000) cubic feet . (d) The above rates are for a quarter of a year, or fraction thereof. ( e) All charges for water shall be due and payable on rendition in mailing of a notice of amount to the owner or tenant and shall become delinquent at the expiration of thirty (30) days from said date of mail- ing and for the purpose of enforcing the lien provided by the Illinois Municipal Code, Chapter 24, Article 11, Division 126, Paragraph 11-126-4. Illinois Revised Statutes, 196 , the fortieth (40th) day following the first day of the respective quarter is hereby fixed as a delinquency date. (f) Ten (10) days after a bill shall become delinquent , the water may be shut off from the premises, and shall not be turned on until all bac'c rentals and charges are paid, together with a Two ( $2.00) Dollar fee for turnin;M on the water. (g) In the event a water user becomes more than ten ( 10) days delin- quent, on two ( 2) or more separate occasions, the user may be required to furnish an additional deposit to the City in the amount of Fifteen ($15. ) Dollars in the case of a tenant of residence property, and Twenty ($20. ) Dollars in the case of all other property, and the City may refuse to turn said water on again until the aforesaid deposit has been received. Section 27. Water service accounts and charges shall be kept in the name of the owner of the property served except as to property owned d�% -3- •. ' by ther State Illinois, and only such owner shall be re nized as` the' consumer, except where the tenant makes and maintains a deposit of an amount of money with the City Treasurer equal to the estimated water bills for the premises to be served, to guarantee payment for water service, but in no case shall such deposit be less than Fifteen ($15.00) Dollars in the case of a tenant of residence property and Twenty (20.00) Dollars in the case of all other property, and the deposit shall accompany the application for service. Where no deposits are made or where the deposit is not maintained, the owner of the premises served shall be held responsible for the payment of all water rentals and all other proper charges in connection with water services to said premises, but such payments will be accepted from tenant if tendered by them, but accepting payments from tenants shall not sub- sequently relieve the owner of the premises from the responsibility of paying water rentals or other service charges when due, or relieve the real estate from the lien hereinbef ore provided. Section 2. The rules and regulations as set forth in the Ordinance shall be considered a part of the contract of every person who takes water supplied by the City through the City Water Works, every such person who takes water shall be considered as having expressly agreed to be bound by the provisions of this Ordinance upon his acceptance of water service from said City. Section 3. Any violation of this Ordinance shall constitute a misde- meanor and be punishable by a fine not to exceed One Hundred ($100.00) Dollars and each day said violation occurs shall be considered a separate offense. Section 4. This Ordinance shall repeal only that part or portion of any other Ordinance of the United City of the Village of Yorkville , hereto- fore passed and adopted that conflicts therewith and in all other respects, An Ordinance Pertaining to the Water Works of the United City of the Village of Yorkville, Illinois, and Repealing All Ordinances in Regard to the Water Works Heretofore Passed and Approved, As Published by Authority of the City Council, July 16, 1959", is hereby ratified and confirmed. Section 5. This Ordinance shall be in full force and effect from and after it ' s due passage, approval and publication according to law. PASSED this kday of , A.
